2246ORDINANCE NO. 2246 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING TITLE 18 OF THE ANAHEIM MUT141CIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT -. W,HEREAS� the City Planning Commis-sion of the City of Anaheim did heretofore duly pass and adopt Resolution No. 1833 -- Series 1965-66 ' in Reclassification No. 65-66-46 recommending a—enial of a change in the boun-da-r-'1e­s­-6-f--Me zoneor zones hereinafter mentioned and described, after having held a public hearing thereon in the manner and as prescribed in Title 18 of the Anaheim Municipal Code to consider such proposed change of zone or zones, and after having received evidence and reports from persons interested thereinand �RiEREAS, said City Planning Coir ission did make findings, and a summary of its hearing, and did recommend denial of a change of zone or zcnes as set forth in said resolution; and 14PHE-REAS,' upon receipt of said resolution, report of findings, s1Q.qL,,Ta-ry of evidence and recommendation of the City Planning Gonruisstcn, the City Clerk did fix the 14th day of - December � 1-965 -, as the time, and thj Cou'ncil Chamber in the Cit� 'RaTI-7af th�c-Clty of Anaheim as the place, for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code and change or changes of zone or zones., and did give notice thereof in the manner and as provided in said Title 18 of the Anaheim Municipal Code; and W11FREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all. persons interested therein an opportunity to be heard and did rec-eive evidence and reports, and did thereupon consider the reco7n.endation of the City Planning Commission, and did adopt Resolution(s) No.(s) 65R-926 finding and " I Wi- --r— determining that .4"itle 18 of t e rM ulacipa Code should be amended and that a change or changes in the boundaries of said zone or zones should be made as set forth in said resolution(s); and in accordance with said resolution(s), certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones; and 161HEREAS, all conditions precedent to said change or changes of zone or., zones have been complied with; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS. SECTION 1. That Title 18 of the Anaheim Municipal Code relating to zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning Map or Maps showing such change or changes as follows-, -1- 65-66-46 That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: PARCEL "A": All that certain real property in the City of Anaheim, County of Orange, State of California, being the Westerly 203.00 feet of Lots 17 and 18 of the P. A. Stanton Tract as per map there- of recorded in Book 5, Pages 23 and 24, Miscellaneous Maps, records of said Orange County. EXCEPTING THEREFROM that portion of said Lot 17 included with- in the following described lines: Beginning at a point on the Westerly line of Section 19, Township 4 South, Range 10 West, in the Rancho Los Coyotes, as per map recorded in Book 51, Page 10 of said Miscellaneous Maps, South 00 38' 40" East 441.50 feet from the Northwest corner of said Section; thence North 890 14' 54" East 572.84 feet to the West line of Lot 14 in said P. A. Stanton Tract; thence South 0° 38' 40" East 345.00 feet along the West line of Lots 14 and 15 in said P. A. Stanton Tract; thence South 89° 14' 54" West 572.84 feet to the West line of said Section; thence North 00 38' 40" West 345.00 feet to the point of beginning. Note: For the purposes of this description, the center line of Magnolia Avenue is assumed to be the Westerly line of Lots 17 and 18. PARCEL"B" : that certain real property in the City of Anaheim, County of Orange, State of California, being Lots 17 and 18 of the P. A. Stanton Tract as per map thereof recorded in Book 5, pages 23 and 24 of Miscellaneous Maps, records of said Orange County. EXCEPTING THEREFROM the Westerly 203.00 feet thereof and also EXCEPTING THEREFROM that portion of said Lot 17 included with- in the following described lines: Beginning at a point on the Westerly line of Section 19, Township 4 South, Range 10 West, in the Rancho Los Coyotes, as per map recorded in Book 51, Page 10 of said Miscellaneous Maps, South 00 38' 40" East 441.50 feet from the Northwest corner of said Section; thence North 890 14' 54" East 572.84 feet to the West line of Lot 14 in said P. A. Stanton Tract; thence South 00 38' 40" East 345.00 feet along the West line of Lots 14 and 15 in said P. A. Stanton Tract; thence South 890 14' 54" West 572.84 feet to the West line of said Section; thence North 0° 38' 40" West 345.00 feet to the point of beginning. Note: For the purposes of this description, the center line of Magnolia Avenue is assumed to be the Westerly line of Lots 17 and 18. now is R -A, AGRICULTURAL ZONE, and that it be changed to and incorporated in the following zones, upon the conditions herein- after set forth: That Parcel "A" above described shall be changed to and in- corporated in C-1, GENERAL COMMERCIAL ZONE; and -2- That Parcel "B" above described shall be changed to and in- corporated in R-3, MULTIPLE -FAMILY RESIDENTIAL ZONE. That said change of zones shall be made upon the following conditions: 1. That subject property shall be developed substantial- ly in accordance with plans and specifications on file with the City of Anaheim. 2. That the owner of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 3. That all air conditioning facilities for the commercial portion of subject property shall be properly shielded from view from abutting streets. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended, and the properly above described shall be excluded from the zone in which it is now situated,' and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
