AN ORDINANCE OF THE CITY O. ANAU.EIN REPEALING
SUBSECTIONS 18.03.030.010 AND 13.03.040.020 OF
TITLE 18, CHAPTER 10.0 3 , AND ADDING NEW SUB-
SECTIONS 18.03.030.010 AND 18.03.040.020 TO
TITLE 18, CHAPTER 18.03 RELATING TO ZONING.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
SECTION 1.
That Subsections 18.03.030.010 and 18.03.040.020 of Title
18, Chapter 18.03, of the Anaheim Municipal Code be, and the same
are hereby, repealed.
SECTION 2.
That new Subsections 18.03.030.010 and 13.03.040.020 of
Title 18, Chapter 18.03, be, and the same are hereby, added to the
Anaheim municipal Code to read as follows:
"18.03.030.010 UNLISTED USES PERMITTED.
The City Council does further find and determine that
it is impossible to set out in the code or anticipate
all of the uses that property owners may wish to make
of their lands, buildings or improvements and where a
use is not authorized or ;.mentioned in any zone through-
out the City, or ambiguity e«ists concerning the
appropriate classification and procedure for the auth-
orization of a particular use or type of development
within the meaning and intent of this code, said use or
type of development may be authorized by conditional
use permit (C.U.P.) until such time as this code is
amended in accordance with provisions of this chapter
designating the prober zone or procedure by which said
use or type of development shall thereafter be estab-
lished. Further, any use not expressly authorized or
permitted in a particular zone (but which is authorized
in another zone) which the Planning Director, or his
designated representative, finds to be similar to, and
compatible with, the uses permitted or conditionally
permitted in said zone, shall be c+eemed a use condi-
tionally permitted in said zone, provided that a condi-
tional use permit is first obtained therefor pursuant
to the provisions of this Chapter."
"18.03.040.020 AUrL. HIr,Y T D CONDITIONS.
The Planning Commission shall have authority, as an
administrative act, subject to the provisions of this
Chapter, to grant, upon such conditions and safeguards
as it may deterimine, such variances from the provisions
of this title as may be in harmony with its general pur-
pose and intent, so that the spirit of this title shall
be observed, public safety and welfare secured and sub-
stantial justice done. The sole purpose of any variance
shall be to prevent discrimination, and no variance
shall be approved which would have the effect of grant-
ing a special privilege not shared by other property in
the same zone and vicinity. A variance shall not be
granted for a parcel of property which authorizes a use
or activitiv which is not othenAse expressly authorized
by the zone regulation governing the parcel of property.
SECTION 3.
The City Clerk shall certify to the passage of this or-
dinance and shall cause the same to be printed once within fifteen
(15) days after its adoption in the Anaheim Bulletin, a newspaper
of general circulation, printed, published and circulated in said
City, and thirty (30) days from and after its final passage, it
shall take effect and be in full force.
THE FOREGOING ORDINANCE is approves' and signed by me
