2589ORDINANCE N0. 2589 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 1, CHPATER 1.04 OF THE ANAHEIM MUNICIPAL CODE BY ADDING THERETO SECTION 1.04.400 TO 1.04.460, BOTH INCLUSIVE,RELATING TO A CULTURAL ARTS COMMISSION. WHEREAS, the City Council of the City of Anaheim finds and determines as follows: A. That the growth and flourishing of art and culture depend upon freedom, imagination and individual initiative. B. That the encouragement and support of arts, and culture, while primarily a matter for private and individual initiative, is also an appropriate matter of concern to the citizens of the City of Anaheim collectively. C. That the prestige and general welfare of the City and its citizens will be promoted by providing recognition that art and culture, and the creative spirit which motivates them and which they personify, are valued as an essential part of the City's resources. D. That it is in the best interest of the citizens of the City of Anaheim to maintain, develop and disseminate the City's artistic and cultural resources. E. That it is desirable to establish a Cultural Arts Commission to provide such recognition and assistance as will encourage and promote the City's artistic and cultural progress. NOW, THEREFORE,THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1: That Title 1, Chapter 1.04, of the Anaheim Municipal Code be, and the same is hereby amended by adding thereto Sections 1.04.400 to 1.04.460, both inclusive, reading as follows: "SEC'T'ION 1.04.400 CULTURAL ARTS COMMISSION. That there be, and is hereby established a Cultural Arts Commission (hereinafter referred as the 'Commission'.) "SECTION 1.04.41 0 A. That the Commission shall be composed of seven members appointed by the City Council and subject to removal by a majority of the City Council as follows: (1) Five Commissioners shall be selected at large from among the citizens of the City of Anaheim who are recognized for their broad knowledge of or experience in, or for their profound interest in the arts and culture and the businesss aspects thereof, so as collectively to provide a representative cross-section distribution of membership among the major art and cultural fields with appropriate consideration to be given in the appointment of members to such recommendations as may from time to time be submitted to the City by various groups interested in the various art and culture fields within the City of Anaheim. -1- (2). Two commissioners shall be selected, one each from the Parks and Recreation Commission and the Library Board. (3). The commissioners appointed at large shall be either qualified electors of the City or shall be owners, officers or partners of business firms or corporations located in and doing business within the City of Anaheim. B. Each at large member of the Commission shall serve for a term of four years, and until their successor is appointed and qualified. The terms of the members first taking office shall expire, as designated by the City Council at the time of appointment --two on the 30th day of June of the second year and three on the 30th day of June of the fourth year. C. A vacancy occurring before the expiration of a term of an at large commissioner shall be filled by appointment for the remainder of the term. D. The members of the Commission appointed from the Library Board and Parks and Recreation Commission shall be appointed and serve for a term to expire upon expiration of their term on the respective board from which they were selected. E. Any vacancy in the Commission shall not affect its power but shall be filled in the same manner in which the original appointment was made. F. The Mayor and the City Manager, the Library Director, the Parks and Recreation Director and the Executive Vice -President of the Chamber of Commerce are designated as ex officio members without vote. "SECTION 1.04.420 ORGANIZATION AND MEETINGS. A. The Commission shall as soon as practicable after its organization under this ordinance and each year thereafter, elect a chairman and vice-chairman in accordance with the provisions of Section 904 of the Anaheim City Charter, provided, however, that no officer of the Commission shall succeed himself in office. B. Meetings of the Commission shall be conducted in accordance with Section 904 of the Anaheim Charter, provided, however, that the Commission shall meet at least four times during each calendar year. A regular meeting time may be established by the Commission. A majority of the members of the Commission shall constitute a quorum. "SECTION 1.04.430 A. The Cultrual Arts Commission shall have the power and duty to: (1) Recommend ways to maintain and increase the artistic and cultural resources of the City. (2) Encourage and solicit contributions from individuals, groups and trusts for the benefit of Anaheim's Cultural Arts. -2- (3) Advise, when requested, and encourage the Cultural Arts endeavors of organizations and groups and promote private initiative. The responsibility for the conduct and leadership of cultural arts programs shall rest with others. (4) Foster understanding and cooperation among the various community groups providing programs in the cultural arts field. (5) Act as a sounding board for various organizations in their efforts to meet the cultural needs of the community. (6) Recommend ways which will better coordinate the use of existing resources and facilities. (7) Conduct studies with a view to formulating ways by which creative activity, high standards and increased opportunities in the arts and culture may be encouraged and promoted by community groups in the best interest of the City's artistic and cultural programs, together with a greater appreciation and enjoyment of the arts by the citizens of Anaheim. (8) Advise and consult public and private groups, schools and state and Federal cultural arts commissions interested in having knowledge or experience in these fields. (9) Recommend on the disbursement of funds or in kind contributed to the City for the cultural arts. (10) Advise on the expenditure of capital funds by the City in the field of cultural arts. (11) Advise as the City Council may request on the physical development of any city owned cultural arts facilities and the use of various city owned facilities. (12) Be advisory, upon request, to any existing City advisory board or commission which is associated with a City department that provides and/or operates cultural arts facilities programs and/or services. (13) Perform such other related duties and functions as the City Council may from time to time direct. B. In selecting subjects to be studied pursuant to this section, the Commission: (1) Shall consider requests submitted to it by the City, the schools, other public art and cultural agencies, the Chamber of Commerce, and groups or associations in order to maintain, develop and disseminate the City's artistic and cultural resources, and (2) May obtain the advice of any interested and qualified person in making its studies. Pursuant to this subsection the Commission may obtain assistance from such committees and panels as may be appointed by the Chairman from among those persons professionally qualified in the fields of art and culture with which such studies are concerned and who are recommended to him by the Commission. -3- C. Not later than thirty days after the end of each fiscal year the Commission shall submit to the City Council a report setting forth its activities pursuant to subsection (A) of this section. in addition, the Commission shall submit to the City Council reports and recommendations with respect to its activities at such time or times as the City Council shall request or the Commission deems appropriate. "SECTION 1.04.440 Members of the commission, the Chairman and persons appointed to assist the Commission in making its studies shall serve at no salary, but shall be reimbursed for travel and subsistence expenses incurred in the performance of their duties while away from the City of Anaheim in accordance with Council policy and to the extent that appropriations for such travel allowance have been provided by the City Council. To the extent possible, the City Manager shall provide stenographer, space, equipment and supplies to perform clerical and typing duties for the Commission and/or designate this responsibility. "SECTION 1.04.450 There is hereby authorized to be appropriated to the Commission such sums for the fiscal period 1968-69 and there- after as the City Council of the City of Anaheim may appro- priate to carry out the purposes of the Commission. "SECTION 1.04.460 The commission is authorized to secure through the City Manager from any department, officer, consultant, commis- sion, board, employee, or other instrumentality of the City of Anaheim, suggestions, estimates and statistics for the purposes of carrying out the provisions of this ordinance and each such department, office, consultant, commission, board, employee, or other instrumentality of the City of Anaheim through the City Manager is authorized and directed to furnish such information, suggestions, estimates and statistics to the Commission upon request made by the Chairman of the Commission." SECTION 2. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
