2658ORDINANCE NO. 2658 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 of the ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT:. WHEREAS, the City Council did adopt its Resolution No. 67R-310 determining that a change or changes in the zone or zones hereinafter mentioned and described should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with as to the property hereinafter described. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: PARCEL 1: That portion of the land of Dreyfus and others in the City of Anaheim, as shown on the map of Anaheim Extension, surveyed by William Hamel, acopy of which is shown in Book 3, pages 162 et seq., entitled Los Angeles County Maps, described as follows: Commencing at the intersection of the Easterly line of West Street 66.00 feet wide, as shown on a map of the replat of Orchard Park Tract, recorded in Book 7, page 6, Miscellaneous Maps, records of Orange County, Cali- fornia, with the Southwesterly line of Manchester Avenue, 100.00 feet wide as described in Parcel 2 of Final Order of Condemnation in the Superior Court Case No. 33172, a certified copy of which Final Order is recorded November 7, 1936, in Book 847, page 478, Official Records; thence South 15° 42' 40" East 191.61 feet along the Easterly line of said West Street to an angle point in the Southwesterly line of land described in deed to State of California, recorded April 8, 1942, in Book 1145, page 80, Official Records, said point being the true point of beginning; thence South 15° 42' 40" East 1011.67 feet along the Easterly line of said West Street to the North line of West Vermont Avenue, also known as Broad Street, as shown on said map of survey of Anaheim Extension; thence North 74° 29' 56" East, along the -1- 66-67-61(24) Northerly line of said West Vermont Avenue, 565.07 feet to said Southwesterly line of Manchester Avenue as des- cribed in said Final Order of Condemnation recorded in Book 847, page 478, Official Records; thence North 400 49' 41" West 668.99 feet along said Southwesterly line to the Northerly terminus of the tangent course des- cribed as having a length of 229.17 feet in the exception in Parcel 1 of the deed to F. A. Yungbluth, and others recorded in Book 821, page 285, Official Records; thence South 160 36' 41" East along said tangent course 109.70 feet to the Southwesterly line of land described in deed to State of California, recorded May 19, 1950, in Book 2015, page 49, Official Records; thence North 400 49' 41`° West 580.84 feet along said Southwesterly line to the Southeasterly line of said land of the State of Cali- fornia, recorded in Book 1145, page 80, Official Records; thence South 61° 31' 560 West, 37.20 feet to the point of beginning. EXCEPTING THEREFROM a 40 -foot strip of land as conveyed to the State of California, by deed recorded October 13, 1955, in Book 3243, page 14, Official Records. PARCEL 2: That portion of Lot 29 of Anaheim Extension, in the City of Anaheim, as shown on a map of survey made by William Hamel and filed in the office of the County Recorder of Los Angeles County, a copy of which is shown in Book 3, pages 163, et seq., entitled "Los Angeles County Maps," records of said Orange County, described as follows: Beginning at the Northwest corner of Lot 29 of Anaheim Extension, in the City of Anaheim, as shown on a map thereof, made by William Hamel and filed in the office of the County Recorder of Los Angeles County, California, in Book 3, page 163, Miscellaneous Records of Los Angeles County, California thence Easterly along the Northerly line of said Lot 29, a distance of 613.57 feet to the Westerly right of way line of the Southern Pacific Rail- road; thence Southeasterly along said right of way to the Northeasterly corner of the 9.38 acre Tract conveyed to Samuel J. Luhring, by deed recorded in Book 212, page 242, Deeds; thence Westerly along the Northerly line of said 9.38 acre tract, 827.7 feet to the Northwesterly corner thereof; thence Northerly along the Westerly line of said Lot 29 to the point of beginning. EXCEPTING AND RESERVING the Northerly and Westerly 33 feet of said land for road purposes. ALSO EXCEPTING the Northeasterly 30 feet of said land as conveyed to the State of California by deeds recorded in Book 1018, page 171, Official Records, and in Book 1019, page 288, Official Records. ALSO EXCEPTING FROM the remainder 15 feet as conveyed to the State recorded August 7, 1950, in Book Records. ALSO EXCEPTING FROM the remainder veyed to the State of California, 1, 1955, in Book 3016, page 489, described as follows: -2- hereof the Northeasterly of California by deed 2052, page 98, Official hereof that portion con - by deed recorded April Official Records, and Beginning at a point in a line parallel with and distant 45.00 feet Southwesterly measured at right angles, from the Southwesterly line of the Southern Pacific Railroad right of way, 100.00 feet wide, distant along said parallel line South 40° 52' 20" East, 467.34 feet from the inter- section of said parallel line with the Northerly line of said lot; thence along said parallel line South 40° 52' 20 East, 42.42 feet to the Southerly line of the land conveyed