A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE
EXECUTION OF A PIPE LINE LICENSE AGREEMENT
WITH THE ATCHISON, TOPEKA AND SANTA FE RAILWAY
COMPANY GRANTING TO THE CITY A LICENSE TO
CONSTRUCT AND;MAINTAIN ONE PIPELINE 36" IN
DIAMETER ACROSS OR ALONG THE RIGHT OF WAY) OF
SAID RAILWAY COMPANY AT OR NEAR THE STATION
OF ORANGE, ORANGE COUNITY, CALIFORNIA.
WHEREAS, the Atchison, Topeka and Santa Fe Railway
Company, a Kansas corporation, has tendered to the City of
Anaheim a license agreement dated August 2, 1965, licensing
the City of Anaheim to construct, maintain and use, solely for
carrying storm drainage, one pipe line 36" in diameter, across
or along the right of way of the Atchison, Topeka and Santa Fe
Railway Company at or near the station of Orange, Orange County,
California, subject to the terms, covenants and conditions con-
tained in said agreement, the exact location of said pipe line
being more particularly shown by red coloring upon said Railway
Company's print No. L- 3- 27465, dated July 29, 1965, marked "Ex-
hibit A," attached to and made a part of said pipe line license
agreement; and
WHEREAS, said license agreement has this day been
submitted to the City Council for consideration, and the
City Council does find and determine that it would be for
the benefit and best interest of the City of Anaheim to
enter into said license agreement with said Railway Company.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the pipe line license agreement,
dated August 2, 1965, tendered to the City of Anaheim by the
Atchison, Topeka and Santa Fe Railway Company, a Kansas corpora-
tion, licensing the City of Anaheim to construct, maintain and
use, solely for carrying storm drainage, one pipe line 36" in
diameter, across or along the right of way of the Atchison,
Topeka'and Santa Fe Railway Company at or near the station of
Orange, Orange County, California, subject to the terms, cove-
nants and conditions contained in said agreement, the exact loca-
tion of said pipe line being more particularly shown by red
coloring upon said Railway Company's print No. L- 3- 27465, dated
July 29, 1965, marked "Exhibit A,' attached to and made a part
of said pipe line license agreement, be, and the same is hereby
approved and accepted.
AND BE IT FURTHER RESOLVED that the Mayor and City
Clerk be, and they are hereby authorized to execute said
agreement above mentioned for and on behalf of the City of
Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
me this 28th day of September, 1965.
