AGREEMENT DATED JULY 11, 1961 FOR JOINT EXER-
CISE OF POWERS FOR CONsTRUCTION, oPERATION AND

PJLITAN WATER DISTRICT OF SOUTHERN CALIFORNIA,
ORANGE COUNTY MUNICIPAL WATER DISTRICT, COASTAL
MUNICIPAL WATER DISTRICT, CITY OF ANAHhIM AND
THE CITY OF SANTA ANA.
WHEREAS, under date of July 11, 1961, The Metropolitan
Water District of Southern California, Orange County Municipal
Water District, Coastal Municipal Water District, the City of
Anaheim and the City of Santa Ana entered into a certain "AGREE-
MENT FOR JOINT EXERCISE OF POWERS FOR CONSTRUCTION, OPERATION
AND MAINTENANCE OF hAST ORANGE COUNTY FEEDER NO. 2," and under
date of July 25, 1962, entered into an "AMENDATORY AGREEMENT TO
AGREEMENT DATED JULY 11, 1961, FOR JOINT EXERCISE OF POWERS FOR
CONSTRUCTION, OPERATION AND MAINTENANCE OF EAST ORANGE COUNTY
FEEDER NO. 2"; and
WHEREAS, it is the mutual desire of said Cities and
Water Districts and The Metropolitan Water District that a
second amendatory agreement to the agreement dated July 11, 1961
be made and entered into providing for a refund of the money
deposited with The Metropolitan Water District, including inter-
est, in excess of the estimated amounts required for completion
of construction and for operation and maintenance to July 1,
1965; the construction of a residence building, including site
and street improvements, at each of the two pressure control
structures; installation of remote control and telemetering
equipment; installation of a venturi meter on the feeder in the
inlet line to the San Joaquin reservoir; operation and mainte-
nance of the entire feeder by Metropolitan Water District, the
total cost of,such operation and maintenance to be allocated
each fiscal year to each party in the same proportion that its
financial participation in the construction costs of the feeder
bears to the total construction cost of the completed feeder,
and not to reaches of the feeder as provided in the agreement
of July 11, 1961; and providing for replacements necessary for
the operation of the feeder; and
WHEREAS, a form of agreement has this day been tendered
to the City Council to be made and entered into by and between
the Cities of Anaheim and Santa Ana, said Water Districts and
The Metropolitan Water District, which agreement the City Council
finds would be for the benefit and best interest of the City and
should be approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the "SECOND AMENDATORY AGREEMENT TO
AGREEMENT DATED JULY 11, 1961 Iva JOINT EXERCISE OF POWERS FOR
CONSTRUCTION, OPERATION AND MAINTENANCE OF EAST ORANGE COUNTY
FEEDER NO. 2, AS AMENDED JULY 25, 1962," this date tendered to
the City Council to be made and entered into by and between The
Metropolitan Water District of Southern California, Orange County
Municipal Water District, Coastal Municipal Water District, the
City of Anaheim and the City of Santa Ana, be, and the same is
hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk be,
and they are hereby authorized to execute said Second Amendatory
Agreement for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 13th day of April, 1965.
