3739ORDINANCE NO. 3739 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MU14ICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 75R_�69 determining that a change or changes in the zone or zones hereinafter mentioned and des- cribed should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and.the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: That portion of Sections 7, 8, 17 and 18, Township 4 South, Range 8 West, S.B.B. & M., described as follows: Beginning at a point in the Northwesterly line of that certain land allotted to Benjamin and Thomas Flint and Llewellyn Bixby in the Partition of the Rancho Santiago de Santa Ana; said point being located therein North 35° 50' 38" East 3341.66 feet from the Northeast corner of the land described in Deed to Santiago Farmers Association, recorded in Book 98, page 544 of Deeds in the office of the County Recorder of Los Angeles County, California; thence leaving said Northwest- erly line, North 540 09' 22" West 15314.53 feet to -1- ATTY-28 74-75-28 the True Point of Beginning; thence South 640 47' 16" West 145.71 feet to the beginning of a tangent curve concave Southeasterly having a radius of 200.00 feet; thence Southwesterly along said curve through a central angle of 45° 15' 33" an arc distance of 157.98 feet to the beginning of a tangent reverse curve concave Northerly having a radius of 200.00 feet; thence Westerly along said curve through a central angle of 980 51' 37" an arc distance of 345.09 feet to the beginning of a tangent reverse curve concave Southwesterly having a radius of 400.00 feet; thence Northwesterly along said curve through a central angle of 690 23' 13" an arc distance of 484.41 feet; thence tangent to said curve South 490 00' 04" West 167.66 feet to the beginning of a tangent curve concave North- westerly having a radius of 6600.00 feet; thence Southwesterly along said curve through a central angle of 130 32' 55" an arc distance of 141.88 feet to the beginning of a tangent reverse curve concave Southeasterly having a radius of 300.00 feet; thence Southwesterly along said curve through a central angle of 560 38' 01" an are distance of 296.53 feet; thence tangent to said curve South 50 54' 58" West 190.00 feet to the beginning of a tangent curve concave Northwesterly having a radius of 400.00 feet; thence Southwesterly along said curve through a central angle of 410 09' 40" an are distance of 287.36 feet to the beginning of a tangent reverse curve concave Southeasterly having a radius of 400.00 feet; thence Southwesterly along said curve through a central angle of 190 13' 08" an arc distance of 134.17 feet; thence tangent to said curve South 27° 51' 30" West 160.00 feet to the beginning of a tangent curve concave North- westerly having a radius of 300.00 feet; thence Southwesterly along said curve through a central angle of 49° 38' 30" an arc distance of 259.92 feet; thence tangent to said curve South 770 30' 00" West 140.74 feet; thence North 120 30' 00" West 732.00 feet; thence North 440 05' 00" East 367.00 fee- thence North 140 23' 00" East 201.00 feet; thence North 700 58' 00" East 92.00 feet; thence North 450 59' 00" East 331.00 feet; thence North 550 05' 00" East 585.00 feet; thence North 190 11' 00" East 122.00 feet; thence North 440 19' 00" East 594.00 feet; thence South 451 41' 00" East 220.00 feet; thence North 810 46' 00" East 409.00 feet; thence South 000 26' 00" West 365.00 feet to the beginning of a tangent curve concave Easterly having a radius of 500.00 feet; thence Southerly along said curve through a -2- central angle of 25° 38' 50" an arc distance of 223.81 feet to the True Point of Beginning. now is "RS -A-43,000" RESIDENTIAL/AGRICULTURAL ZONE, and that it be changed to and incorporated in "RS -HS -22,000" RESIDENTIAL, SINGLE-FAMILY HILLSIDE ZONE, subject to the following conditions: 1. That subject property shall be served by under- ground utilities. 2. That a final tract map of subject property shall be submitted to and approved by the City Council and then be recorded in the office of the Orange County Recorder. 3. That drainage of said property shall be disposed of in a manner satisfactory to the City Engineer. If, in the preparation of the site, sufficient grading is required to necessitate a grading permit, no work on grading will be permitted between October 15th and April 15th unless all required off-site drainage facilities have been installed and are operative. Positive assurance shall be provided the City that such drainage facilities will be completed prior to October 15th. Necessary right-of-way for off-site drainage facilities shall be dedicated to the City, or the City Council shall have initiated condemna- tion proceedings therefor (the costs of which shall be borne by the developer) prior to commencement of grading operations. The required drainage facilities shall be of a size and type suffi- cient to carry runoff waters originating from higher properties through said property to ultimate disposal as approved by the City Engineer. Said drainage facilities shall be the first item of construction and shall be completed and be functional throughout the tract and from the downstream boundary of the property to the ultimate point of disposal prior to the issuance of any final building inspections or occupancy permits. Drainage district reimbursement agreements may be made available to the developers of said property upon their request. 4. That grading, excavation and all other construc- tion activities shall be conducted in such a manner so as to minimize the possibility of any silt originating from this project being carried into the Santa Ana River by storm water originating from or flowing through this project. 5. That Conditions Nos. 1, 2, 3 and 4, above- mentioned, shall be complied with prior to final building and zoning inspection. SECTION 2. The City Zoning flap shall be, and the same is hereby, amended and the property above-described shall be excluded from -3- the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning a/iap, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning I1ap showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circu- lated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
