3656FOLLOWS: ORDINANCE NO. 3656 AN ORDINANCE OF THE CITY OF ANAHEIM REPEAL- ING TITLE 15, CHAPTER 15.50 OF THE ANAHEIM MUNICIPAL CODE AND ADOPTING THE 1976 EDITION OF THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS, UNIFORM MECHANICAL CODE, WITH AMEND14ENTS THERETO, AND AMENDING TITLE 15, BY ADDING THERETO A NEW CHAPTER 15.50. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1. That Title 15, Chapter 15.50 of the Anaheim Municipal Code be, and the same is hereby, repealed. SECTION 2. That Title 15 of the Anaheim Municipal Code be, and the same is hereby, amended by adding thereto a new Chapter 15.50 to read as follows: "CHAPTER 15.50 - MECHANICAL CODE SECTION 15.50.001 APPROVAL OF CODE The City Council does hereby find and determine, as the result of investigation and tests conducted by the City and its Building Official, that the Uniform Mechanical Code, 1976 Edition, of the International Conference of Building Officials and the International Conference of Plumbing and Mechanical Officials is an approved Code for adoption by reference within the meaning of Section 50022.1 of the Government Code of the State of California. SECTION 15.50.010 ADOPTION OF CODE Pursuant to the provisions of Sections 50022.1 to 50022.8, both inclusive, of the Government Code of the State, the City of Anaheim does hereby adopt by refer- ence the Uniform Mechanical Code, 1976 Edition, with amendments thereto and the Appendices; three copies of said Code shall be filed in the office of the City Clerk of the City of Anaheim at least fifteen days preceding the hearing, hereinafter provided for and shall be kept there for public inspection while said Code is in force; all of which copies shall be certi- fied to be true copies by the City Clerk; following the adoption of said Code, the City Clerk shall at all times maintain a reasonable supply of copies of said code available for purchase by the public. -1- SECTION 15.50.511 PROHIBITED LOCATIONS Section 511. Equipment regulated by this Code shall not be located in any front or side yard as established by the zoning ordinances. SECTION 15.50.512 Chapter 5 of the Uniform Mechanical Code is hereby amended by adding thereto Section 15.50.512. SECTION 15.50.512 SCREENING Section 512. Equipment regulated by this Code, when located on the roof or outside of the building, shall be screened from public view. Such screening shall conform to the architecture of the building. EXCEPTION: Window air conditioners SECTION 15.50..513 Chapter 5 of the Uniform Mechanical Code is hereby amended by adding thereto Section 15.50.513. SECTION 15.50.513 NOISE ABATEMENT Section 513. Equipment regulated by this Code shall be installed so that it will not produce a sound level above the limits set forth in Section 15.70.010 of the Anaheim Municipal Code. SECTION 15.50.1202 INSTALLATION Section 1202 of the Uniform Mechanical Code is hereby amended by adding thereto the following paragraph: Air cooled condensers or cooling towers located within a building or confined space shall have the air discharge directly to the outside of the build- ing. SECTION 15.50.1901 RANGES Section 1901 of the Uniform Mechanical Code is hereby amended by adding thereto the following para- graph (c) : -3- SECTION 15.50.202 VIOLATIONS AND PENALTIES Section 202 of the Uniform Mechanical Code is hereby amended to read as follows: Section 202. The penalty for violation of any pro- visions of this Code shall be as specified in Section 1.01.370 of the Anaheim Municipal Code. SECTION 15.50.203 BOARD OF APPEALS Section 203 of the Uniform Mechanical Code is hereby amended to read as follows: Section 203. In order to determine the suitability of alternate materials and methods of construction and to provide for reasonable interpretations of the provisions of this Code, there shall be, and is hereby, created a Board of Appeals. The Building Official shall be an ex officio member and shall act as Secretary of the Board. The Board of Appeals shall be the City Council. The Board shall adopt reasonable rules and regulations for conducting its investigations and shall render all decisions and findings in writing to the Building Official with a duplicate copy to the appellant and may adopt such new legislation as is consistent therewith.. SECTION 15.50.304 PERMIT FEES Section 304 of the Uniform Mechanical Code is hereby amended to read as follows: Section 304. Every applicant for a permit to do work regulated by this Code shall state in writing on the application form provided for that purpose, the character of work proposed to be done and the amount and kind in connection therewith, together with such information, pertinent thereto, as may be required. The fees which shall be paid to the Building offi- cial as the cost of permit shall be as determined and set forth by resolution of the City Council. SECTION 15.50.511 Chapter 5 of the Uniform Mechanical Code is hereby amended by adding thereto Section 15.50.511. -2- (c) RESIDENTIAL KITCHEN VENTILATION. Domestic free- standing or built-in ranges shall have an approved type of mechanical exhaust installed directly above the range. The exhaust air shall be ducted directly to the outside of the building. SECTION 15.50.2100 STEAM AND HOT NATER BOILERS Chapter 21 of the Appendix of the Uniform Mechanical Code is hereby amended by deleting therefrom Section 2124, Section 2125, and Section 2126." SECTION 3. SEVERABILITY. The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this chap- ter of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this chapter independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 4. The City Clerk shall certify to the passage of this or- dinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
