3653ORDINANCE N0. 3693 _ AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 73R-458 determining that a change or changes in the zone or zones hereinafter mentioned and des- cribed should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: PARCEL 1 OF 2: That portion of the land allotted to Juan Yorba, in the County of Orange, State of California, as described in the Final Decree of Partition of the Rancho Santiago de Santa Ana, which was entered September 12, 1863 in Book "B", page 410 of Judg- ments of the District Court of the 17th Judicial District in and for Los Angeles County, California, described as follows: Beginning at the southwest corner of Well Lot No. 2, as shownona map filed in Book 14, page 13 of -� Record of Surveys in the office of the County Re- corder of said Orange County, as said Well Lot No. 2 is described as Parcel No. 2 in the deed to Wal- nut Canyon a-Zutual Water Company, recorded April 6, -1- 73-74-11 1944, in book 1241, page 431 of Official Records; thence north 78° 26' 40" West 21.62 feet, thence South 110 33' 20" West 611.43 feet to a point in the southerly boundary line of that certain 26.076 acre parcel of land shown on said map filed in book 14, page 18 of Record of Surveys; thence North 350 32' 10" e-iest along the said southerly boundary line 196.08 feet to an angle point therein; thence South 790 01' 20" iest 200.31 feet; to the southerlv terminus of tie course shown as "`i 471 00' 31" West 40.331" on a map filed in book 91 page 40 of said Record of Surveys; thence along said record of survey filed in book 91 page 40 the following courses: South 280 51' 31" west 282.73 feet, and north 460 31' 09" West 199.70 feet; thence leaving said boundary north 750 45' 00" West 209.72 feet to a point in the easterly line of the land described in deed recorded May 16, 1972 in book 10128 page 922 of said Official Records, said point being in a curve concave easterly with a radius of 712.00 feet a radial line to said point bears South 840 34' 02" West thence along said easterly line; northerly 161.26 feet along said curve through a central angle of 120 58' 3611, North 70 32' 38" East 253.07 feet, northerly 360.93 feet alone a curve concave westerly with a radius of 1001.75 feet through a central angle of 200 38' 37" and worth 130 04' 59" vest 33.78, feet to the boundary of said Record of Survey, filed in book 14 page 18; -thence along said boundary South 770 32' 26" East 674.56 feet to the northwest corner of Viell Lot No. 1, as shown on said map filed in book 14, page 18 of Record of Surveys; thence South 110 33' 20" West 75 feet; thence South 780 26' 40" East 50 feet; thence North 11° 33' 20" East 75 feet to the northeast cor- ner of said Well "Lot No. 1; -thence South 731 26' 40" East 248.88 feet to the northwest corner of said Well Lot No. 2; thence South 110 33' 20" .nest 75 feet to the point of beginning. PARCEL 2 OF 2: Beginning at the most northeasterly corner of the 9.220 acre parcel of land as shown on the Parcel Zap as recorded in Parcel daps, Book 54, Page 5 in the office of the County Recorder of Orange County, said point also being the northerly corner of the 5.00 acre parcel as shown on Record of Survey, as recorded in Book 26, Page 20 in the office of the County Re- corder of Orange County; thence southeasterly along northerly line of said 5.00 acre Parcel, said line also being the southerly line of S.A.V.I. canal right of way, 50.00 feet wide as per Record of Survey, Book 4, Pages 44 to 50, in the office of the County Re- corder of said County, South 770 32' 26" East, 86.13 -2- feet to the northwest corner of Well Lot 1 as shown on a map filed in Book 14, Page 13 of Record of Surveys, in the office of the County Recorder of said Orange County, said point being the True Point of Beginning; thence along the boundary lines of said Well Lot 1, South 120 27' 34" West, 75.00 feet; South 771 32' 26" East, 50.00 feet; North 120 27' 34" East, 75.00 feet; North 770 32' 26" West, 50.00 feet to the True Point of Beginning. now is "RS -A-43,000" PT.'SID.ENTIAL/AGRICULTURF�I, ZONE and that it be changed to and incorporated in "RS -7200" RESID.ENTIAL, SI3GLE- FAI4ILY ZONE, subject to the following conditions: 1. That the owner(s) of subject property shall pay to the City of Anaheim the appropriate Park and Recreation in -lieu fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 2. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to co mencement of structural framing. 3. That all air conditioning facilities shall be properly shielded from view, and the sound buffered from adjacent proper- ties. 4. That subject property shall be served by underground utilities. 5. That a six-foot masonry wall shall be constructed along the east property line. 6. That Condition dos. 3, 4 and 5, above mentioned, shall be complied with prior to final building and zoning inspections. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from: the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning nap, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Trap showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of ti -lis Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, -3- a newspaper of general circulation, printed, published and cir- culated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
