2581ORDINANCE NO. 2581 AN ORDINANCE OF THE CITY OF ANAHEIi"i APPROVING �- THE ANNEKATION TO THE CITY OF ANAHEIM OF THE TERRITORY KIJOWN AND DESIGNATED AS SANTA ANA CANYON ANNEXATION NO. 2. THE CITY COUNCIL OF THE CITY OF ANAHEI14 DOES ORDAIIN AS FOLLOWS: SECTION 1. That the City Council of the City of Anaheim did on tile- 6th day of August , 1968 , receive a written petition asking that certain new territory described in said, petition be annexed to the City of Anaheim. That prior to the circulation or filing of said petition, notico of intention to annex said territory, contairL- ing the specific boundaries of the territory to be annexed, was filed with the Local Agency Formation Commission, and saiu Local Agency Formation Commission rendered its decision, as provided in Section 54797 of tile- Government Code, a,)proving said ainuxation. That saiu territory proposed to be annexed to saiu City of Anaheim is situated in the County of Orange, State of California, and, is colitiguous to the City of Anaheim, and is uninnai)ited territory. That said petition contained a descrip- tion of said territory in words and figures as hereinafter in this ordinaIice descrii)ed. That the City Council duly assembled at a regular meeting of said City Council held on the ,6th day of August , 196_, did find that said petition at the time it was filed and received was signed by the owners of not 'Less than one-fourth of the land in the territory by area and by assessed value, as shown on tree last preceding equalizudi assess- ment roll of tare County of Orange, State of California, in w«ici-, said territory is situated, and that said territory aid not form a part of any municipal corporation, and did find tilat saiu ter- ritory.is contiguous to the City of Anaheim and is uninhabited territory. Tnat on the 6th day of n1�T,Gt . 1968 at a __ regular meeting of said City Council of the City of Anaheim, Resolution No. 68R-490 was duly passed and adopted specifically describing the boundaries of the territory so proposed to be annexed to the City of Anaheim and designating such territory as Santa Ana riqnynn Annexat4nn AMMM and giving notice o such annexation and ixing the 24th day of September , 19 68 , at the hour of 1:30 o'clock P.M. at thea -City Council Chamber in the City Hall in the City of Anaheim, as the day, hour and place for hearing of written protests to said annexation and when and where any person owning real property within such territory so proposed to be annexed and having objections to the proposed annexation might appear before the City Council of the City of Anaheim and present written objections to the annexation of said territory to the City of Anaheim, and directing the City Clerk to publish or cause to be -1- published a copy of said resolution at least twice, but not oftener than once a week, for two successive weeks prior to the date of said hearing, in a newspaper of general circula- tion, published in the City of Anaheim, to wit: the Anaheim Bulletin of Anaheim, Orange County, California, and also in a newspaper of general circulation, published outside of the City of Anaheim, but in the County of Orange, in which is located the territory hereinafter proposed to be annexed to the City of Anaheim, to wit: the Placentia Courier and directing that said publications be completed at least twenty (20) days prior to the date of hearing hereinabove mentioned; and further directing the City Clerk of the City of Anaheim to cause written notice of such proposed annexation to be mailed to each person to whom•land_within the territory proposed to be annexed is assessed in the last equalized County assessment roll available on the date the proceedings were initiated, at the address shown on said assessment roll or as known to said City Clerk, and to any person who has filed his name and address and the designation of lands in which he has any interest, either legal or equitable, with said City Clerk; and that in the event that land within the territory proposed to be annexed to the City of Anaheim is owned by a county, that the City Clerk shall cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such county, and directing that such notices be given not less than twenty (20) days before the first public hearing on the proposed annexation. That on the hour, day and at the place specified in said Resolution No. 68R-490 , to wit: On the 24thday of September , 196_, at the hour of 1:30 o'clock P.M. in the City Council Chamber in the City Hall in the City of Anaheim, California, the City Council of the City of Anaheim did meet and assemble to hear and pass on all protests filed or re- ceived up to the closing of the hearing on said protests. That the City Council did find that the resolution fixing the time and place of said hearing was published by the City Clerk as therein directed, and that written notice of such proposed annexation was mailed by the City Clerk as directed in said resolution and as set forth above, and that written protests were not made by the owner or owners of one-half of the value of the territory proposed to be annexed according to the last equalized assessment roll of the County of Orange, State of California, nor were protests made by public or private owners equal to one-half of the value of the territory proposed to be annexed as determined by the City Council. Said findings were then duly adopted by Resolution No. 68R --5,q7 on September 24th , 1968 - SECTION 2. That the annexation of the territory included within the boundaries of the Santa Ana Can on Annexation and more particu- larly described as follows, to wit: -2- SANTA ANA CANYON