1965-602RESOLUTION NO. 65R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 65 to consider an amendment to Title 18 of the Ana eim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 10th day of August 19 65 as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit -1- 65 -66 -13 AREA 1: All that land lying within the City boundary lines as de- cribed in the City of Anaheim "Northeast Annexation No. 3, passed by City Ordinance No. 1542 and filed with the Secretary of State, July 10, 1964, located north of the center line of Orangethorpe Avenue. AREA 2: Ali that land lying within the City boundary lines as de- scribed in the City of Anaheim "Northeast Annexation No. 3," passed by City Ordinance No. 1542, and filed with the Secretary of State, July 10, 1964; EXCEPTING THEREFROM that portion lying north of the center line of Orangethorpe Avenue. ALSO EXCEPTING THEREFROM that portion of land lying south- easterly of the northwesterly line of the Santa Ana River, as conveyed to the Orange County Water District by deed recorded December 3, 1937 in Book 919, page 221; October 5, 1938 in Book 961, page 590; February 16, 1939 in Book 984, page 110, and March 4, 1938 in Book 928, page 390, all of Official Records of Orange County, California. ALSO EXCEPTING that portion of land lying southwesterly of the northeasterly line of the Riverside Freeway, as shown on a Highway Right of Way Map entitled "Road VII ORA- 175 -B," dated November, 1952, State of California Department of Public Works, Division of Highways, State of California. AREAS 3 and 4: That portion of land lying southeasterly of the north- westerly line of the Santa Ana River, as conveyed to the Orange County Water District by deeds recorded December 3, 1937, in Book 919, page 221; October 5, 1938 in Book 961, page 590; February 16, 1939 in Book 984, page 110, and March 4, 1938 in Book 928, page 390, all of Official Records of Orange County, California, LYING WITHIN the City boundary lines as described in the City of Anaheim "Northeast Annexation No. 3," passed by City Ordinance No. 1542 and filed with the Secretary of State, July 10, 1964. AREA 5: TFia.t portion of land lying within the City boundary lines as described in the City of Anaheim "Northeast Annexation No. 3," passed by City Ordinance No. 1542 and filed with the Secretary of State, July 10, 1964, lying south of the center line of Glen Avenue, as shown on a Map of the J. D. Taylor Tract, recorded in Book 5, page 16 of Miscellaneous Maps, records of Orange County, California. EXCEPTING THEREFROM that portion lying east of the easterly line of Tract No. 4644, as shown on a Map recorded in Book 168, pages 44 and 45 of Miscellaneous Maps, records of Orange County, California. AREA 6: That portion of land lying within the City boundary lines as described in the City of Anaheim "Northeast Annexation No. 3," passed by City Ordinance No. 1542 and filed with -2- the Secretary of State, July 10, 1964, lying south of the center line of Glen Avenue, as shown on a Map of the J. D. Taylor Tract, recorded in Book 5, page 15 of Mis- cellaneous Maps, records of Orange County, California. EXCEPTING THEREFROM that portion lying west of the easterly line of Tract No. 4644, as shown on a Map recorded in Book 168, pages 44 and 45 of Miscellaneous Maps, records of Orange County, California. be excluded from R -A, AGRICULTURAL ZONE; R -1, ONE- FAMILY RESI- DENTIAL ZONE; R -2, MULTIPLE- FAMILY RESIDENTIAL ZONE; and M -1, LIGHT INDUSTRIAL ZONE, and incorporated in the following zones: That Areas 1, 2, 3 and 4 hereinbefore described shall be changed to R -A, AGRICULTURAL ZONE; That Area 5 hereinbefore described shall be changed to R -1, ONE- FAMILY RESIDENTIAL ZONE; and That Area 6 hereinbefore described shall be changed to R -2, MULTIPLE- FAMILY RESIDENTIAL ZONE. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
