3709ORDINANCE NO. 3709 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MU14ICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 67R-310 determining that a change or changes in the zone or zones hereinafter mentioned and des- cribed should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: PARCEL 1: That portion of the land of Dreyfus and others, as shown on the map of Anaheim Extension, surveyed by William Hamel, a copy of which is shown in Book 3, Pages 162 et seq., entitled Los Angeles County Maps, described as follows: Commencing at the intersection of the Easterly line of West Street 66.00 feet wide, as shown on a map of the replat of Orchard Park Tract, recorded in Book 7, page 6, Miscellaneous Maps, records of Orange County, California, with the Southwesterly line of Manchester Avenue, 100.00 feet wide as described in Parcel 2 of Final Order of Condemnation in the Supe- rior Court Case No. 33172, a certified copy of which -1- 66-67-61(81) ATTY-28 Final Order is recorded November 7, 1936, in Book 847, page 478, Official Records; thence South 150 42' 40" East 191.61 feet along the Easterly line of said West Street to an angle point in the Southwest- erly line of land described in deed to State of �. California, recorded April 8, 1942, in Book 1145, page 80 Official Records, said point being the true point of beginning; thence South 15° 42' 40" East 1011.67 feet along the Easterly line of said West Street to the North line of West Vermont Avenue, also known as Broad Street, as shown on said map of survey of Anaheim Extension; thence North 74° 29' 56" East, along the Northerly line of said West Ver- mont Avenue, 565.07 feet to said Southwesterly line of Manchester Avenue as described in said Final Order of Condemnation recorded in book 847, page 478, Official Records; thence North 40° 49' 41' West 668.99 feet along said Southwesterly line to the Northerly terminus of Parcel 1 of the deed to T. A. Yungbluth, and others recorded in book 821, page 285, Official Records; thence South 160 36' 41" East along said tangent course 109.70 feet to the Southwesterly line of land described in deed to State of California, recorded May 19, 1950, in book 2015, page 49, Official Records; thence North 400 49' 41" West 580.84 feet along said Southwesterly line to the Southeasterly line of said land of the State of California, recorded in book 1145, page 80, Official Records; thence South 61° 31' 56" West, 37.20 feet to the point of beginning. Together with the Northeast 1/2 of West Street ad- joining said land on the Southwest. Excepting therefrom that portion lying Northerly of the South line of Parcel No. 2, as shown on a Map filed in Book 52, page 39 of Parcel Maps in the office of the County Recorder of Orange County, California, and the Westerly extension thereof. PARCEL 2: That portion of the North half of Vermont Avenue vacated by Resolution No. 69R-351 of the City Council of the City of Anaheim, a certified copy of which was recorded June 23, 1969 in Book 8998, page 406 of Offi- cial Records of Orange County, California, lying west- erly of the Southwesterly line of Manchester Avenue as described in that certain Final Order of Condemnation in the Superior Court Cast No. 33172, a certified copy of which was recorded November 7, 1936 in Book 847, page 478 of said Official Records. -2- now is "ML" LIMITED INDUSTRIAL) ZONE and that it be changed to and incorporated in "C-R" COMMERCIAL RECREATION ZONE, subject to the following conditions: 1. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot for street light- ing purposes, said amount to be paid at the time the property is developed. 2. That the owners of subject property shall pay to the City of Anaheim the sum of 60 cents per front foot for tree planting purposes, said amount to be paid at the time the property is devel- oped. 3. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspec- tion. 4. That all air conditioning facilities shall be properly shielded from view and shall be in architectural conformance with the structure. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and cir- culated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
