1965-272RESOLUTION N0, 65R -272 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED, WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution recommending denial of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having fixed a time and place for the holding of a public hearing thereon in the manner and as prescribed in Title 18 of the Anaheim Municipal Code, and after having duly held and conducted such public hearing to consider said proposed change of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following the hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reasons for recommending denial of said proposed change in the boundaries of the zone or zones hereinafter mentioned and described; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City, Council did fix the 6th day 3f A pril 1965 as the time, and the City Council Chambers in the C y Hall in the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone in which it is now situated and the incorporation thereof in the zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendations; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows -1- 64 -65 -96 PARCEL NO. 1: That portion of the South of the Southwest k of the Northwest of the Southwest of Section 2, Township 4 South, Range 10 West, in the City of Anaheim, County of Orange, State of California, as said section is shown on a map thereof recorded in book 51, page 10, Miscellaneous Maps, records of said Orange County, described as follows: Beginning at the most Westerly Southwest corner of Tract No. 2022, as per map recorded in book 58, pages 24 and 25, Miscellaneous Maps, records of said Orange County, said Southwest corner being in the West line of Southwest of the Northwest 34 of the Southwest 34 of said Section 2, and running thence East along the Boundary of said Tract 201.77 feet to an angle point therein; thence continuing along said boundary, South 135.00 feet to the South line of said Southwest k of the Northwest k of the Southwest 34; thence West along said South line 200.15 feet to the Southwest corner of said Southwest of the Northwest of the Southwest k; thence North 0 41' 20" West along the West line of said Southwest k of the Northwest k of the Southwest 3, 135.01 feet to the point of beginning. PARCEL NO. 2: Lot 9, Tract 2022, in the City of Anaheim, as shown on a map thereof recorded in book 58, pages 24 and 25, Miscellaneous Maps, records of said Orange County. be excluded from R -A, AGRICULTURAL ZONE, and R -1, ONE- FAMILY RESIDENTIAL ZONE, and incorporated in C -1, GENERAL COMMERCIAL ZONE, upon the following conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along East Street, for street widening purposes, including 15 -foot radius corner returns. 2. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Romneya Drive and along the southerly 105 feet of East Street, for street lighting purposes. 3. That the owners of subject property shall pay to the City of Anaheim the sum of 15c per front foot along Romneya Drive and along the southerly 105 feet of East Street, for tree planting purposes. 4. That the owners of subject property shall deed to the City of Anaheim a 5 -foot public utility overhang easement along the easterly 80 feet of the northerly property line of Parcel 1. 5. That subject property shall be developed substantially in accordance with City of Anaheim Service Station Minimum Site Development Standards, on file with the City. -2- 6. That the completion of these reclassification proceedings is contingent upon the granting of Conditional Use Permit No. 677. 7. That Conditions Nos. 1, 2, 3 and 4 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
