3103ORDINANCE NO. 3103 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 1 OF THE ANAHEIM MUNICIPAL CODE BY ADDING THERETO CHAPTER 1.13 AND INCLUDING THEREIN SECTIONS 1.13.010 TO 1.13.080 BOTH INCLUSIVE, RELATING TO CREATING AND ESTAB- LISHING A "POLICE RESERVE CORPS," PROVIDING FOR ITS USE AND CONTROL AND FOR COMPENSATION IN THE EVENT OF INJURY, DISABILITY OR DEATH OF ITS MEMBERS. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1: That Title 1 of the Anaheim Municipal Code be, and the same is hereby amended by adding thereto Chapter 1.13 reading as follows: "CHAPTER 1.13 POLICE RESERVE CORPS "SECTION 1.13.010 POLICE RESERVE CORPS CREATED AND ESTABLISHED "A Police Reserve Corps (hereinafter referred to as the 'Corps') hereby is created and established as an organi- zation which shall be composed of persons who shall have been appointed and sworn in as members thereof (sometimes herein- after referred to in the singular as 'Member' or in the plural as 'Members') by the Chief of Police (hereinafter referred to as 'The Chief') or by an authorized person designated by the Chief for such purpose. The number of members of the Corps may be increased by not to exceed 100 during any fiscal year commencing with the Fiscal Year 1971-1972, but shall not exceed 100 at any time. Members shall be volunteer workers only and shall not be deemed to be employees of the City or of the Police Department for any purpose other than for the purposes of Section 1.13.080 of this Ordinance and shall serve gratui- tously." "SECTION 1.13.020 QUALIFICATIONS FOR MEMBERSHIP "The Chief of Police, with the assistance of the Personnel Department, shall establish the requirements to be met by persons to qualify to become members of the Corps. Such requirements shall include but need not be limited to physical, mental, aptitude, personality inventory and character standards and the mandatory training of such persons, for a minimum of 200 hours, in all fields of police work and activity in accordance with the California Peace Officers Standards or, in the discretion of the Chief, better or higher standards. It shall be the duty of the Chief to provide such training for such persons and also any further training for members which he or the Personnel Department may deem to be necessary or desirable. -1- The City Department, shall to become members Physician, as designated by the Personnel determine the physical fitness of persons and of members to continue as such, Whenever all of the requirements to quality to become a member shall have been met by any person and he shall have certified in writing that he has read the provisions of this Ordinance, he may be appointed and sworn in as a member by the Chief or by any authorized person designated by the Chief for such purpose. However, the Chief or any such designated subordinate with or without cause therefor, need not appoint and swear in any particular person as a member. The Chief, with or without cause therefor, terminate any member at any time and any member may as such at any time by written notification thereof Chief. Any member who shall cease to be such shall at the time he shall cease to be such, all property which shall have been issued to him pursuant to the of this Ordinance or otherwise. may resign to the surrender, of the City provisions The Chief, by order, may either decrease the number of members of the Corps, or subject to the restrictions and limitations contained in this Ordinance, increase the number of members thereof." "SECTION 1.13.030 CONTROL AND RULES AND REGULATIONS "The Chief, subject to the restrictions and limita- tions contained in this Ordinance, shall have complete authority and control over the Corps and its members and may delegate the exercise thereof in whole or in part to any of his subordi- nates. The Chief or any of his subordinates whom he shall have designated therefor may establish by order which may change from time to time, rules and regulations governing the Corps and its members providing for the maintenance of discipline and assigning of each member to perform police duties in a patrol car with a member of the Police Department (hereinafter referred to as a 'regular police officer'), in traffic control, in crowd control or in specialized assignments." "SECTION 1.13.040 MINIMUM ASSIGNMENTS AND EXPENSES "Each member of the Corps shall serve as such for at least 16 -hours each calendar month. Corps members will not receive salary, wages or compensation for services rendered; however, at the discretion of the Chief, reimbursement can be made for expenses incurred in the line of duty." "SECTION 1.13.050 STATUS AS PEACE OFFICER "Each member, while serving as such, shall have status as a police officer or as a peace officer as provided by Sec- tion 830.6(a) of the California Penal Code and as such, shall have the same power and authority, except to the extent that the same may be restricted or limited by the Chief as does a regular police officer while he is serving as such. However, each member, at all times other than while serving as such: (1) shall not have status as a police officer or as a peace officer; (2) shall not have any power, authority or duties as a police officer or as a peace officer; and (3) shall not represent, identify or hold himself out to be a police officer or a peace officer." -2- "SECTION 1.13.060 EQUIPMENT "Each member of the Corps shall be issued at City expense and at no expense to him, items as follows; (1) a uniform which shall be identical to that issued to a regular police officer; (2) equipment which shall include but need not be limited to a firearm, a regulation police baton, a regula- tion belt and holster, a helmet, all of whish, shall be identical to those issued to a regular police officer; and (3) an identification card and badge which shall show him as being a member of the Police Reserve Corps. Each member, while serving as such, shall wear, display or carry, as the case may be, every item, except as hereunder provided, which shall have been issued to him as a member, whether or not hereinabove mentioned, provided, however, that he shall not carry any firearm unless he shall have qualified for and received a gun permit signed by the Chief. Each member at all times other than while serving as such shall not wear, display or carry, as the case may be, any such item unless he shall do so in such a manner that the item, it if were to be seen by another person, could not be identified by him as being one issued to a regular police officer or to a member of the Corps. Each item which shall be issued to a member, whether or not hereinabove mentioned, shall remain and be the property of the City." "SECTION 1.13.070 MISDEMEANOR TO IMPERSONATE CORPS MEMBERS - PENALTY "It shall be a misdemeanor, punishable by imprison- ment for not to exceed six (6) months or by a fine not to exceed $500, or both, for any person, not a member of the Corps; (1) To wear, display or carry, as the case may be, any items which shall have been issued to any member of the Corps; or (2) To represent, identify or hold himself out, in any manner whatsoever, to be a member of the Corps or to have any connection with the Corps." "SECTION 1.13.080 COMPENSATION IN EVENT OF INJURY, DISABILITY OR DEATH OF MEMBERS OF CORPS "For the purposes of this section only, each member of the Corps shall be an employee of the City only while serv- ing any assigned shift as a member or while receiving further training as such, and any person shall be an employee of the City only while receiving any required training to qualify to become a member of the Corps. If any such member or any such person were to suffer or sustain any illness or injury proximately caused by, arising out of, and in the course of, his service or training while an employee of the City, as hereinabove limited, he shall be entitled to all of those Workmen's Compensation benefits, no more or no less, to which he, pursuant to the provisions of Division IV of the Labor Code of the State of California but only upon the conditions therein provided therefor, would be entitled if he were a regular police officer receiving a monthly salary as such. -3- If any such member or any such person were to die as a result of any illness or injury proximately caused by, arising out of, and in the course of, his service or train- ing while an employee of the City, as hereinabove limited, those persons who, if the deceased had been a regular police officer receiving a monthly salary as such, would be entitled to any Workmen's Compensation benefits, pursuant to the pro- visions of Division IV of the Labor Code of the State of California, shall be entitled, but only upon the conditions provided therefor in said Division IV, to the same such benefits, no more or no less. SECTION 2. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fif- teen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
