1965-930RESOLUTION NO. 65R -930 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 1740. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from JEROME F. STEHLEY, NICHOLAS J. STEHLEY and WINIFRED STEHLEY, owners of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: Parcel 1. That portion of the west half of the northwest quarter of section 20, Township 4 South, Range 10 West, in the city of Anaheim, county of Orange, state of California, as per map recorded in book 51 page 10 of Miscellaneous Maps, in the office of the county recorder of said county, des- cribed as follows: Beginning at a point on the West line of the northwest quarter of said section 20, South 952.60 feet from the northwest corner thereof, said point of beginning being the southwest corner of that certain 14.46 acre parcel of land conveyed to Lucy Frances Ball by deed recorded in book 32 page 68 of Deeds, records of said Orange County; thence North 10.00 feet along the West line of the north- west quarter of said section 20; thence East 780.66 feet parallel with the South line of said 14.46 acre parcel; thence South 10.00 feet parallel with the East line of the west half of said northwest quarter to the South line of said 14.46 acre parcel; thence West 780.66 feet along said South line to the point of beginning. Parcel 2. The west 480.00 feet of that portion of section 20, Town- ship 4 South, Range 10 West, in the Rancho Los Coyotes, city of Anaheim, county of Orange, state of California, as said section is shown on a map recorded in book 51 page 10 of Miscellaneous Maps, in the office of the county recorder of said county, described as follows: Beginning at a point on the West line of said section 20, South 952.60 feet from the northwest corner of said sec- tion 20; thence East 1331.60 feet; thence South 472.80 feet; thence West 1330.90 feet to the West line of said section 20; thence North 472.80 feet along said West line to the point of beginning. Parcel 3. That portion of the northwest quarter of section 20, Township 4 South, Range 10 West, in the Rancho Los Coyotes, city of Anaheim, county of Orange, state of Califrrnia, as per map recorded in book 51 page 10 of Miscellaneous Maps, in the office of the county recorder of said county, described as follows: Beginning at a point on the West line of said section, South 952.60 feet from the northwest corner thereof; thence East 1331.60 feet; thence South 472.80 feet; thence West 1330.90 feet to said West line; thence North 472.80 feet to the point of beginning. -1- EXCEPT that portion thereof lying easterly of the follow- ing described line: Beginning at a point on the North line of said land, West 417.25 feet from the northeast corner thereof; thence South 0 28' 20" West to the South line of said land. ALSO EXCEPT the West 480.00 feet thereof. Parcel 4. That portion of section 20, Township 4 South, Range 10 West, in the Rancho Los Coyotes, city of Anaheim, county of Orange, state of California, as per map recorded in book 51 page 10 of Miscellaneous Maps, in the office of the county recorder of said county, described as follows: Beginning at a point on the West line of said section, South 952.60 feet from the northwest corner of said sec- tion; thence East 914.35 feet to the true point of begin- ning; thence East 417.25 feet; thence South 472.80 feet; thence West to a line bearing South 0 23' 20" West from the true point of beginning; thence North 0 23' 20" East to the true point of beginning. EXCEPT any portion within the Kellogg Homestead Tract, as per map recorded in book 8 page 50 of said Miscel- laneous Maps. Parcel 5. That portion of the South 14.44 acres of -the North 58.03 acres of the west half of the northwest quarter of sec- tion 20, Township 4 South, Range 10 West, in the Rancho Los Coyotes, city of Anaheim, county of Orange, state of California, as said section is shown on a map recorded in book 51 page 10 of Miscellaneous Maps, in the office of the county recorder of said county, described as fol- lows: Beginning at the northwest corner of said section 20; thence South 1425.40 feet along the West line of said section 20; thence East 1128.00 feet to the true point of beginning; thence East 204.00 feet to the East line of said west half; thence South 471.80 feet; thence West 204.00 feet to a point which is East 1128.00 feet from a point on the West line of said section 20, said last mentioned point being South 1898.20 feet from the north- west corner of said section 20; thence North 472.80 feet; parallel with the West line of said section 20, to the true point of beginning. Parcel 6. The West 12.24 acres of the South 14.44 acres of the North 58.03 acres of the west half of the northwest quarter of section 20, Township 4 South, Range 10 West, in the Rancho Los Coyotes, city of Anaheim, county of Orange, state of California, as per map recorded in book 51 page 10 of Miscellaneous Maps, in the office of the county recorder of said county, more particularly described as follows: Beginning at a point on the West line of said section, South 1425.40 feet from the northwest corner of said -2- section; thence East 1128.00 feet; thence South 472.80 feet parallel with said West line to the South line of said 14.44 acres; thence West 1128.00 feet to said West line; thence North 472.80 feet to the point of beginning. Parcel 7. That portion of the northwest quarter of section 20, Township 4 South, Range 10 West, in the Rancho Los Coyotes, city of Anaheim, county of Orange, state of California, as per map recorded in book 51 page 10 of Miscellaneous Maps, in the office of the county recorder of said county, described as follows: Beginning at a point on the West line of said section, South 1898.20 feet from the northwest corner thereof; thence East 1330.20 feet; thence South 325.30 feet; thence West 1329.70 feet to said West line; thence North 325.30 feet to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on November 8, notice of which said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 1837, Series 1965 -66, recommending that Variance No. 1740 be granted, subject to certain conditions therein set forth; and WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in granting said variance and did set a public hearing thereon to be held on the 14th day of December, 1965, at 7 :00 o'clock P.M. in the City Hall in the City of Anaheim and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: 1. There are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the preserva- tion and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not adver- sely affect the comprehensive general zoning plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted permitting a waiver of the mini- mum front yard setback requirement, on the property herein before described, subject to the following conditions: 1. That a Final Tract Map of subject property shall be submitted to the City Council for approval and recorded in the Office of the Orange County Recorder. 2. That this variance is granted subject to the comple- tion of Reclassification Proceedings No. 65 -66 -55 now pending. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owners, their heirs, successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein.
