3749ORDINANCE NO. 3749 AN ORDINANCE OF THE CITY OF ANAHFIH AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 71R-220 determining that a change or changes in the zone or zones hereinafter mentioned and des- cribed should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: Lot 14 in Block 36 of the Yorba Linda Tract, in the County of Orange, State of California, as per map recorded in Book 5, Pages 17 and 18 of Miscellaneous Maps, in the office of the County Recorder of said county. Except the northerly 143.52 feet thereof. Also except the southerly 180 feet thereof. Also except the easterly 40 feet thereof. -1- ATTY-28 70-71-47(17) & (18) That portion of the Third Class Land allotted to.Y. Y. De Cota, as described in the Final Decree of Partition of the Rancho Canon de Santa Ana, a certified copy of which was recorded February 8, 1874 in Book 28, page 158 of Deeds, records of Los Angeles County, California, together with that portion of Lot 5 of Tract No. 925, as shown on a Map recorded in Book 29, pages 42 to 45 inclusive of Miscellaneous Maps, records of Orange County, California, described as follows: Parcel 1: Beginning at the Northeast corner of said Lot '5; thence South 10 02' 52" West 1324.60 feet. along the Easterly line of said Lot 5 to a point on the Northerly line of Parcel 138.01 as described in the :deed to the County of Orange by deed recorded in Book 8432, page 316 of Official Records in the office of said County Recorder, said point being on a curve concave Northerly and having a radius of 1947.00 feet, a radial line to said point bears South 80 04' 21" East; thence Westerly along said Northerly line along said curve through a central angle of 7° 52' 31" a distance of 267.61 feet; thence South 890 48' 10" West 1018.28 feet along said Northerly line and along the Northerly line of Parcel 137.01 as described in deed to County of Orange recorded in Book 8308, page 472 of said Official Records to a point on the Easterly line of the land conveyed to Warner-Lambert Pharmaceutical Co. by deed recorded in Book 7563, page 262 of said Official Records; thence North 00 15' 34" East 1619.41 feet to a point on the Southerly right of way line of the Atchison, Topeka and Santa Fe Railway Company as described in deedrecorded in Book 232, page :178 of Deeds, in the office of said County Recorder; thence South 781 11' 20" East 1329.97 feet along said Southerly line and along the Northerly line of said Lot 5 to the point of beginning. Excepting therefrom all oil, gas, minerals, and other hydrocarbon substances in, upon and under said subject property below a depth of 500 feet from the surface thereof without the right of surface entry for the purpose of removing or extracting the same not excepting, however, the drill site and the rights to. drill from said drill site as set forth: in the Quitclaim deeds recorded April 10, 1967, in Book 822.0.,. pages: 688 and 724 of Official Records of Orange :County. -2- PARCEL 2: The North half of La Palma Avenue as described. in deed to the .County. of Orange recorded July 12, 1967 in Book 8308, page 472 of Official Records of Orange County, California. now is "RS -A-43,000" RESIDENTIAL/AGRICULTURAL ZONE, and that it be changed to and incorporated in "ML" LIMITED INDUSTRIAL ZONE, subject to the following conditions: 1. That all engineering requirements. of the City of Anaheim such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by. the City Engineer and in accordance with the standard plans and specifications on file in the Office of the City Engineer at the time the property is developed. 2. That the owners of subject property shall install street lighting on all streets. within the area as required by the Director of Public Utilities at the time the property is developed. 3. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 4. That subject property shall be served with under- ground utilities SECTION 2.. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set .forth., and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map tobe added to the City Zoning Map showing the changes hereby approved and adopted. SEC'TI'ON 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen.
