A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DENYING AN AMENDMENT TO CERTAIN
CONDITIONS OF APPROVAL IN VARIANCE NO. 3631
AS APPROVED BY RESOLUTION NO. PC87-24.
WHEREAS, the Planning Commission of the City of Anaheim
heretofore adopted Resolution No. PC87-24 approving Variance No.
3631, subject to certain conditions specified therein; and
WHEREAS, the permittee has now requested an amendment
to said conditions of approval and a further waiver from the code
requirements; and
WHEREAS, the Planning Commission heretofore held a duly
noticed public hearing upon said matter, as a result of which
said application was denied; and
WHEREAS, the permittee heretofore appealed said matter
to the City Council; and
WHEREAS, the city Council held a duly noticed public
hearing on July 23, 1991, at which hearing the City Council did
receive and consider evidence, both oral and documentary,
relating to said request; and
WHEREAS, the City Council hereby finds and determines
that the amendment of said conditions of approval is not
reasonably necessary to protect the public peace, health, safety
or general welfare, nor necessary to permit reasonable operation
under said Variance No. 3791; and
WHEREAS, the City Council does further find, after
careful consideration of the action of the Planning Commission
and all evidence and reports offered at said public hearing
before the city Council regarding said requested waiver(s), that
all of the conditions set forth in Section 18.06.080 of the
Anaheim Municipal Code are not present, and that said waiver(s)
of off-street parking requirements should be denied, for the
following reasons:
1. That the variance(s) will cause an increase in traffic
congestion in the immediate vicinity and adversely affect
adjoining land uses; and
2. That the granting of the variance(s) will be
detrimental to the peace, health, safety or general welfare of
the citizens of the City of Anaheim.

NOW, THEREFORE, BE IT RESOLVED by the City Council of
the city of Anaheim that the conditions of approval heretofore
imposed in Variance No. 3631 as approved by Resolution No. PC87-
24 be, and the same are hereby, affirmed.
BE IT FURTHER RESOLVED that said petition to amend said
conditions of approval of Variance No. 3631 be, and the same is
hereby, denied and that Resolution No. PC87-24 shall remain in
full force and effect.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 23rd day of July 1991.
