A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE
EXECUTION OF AN AGREEMENT WITH YORBA LINDA
COUNTY WATER DISTRICT, WITH REFERENCE TO
WATER AND SEWER SERVICES.
WHEREAS, the City of Anaheim and Yorba Linda County
Water District both have the power to provide water and sewer
service within their respective boundaries; and
WHEREAS, the boundaries of the City and the boundaries
of said District now partially overlap and may in the future,
through annexation, increase in the overlap area; and
WHEREAS, the Master Plan of said District for storage,
transmission, distribution and water supply systems has been
designed for the purpose of providing water service to the entire
area within the boundaries of said District, and said District
has constructed and installed mains in the area of said Yorba
Linda County Water District which overlap with the boundaries of
the City; and
WHEREAS, said District has adopted a Master Plan of
sanitary sewer service for the entire area within the boundaries
of said District and has entered into numerous contracts for
construction of such facilities and the refunding of the cost
of oversizing or extensions thereof; and
WHEREAS, the Master Plan of the City has been made
flexible in the area of service by said District in anticipation
of present and future annexation of territory by the City; and
WHEREAS, the potential conflict in powers and duties
possessed by both the City and said District may result in mis-
understanding and operational difficulties, duplication of costs
in providing such service, and litigation and substantial expense
on the part of both parties; and
WHEREAS, it is the mutual desire of the City and said
District to intelligently resolve problems incident to this con-
flict in an amicable manner and to avoid unnecessary duplication
of water and sewer services, allowing each agency to continue
its existence and services unimpaired, and said parties desire
to enter into a contract which will enable them to accomplish
this; and
WHEREAS, a form of agreement, dated November 30, 1965,
has this day been submitted to the City Council to be made and
entered into between the parties, which agreement the City
Council finds will accomplish the object desired, and should be
approved.
NOW, THEREFORE BE IT RESOLVED by the City Council of
the City of Anaheim that the agreement hereinbefore mentioned,
dated November 30, 1965, and this day submitted to the City
Council to be made and entered into by and between the City of
Anaheim and Yorba Linda County Water District, be and the same
is hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk be
and they are hereby authorized to execute said agreement for and
on behalf of the City of Anaheim.
