A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM APPROVING AN AMENDMENT TO CERTAIN
CONDITIONS OF APPROVAL IN CONDITIONAL USE
PERMIT NO. 3400 AND AMENDING RESOLUTION NO.
91R-165.
WHEREAS, the City Council of the City of Anaheim
heretofore adopted Resolution No. 91R-165 approving Conditional Use
Permit No. 3400, subject to certain conditions specified therein;
and
WHEREAS, the permittee has now requested an amendment to
certain of said conditions of approval; and
WHEREAS, the City Council held a duly noticed public
hearing on July 23, 1991, at which hearing the City Council did
receive and consider evidence, both oral and documentary, relating
to said request; and
WHEREAS, the City Council hereby finds and determines
that the amendment of said conditions of approval in the manner
hereinafter set forth is reasonably necessary to protect the public
peace, health, safety or general welfare, or necessary to permit
reasonable operation under said Conditional Use Permit.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the conditions of approval heretofore imposed
in Conditional Use Permit No. 3400 be, and the same are hereby,
amended by the amendment of Conditions Nos. 5, 8, 16, 19, and 20 as
set forth in Resolution No. 91R-165 to read as follows:
"5. That the petitioner shall resurface and
restripe the existing parking lot in accordance
with submitted plans on file marked Exhibit No.
1.
8. That a solid waste management plan with
recycling capabilities shall be approved by the
Street Maintenance and Sanitation Division.
Said plan shall commence and remain full effect
as required by said Division.
16. That the existing hole in the ground
located adjacent to Anaheim Boulevard shall be
filled and paved.
19. That prior to issuance of a building
permit, or prior to commencement of the
activity authorized by this resolution, or
within a period of one (1) year from the date
of this resolution, whichever occurs first,

Condition Nos. 1, 2, 3, 4, 7, and 17, above-
mentioned, shall be complied with. Extensions
for further time to complete said conditions
may be granted in accordance with Section
18.03.090 of the Anaheim Municipal Code.
20. That prior to final building and zoning
inspections or prior to commencement of the
activity authorized by this resolution,
whichever occurs first, Condition Nos. 9, 15,
16 and 18, above-mentioned, shall be complied
with."
BE IT FURTHER RESOLVED that new Condition Nos. 24 and 25
be, and the same are hereby, added to Conditional Use Permit No.
3400 as set forth Resolution No. 91R-165, to read as follows:
"24. That within a period of six (6) months
from the date of this resolution, Condition No.
8, above mentioned, shall be complied with.
25. That within a period of one (1) year from
the date of this resolution, Condition Nos. 5,
6, 13 and 14, above-mentioned, shall be
complied with; provided, however, that prior to
issuance of a building permit or prior to
commencement of the activity authorized by this
resolution, whichever occurs first, security in
the form of a bond, certificate of deposit,
letter of credit or cash, in an amount and form
satisfactory to the City of Anaheim, shall be
posted with the City to guarantee the
satisfactory completion of the above-mentioned
improvements."
BE IT FURTHER RESOLVED that, except as expressly amended
herein, Resolution No. 91R-165 shall remain in full force and
effect°
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 23rd day of July, 1991.