ANNEXATION NO, 2 TO THE CITY OF ANAHEIM That parcel of land located in the County of Orange, State of California, described as follows: Beginning at the Northwesterly corner of that certain parcel of land described in deed recorded March 12, 1953 in Book 2469, pages 46 and 47 of Official Records of Orange County, California, said Northwest corner being distant from the common Section cor- ner of Section 1, Township 4 South, Range 9 West; Section 6, Township 4 South, Range 8 West; Section 36, Township 3 South, Range 9 West, and Section 31, Township 3 South, Range 8 West, S.B.B. & M., as said section corners are shown on a Map of Survey filed in Book 18, page 46 in Record of Surveys in the office of the County Recorder of said Orange County, California, the following courses and distances: South 890 53' 11" West 2,051.78 feet, more or less, South 460 54' 30" West 404.15 feet, more or less, South 730 53' 14" West 1,720.05 feet, more or less; thence Following along the Northerly boundary of the land des- cribed in the last mentioned deed the following courses and distances: North 730 53' 14" East 120.70 feet, more or less, South 00 00' 30" East 119.37 feet, more or less, North 670 54' 30" East 219.73 feet, more or less, to the Northeast corner of the last mentioned parcel of land, said Northeast corner also being the Northwest corner of that certain parcel of land des- cribed in deed recorded June 26, 1967 in Book 8992, page 553 of Official Records of Orange County, California; thence North 670 54' 30" East 459.85 feet, more or less, along the Northerly line of the land described in the last mentioned deed to the Northeast corner of said parcel, said Northeast corner also being the Northwest corner of that certain parcel of land described in deed recorded January 11, 1954 in Book 2646, page 538 of Official Records of Orange County, California; thence North 670 54' 30" East 501.69 feet, more or less, along the Northerly line of the land described in the last mentioned deed to the Northeast corner of said parcel; thence South 280 42' 50" East 960.07 feet, more or less, along a portion of the Easterly line of the land described in the last mentioned deed to an intersection with the Northerly right of way line of Santa Ana Canyon Road, 160 feet wide; thence South 600 30' 02" West 11359 feet, more or less, along -3- Santa Ana Canyon Annexation No. 2 To The City of Anaheim the Northerly right of way line of said Santa Ana Canyon Road to an intersection with the Northwesterly prolongation of the Westerly line of the land conveyed to Fannie Aherns by deed recorded April 29, 1963 in Book 6527, page 898 of Official Records of Orange County, California, said point of intersec- tion being a point in the existing City Limit line of the City of Anaheim, as established by the Santa Ana Canyon Annexa- tion No. 1 to the City of Anaheim, passed by Ordinance No. 2471, filed with the Secretary of State February 29, 1968 and recorded March 4, 1968 in Official Records of Orange County, California; thence Following along a portion of the said existing City Limit line of the City of Anaheim, being a portion of the Northerly right of way line of said Santa Ana Canyon Road the following courses and distances: South 600 30' 02" West 60 feet, more or less, to the beginning of a tangent curve concave North- westerly and having a radius of 1,950 feet; thence Southwest- erly along a portion of said curve through a central angle of 8° 56' 19" an arc distance of 304.22 feet, more or less, to an intersection with the Westerly line of the land described in the aforementioned deed recorded March 12, 1953 in Book 2469, pages 46 and 47 of Official Records of said Orange County, California; thence Leaving the said existing City Limit line of the City of Anaheim and following along a portion of the Westerly line of the land described in the last mentioned deed the following courses and distances: North 30 52' 40" West 798.71 feet, more or less, South 890 53' West 65.08 feet, more or less, North 00 07' West 521.08 feet, more or less, South 740 54' West 27.42 feet, more or less, North 00 07' West 10.72 feet to the point of beginning. -4- is hereby approved and said territory is hereby annexed to and incorporated in the City of Anaheim, County of Orange, State of California, and is hereby designated as the Santa Ana Canvon Annexation No 2 AX= to the City of Anaheim. SECTION 3. That from and after the effective date of this ordinance and the filing of a certified copy thereof with the Secretary of State of the State of California, the annexation of the territory herein described shall be deemed to be and shall be complete and thenceforth such annexed territory shall be, to all intents and purposes, a part of the City of Anaheim, and from and after the effective date of such annexation, all property therein shall be subject to taxation equally with the property within the City of Anaheim and shall be taxed to pay its proportionate share of the existing indebtedness and liability of said City of Anaheim contracted prior to or exist- ing at the time of such annexation pursuant to the written con- sent of the owners of property in said annexed territory filed with the.Clerk of the City of Anaheim prior to the adoption of this ordinance. SECTION 4. The City Clerk shall certify to the passage of this ordinance and cause the same to be published once in the Anaheim Bulletin , a newspaper of general circu- lation, printed, published and circulated in the City of Anaheim, County of Orange, State of California, and thirty (30) days from and after its final passage it shall be in full force and effect.
