91-082 RESOLUTION NO. 91R-82 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM CALIFORNIA, RECITING THE FACT OF THE SPECIAL MUNICIPAL ELECTION HELD ON MARCH 5, 1991, DECLARING THE RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW. WHEREAS, a Special Municipal Election was held and conducted in the City of Anaheim, California, on Tuesday, March 5, 1991, as required by law; and WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in charter cities; and WHEREAS, pursuant to Resolution No. 90R-417 adopted November 27, 1990 the County Registrar of Voters canvassed the returns of the election and has certified the results to this City Council, the results are received, attached and made a part hereof as Exhibit ~A#. NOW THEREFORE THE CITY COUNCIL OF THE CITY OF ANAHEIM, CALIFORNIA, DOES RESOLVE DECLARE DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That the whole number of ballots cast in the City except absent voter ballots was 10,277. That the whole number of absent voter ballots cast in the City was 3,760 making a total of 14,037 ballots cast in the City. SECTION 2. That the measures voted upon at the election are as follows: A MOBILE HOME RENT CONTROL. Shall the Ordinance submitted by initiative petition to limit and control YES the amounts of rent which can be charged to tenants for occupancy of space in mobile home parks in the NO City of Anaheim be adopted? B DIRECT ELECTION OF MAYOR. Shall Sections 500, 501, 503 and 504 of the City Charter be amended to (1) increase the term of the elected Mayor to four years, make the office of Mayor a separate City Council seat, YES allow any qualified resident to run for Mayor, and prohibit candidates from seeking election as both Mayor NO and City Council member at the same election, which amendments would become effective in 1994; and (2) make other changes relating to the offices of Mayor and City Council member? C CITY COUNCIL SALARY LIMIT. Shall Section 502 of the City Charter be amended to limit the salaries of YES members of the City Council and the Mayor to the same amounts as established and authorized by state law for NO city council members in general law (non-charter) cities? D ADVISORY VOTE ONLY- FINANCING OF NEW POLICE, FIRE AND pARAMEDIC SERVICES. Should the City Council create YES a Public Safety Benefit Assessment District throughout the City of Anaheim to finance the cost of providing NO additional police officers, firefighters and paramedics for the City? SECTION 3. That the number of votes given at each precinct and the number of votes given in the city for and against the measures were as listed in Exhibit "A" attached. SECTION 4. That as a result of the election, a majority of the voters voting on measures A and D, relating to mobile home rent stabilization and the advisory issue on assessment districts for public safety personnel did not vote in favor of these, and that the measures were not carried and shall not be deemed adopted. SECTION 5. That as a result of the election, a majority of the voters voting on measures B and C, relating to direct election of the mayor and City Council salary limits did vote in favor of these, and that the measures were carried and shall be deemed adopted and ratified. SECTION 6. The City Clerk shall enter on the records of the City Council of the City, a statement of the result of the election, showing (1) the whole number of ballots cast in the City; (2) the measures voted upon (3) the number of votes given at each precinct for and against each measure (4) the total number of votes given for and against each measure. SECTION 7. That the City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
