2307ORDINANCE NO. 2307 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 18 OF THE ANAHEIM NW4ICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT-. WHEREAS, the City Planning Commission of the City of Anaheim did heretofore duly pass and adopt Resolution No. 1252 -- Series 1964-65 , in Reclassification No. ares recommending denial of a change in the boun aries of the zone or zones hereinafter mentioned and described,, after having held a public hearing thereon in the manner and as prescribed in Title 18 of the Anaheim Municipal Code to consider such proposed change of zone or zones, and after having received evidence and reports from persons interested therein� and WHEREAS, said City Planning Cox&nission did make findings, and a summary of its hearing, and did recommend denial of a change of zone or zones as set forth in said resolution; and WHEREAS,, upon receipt of said resolution, report of findings, summary of evidence and reco,.rmmendation of the City Planning Commission, the City Clerk did fix the 11th day of August 19 64 ,, as the time, and the -Council Chamber in the City Ha of th:e7-61'11� of Anaheim as the place, for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code and change or changes of zone or zones, and did give notice thereof in the manner and as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all pers,�,ns interested therein an opportunity to be heard and did receive evidence and reports, and did thereupon consider the recommendation of the City Planning Commission, and did adopt Resolution(s) No.(s) 64R-596 . finding and determining that Title 18 of the Bina he--'- cipa Code should be amended and that a change or changes in the boundaries of said zone or zones should be made as set forth in said resolution(s); and WHEREAS, in accordance with said resolution(s), certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones; and WHEREAS, all conditions precedent to said change or changes of zone or, zones have been complied with; NOW., THEREFORE., THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS-. SECTION 1. That Title 18 of the Anaheim Municipal Code relating to zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning Map or Maps showing such change or changes as follows-, -1- 63-64-103 That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: PORTION "A": The easterly 360.00 feet, measured at right angles, of the following described property. A portion of the south half of the northeast quarter of the southwest quarter of Section 27, Township 4 South, Range 10 West, S. B. B. & M., in the Ranchos Las Bolsas, as shown on a map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at the southeast corner of Tract No. 2224 as shown on a map recorded in Book 90, page 16 of Miscellane- ous Maps, records of Orange County, said corner also being the southwest corner of Tract No. 3267 as shown on a map recorded in Book 102, Page 42 of Miscellaneous Maps, records of Orange County; thence southerly along the pro- longation of the easterly line of said Tract No. 2224, South 1° 56' 0001 East 660.13 feet to a point in the south line of the southeast quarter of the northeast quarter of the southwest quarter of said Section 27; thence along said southerly line North 89° 43' 45" East 673.11 feet to a point in the easterly line of the southeast quarter. of the northeast quarter of the southwest quarter of said Section 27, said easterly line also being the center line of Harbor Boulevard; thence along said center line of Harbor Boulevard North 1° 20' 30" West 659.97 feet to a point on the northerly line of the southeast quarter of the northeast quarter of the southwest quarter of said Section 27; thence along the said northerly line, South 890 43' 45" West 679.92 feet to the point of beginning. EXCEPTING THEREFROM the southerly 189.80 feet measured at right angles. PORTION "B": The southerly 189.80 feet of the easterly 360.00 feet measured at right angles of the following described property. EXCEPTING THEREFROM the easterly 360.00 feet measured at right angles. now is R -A, RESIDENTIAL -AGRICULTURAL ZONE, and that it be changed to and incorporated in the following zones, upon the conditions hereinafter set forth: That Portion "A" above described shall be changed to and incorporated in C-3, HEAVY -COMMERCIAL ZONE; and -3- That Portion "B" above described shall be changed to and incorporated in C-0, COMMERCIAL -OFFICE ZONE; and That Portion "C" above described shall be changed to and incorporated in R-3, MULTIPLE -FAMILY RESIDENTIAL ZONE. That said change of zones shall be made upon the following conditions: 1. That the Wilkin Way buildin§ setback of the proposed office building on Portion B" shall be a minimum of five (5) feet. 2. That the Wilkin Way building setback of the proposed restaurant on Portion "A" shall be a minimum of five (5) feet. 3. That the Harbor Boulevard building setback of the proposed auto center shall be a minimum of fifteen (15) feet. 4. That the building setback areas of 15 feet on Harbor Boulevard and 5 feet on Wilkin Way shall be landscaped and said landscaping maintained. 5. That an easement for parking purposes shall be recorded in the Office of the Orange County Recorder permitting the utilization by Portion "A" of the 13 surplus parking spaces proposed on Portion "B"; or that an adequate number of parking spaces, as required by the Anaheim Municipal Code, shall be provided on Portion "A." SECTION 2. The City Zoning Map shall be, and the same is hereby, amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) dayys from and after its final passage it shall take effect and be in full force.
