3660ORDINANCE NO. 3660 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 76R-387 determining that a change or changes in the zone or zones hereinafter mentioned and des- cribed should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the makinq of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That the owner of subject property shall pay to the City of Anaheim the appropriate parr and recreation in -lieu fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 2. That drainage of said property shall be disposed of in a manner satisfactory to the City Engineer. If, in the preparation of the site, sufficient grading is required to necessitate a grad- ing permit, no work on grading will be permitted between October 15th and April 15th unless all required off-site drainage facili- ties have been installed and are operative. Positive assurance shall be provided the City that such drainage facilities will be completed prior to October 15th. Necessary right-of-way for off- site drainage facilities shall be dedicated to the City, or the City Council shall have initiated condemnation proceedings therefor -2- (the costs of which shall be borne by the developer) prior to the commencement of grading operations. The required drainage facili- ties shall be of a size and type sufficient to carry runoff waters originating from higher properties through said property to ulti- mate disposal as approved by the City Engineer. Said drainage facilities shall be the first item of construction and shall be completed and be functional throughout the tract and from the down- stream boundary of the property to the ultimate point of disposal prior to the issuance of any final building inspections or occu- pancy permits. Drainage district reimbursement agreements may be made available to the developers of said property upon their re- quest. 3. That grading, excavation, and all other construction activities shall be conducted in such a manner so as to minimize the possibility of any silt originating from this project being carried into the Santa Ana River by storm water originating from or flowing through this -project. 4. That the owner(s) of subject property shall pay appropri- ate drainage assessment fees to the City of Anaheim as determined by the City Engineer prior to issuance of a building permit. 5. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. u. That appropriate water assessment fees as determined by the Director of Public Utilities shall be paid to the City of Anaheim prior to the issuance of a building permit. 7. That the removal of any specimen trees shall be sub- mitted for review by the Planning Department and subject to the regulations pertaining to tree preservation in the Scenic Corridor Overlay Zone. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and _trade a part of the zone or zones as above set forth, and said. City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of -this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the i1naheim Bulletin, a newspaper of general circulation, printed, published and cir- culated in said City, and. thirty (30) days frorl and after its final passage, it shall take effect and be in full force. -3- THE FOREGOING ORDR-TANCE is approved and signed by me this ist day of March , 1977.
