A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ANAHEIM ESTABLISHING A
CLASS OF PERSONS EXEMPT FROM THE
UTILITY USERS' TAX SET FORTH IN
CI{APTER 2.13 OF TITLE 2 OF THE
ANAHEIM MUNICIPAL CODE.
WHEREAS, the City Council of the city of Anaheim has
heretofore adopted Chapter 2.13 of Title 2 of the Anaheim
Municipal Code establishing a Utility Users' Tax; and
. WHEREAS, Section 2.13.170 of said Chapter 2.13 of Title
2 of the Anaheim Municipal Code provides that the city Council
may, by order or resolution, establish one or more classes of
persons or one or more classes of utility service, otherwise
subject to payment of a tax imposed by said Chapter, which
classes of persons or service shall be exempt, in whole or in
part, from such tax; and
WHEREAS, the City Council hereby finds and determines
that the class of persons hereinafter specified should be exempt
from the payment of any taxes otherwise required to be paid by
such persons pursuant to Chapter 2.13 of Title 2 of the Anaheim
Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim as follows:
SECTION 1. LOW INCOME EXEMPTION
The taxes imposed by Chapter 2.13 of Title 2 of the
Anaheim Municipal Code shall not apply to, and the City Council
hereby exempts therefrom, any service user in or upon any
residential unit occupied by such individual when the combined
total adjusted gross income (as such term is used for purposes of
the California personal income tax law) of all members of the
household in which such individual resided was less than Twenty
Thousand Dollars ($20,000.00) for (i) the calendar year
immediately preceding the year in which an application for
exemption is filed and (ii) any period (on an annualized basis)
during which such exemption shall remain in effect.
SECTION 2. DEFINITIONS
Except as otherwise expressly specified herein, the
words and terms used in this resolution shall be with reference
to, and shall have the same meanings as, the words and terms set
forth and defined in Chapter 2.13 of title 2 of the Anaheim
Municipal Code. '~-
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 20Lh day of