to Albert J. Janzen et ux., by deed recorded September 24, 1943, in Book 1209, page 925, Official Records; thence along said Southerly line South 74° 26' 40" West, 27.71 feet to a curve concave Westerly, having a radius of 220.00 feet; thence Northerly from a tangent which bears North 30 35' 53" East, along said curve, through an angle of 10° 18' 23", an arc distance of 39.57 feet, to the point of beginning. PARCEL 3. That portion of Lot 29 of Anaheim Extension, in the City of Anaheim, as shown on a mapof survey made by William Hamel and filed in the office of the County Re- corder of Los Angeles County Maps, records of said Orange County, described as follows: Beginning at a point on the Westerly line of said Lot 29 Southerly 455.9 feet from the Northwesterly corner of said Lot 29; thence Easterly 827.70 feet parallel to the Northerly line of said lot, to the Westerly right of way line of the Southern Pacific Railway Company; thence Southerly 156.5 feet along said Westerly right of way line, to a point on a line parallel with the Northerly line of said lot, distant 597.4 feet from said Northerly line, said point being 894.1 feet Easterly along said parallel line from the Westerly line of said lot; thence Westerly 35.1 feet parallel with the Northerly line of said lot; thence Southerly 50 feet parallel with the Westerly line of said lot; thence Westerly 859.00 feet parallel with the Northerly line of said lot, to the Westerly line of said lot; thence Northerly 191.50 feet along said Westerly line to the point of beginning. EXCEPT the interest of the public in the Westerly 33 feet for road purposes, as contained in a resolution of the Board of Supervisors of said County, dated June 5, 1918, and filed in Minute Book 13, page 292. PARCEL 4. The two leasehold estates created by those certain leases dated May 13, 1964 executed by Wilma L. Miller, as lessor, and Anaheim Hotel Associates, Ltd., a limited part- nership, as lessee, memorandums of said leases were recorded May 14, 1964, in Book 7044, page 621, Official Records, and in Book 7044, page 626, Official Records, in and to that certain real property described as follows: That portion of Lot 29 of Anaheim Extension, in the City of Anaheim, as shown on a map made by Wm. Hamel and filed for record in the office of the County Recorder of Los Angeles County, California, described as follows: -3- Beginning at the Southwest corner of said Lot 29, said Southwest corner being the intersection of the center line of Ball Road with the center line of West Street, and running thence North 15° 45' 06" West, along said center line of West Street, 122.45 feet to a point which is distant thereof South 150 45' 06" East 647.40 feet from the Northwest corner of said Lot 29, said Northwest corner also being the intersection of the center line of West Street with the center line of Vermont Avenue (formerly Broad Street) as said streets are shown on said map of Anaheim Extension; thence North 740 26' 45" East, parallel with the Northerly line of said Lot 29, 651.35 feet to the Westerly boundary of the land conveyed to the State of California by deed recorded April 5, 1955, in Book 3019, page 444, Official Records; thence South 140 08' 29" West, along said Westerly boundary 180.61 feet to the North boundary of the land conveyed to the State of California, by deed recorded November 14, 1955, in book 3279, page 495, Official Records; thence along said North boundary South 451 28' 13" West 25.63 feet; thence South 760 47' 48" West 162.69 feet to the beginning of a tangent curve, con- cave Northerly and having a radius of 450 feet; thence Westerly along said curve through an angle of 13° 08' 02" a distance of 103.15 feet to a line tangent; thence South 89° 55' 50" West 19.63 feet to the West boundary of the land conveyed by said deed recorded in Book 3279, page 495, Official Records; thence South 00 04' 10" East, along said West boundary and the Southerly extension thereof, 50 feet to the South line of said Lot 29, said South line also being the center line of Ball Road; thence South 890 55' 50" West along said South line 251.66 feet to the point of beginning. now is R -A, AGRICULTURAL ZONE, and that it be changed to and incorporated in C-R, COMMERCIAL -RECREATION ZONE, upon the fol- lowing conditions: 1. That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer, at the time the property is developed. 2. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, for street lighting purposes, said amount to be paid at the time the property is developed. 3. That the owners of subject property shall pay to the City of Anaheim the sum of 154� per front foot for tree planting purposes, said amount to be paid at the time the property is developed. 4. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. 5. That all air conditioning facilities shall be properly shielded from view and shall be in architectural confor- mance with the structure. -4- SECTION 2. The City Zoning Map shall be, and the same is hereby, amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (1.5) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circu- lated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
