1965-798RESOLUTION NO. 65R -798 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 65-66 -40 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 2�6th day of ncrnhPr 19 6 as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: 65 -66 -40 The Northerly 57 feet of the Southerly 114 feet of that portion of Vineyard Lot G -6, as shown on a map thereof recorded in book 4, pages 629 and 630, Deeds, records of Los Angeles County, described as follows: Beginning at a point 144.75 feet Westerly measured at right angles from the monumented center line of South Palm Street and 38.25 feet Northerly measured at right angles from the monumented center line of West Water Street; thence Northerly parallel with said center line of South Palm Street, 513.25 feet to the Northerly line of the land conveyed to Joseph William Heinz, et ux., by deed dated November 19, 1925, and recorded in book 619, page 4, Deeds, records of said Orange County; thence Easterly along said Northerly line to a point 34.75 feet Westerly at right angles from the monumented center line of South Palm Street; thence Southerly along a line parallel to said monumented center line of South Palm Street, 513.25 feet, more or less, to a point in a line 38.25 feet North- erly measured at right angles from the monumented center line of West Water Street, which line is the Northerly line of West Water Street as fixed by that certain deed recorded January 8, 1927, in book 10, page 81, Official Records, in the office of the County Recorder of said Orange County; thence Westerly along said Northerly line of West Water Street 110 feet to the point of beginning. NOTE 1: Said land is shown on a Licensed Surveyor's Map recorded in book 7, page 16, Record of Surveys, in the office of the County Recorder of said Orange County. be excluded from R -1, ONE- FAMILY RESIDENTIAL ZONE, and incor- porated in C -1, GENERAL COMMERCIAL ZONE, upon the following conditions: 1. That the owner of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Harbor Boulevard, for street widening purposes. 2. That the owner of subject property shall pay to the City of Anaheim the sum of 15c per front foot along Harbor Boulevard, for tree planting purposes. 3. That sidewalks shall be installed along Harbor Boule- vard at the ultimate location and grade, as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer, prior to final building inspection. 4. That trash storage areas shall be provided in accord- ance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. 5. That the owner of subject property shall deed to the City of Anaheim a strip of land five (5) feet in width along the westerly property line, for alley widening purposes. 6. That all vehicular access rights to Harbor Boulevard shall be dedicated to the City of Anaheim. -2- 7. That the existing structure on subject property shall conform to the Uniform Building Code as adop- ted by the City of Anaheim for commercial structures; and that all required alterations shall be completed prior to final building inspection. 8. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibits Nos. 1, 2 and 3. 9. That Conditions Nos. 1, 2, 5 and 6 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
