3156ORDINANCE NO. 3156 Ali ORDINANCE OF THE CITY OF ANAHEIM AMEND- I:1G TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND TIIAT : WHEREAS, the City Council did adopt its Resolution :4o. 72R-559 determining that a change or changes in the zone or zones hereinafter mentioned and des- cribed should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: Tract No. 6569, Recorded in Book 319, pages 40, 41 and 42 of Miscellaneous Maps in the office of the Recorder of Orange County, California. now is the R -A, AGRICULTURAL ZONE, and that it be changed to and incorporated in the R-1, ONE -FAMILY RESIDENTIAL ZONE, subject to the following conditions: 1. That the owner(s) of subject property shall pay to the City of Anaheim the appropriate park and recreation in - lieu fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 2. That subject property shall be developed substan- tially in conformance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1 through 14 provided, however, that all lots along the north property line, except for Lot No. 28, shall be of one-story construction and that where garage setbacks are proposed at ten feet or less, three -car garages with automatic garage door openers shall be constructed as stipulated to by the petitioner; and, further provided, that Lot No. 28 shall have house plan No. 944, as stipulated by the petitioner. -1- 72-73-21 3. That these Reclassification proceedings are granted subject to the approval and completion of Variance No. 2436 and _ Tentative Map of Tract No. 6569. SECTION 2. The City Zoning Map shall be, and the same is hereby amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circu- lated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
