2644ORDINANCE NO. 2644 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 of the ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution(s) No(s). 69R-7 determining that a change or changes in the zone or zones hereinafter mentioned and described should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: PARCEL 1: That portion of the West half of the Southeast Quarter of the Southwest quarter of Section 7, Township 4 South, Range 10 West, of the Rancho Los Coyotes, in the City of Anaheim, County of Orange, State of California, as shown on a map re- corded in Book 51, page 10 of Miscellaneous Maps, records of said County described as follows: Beginning at the Southwest corner of said Southeast Quarter of Southwest Quarter; thence along the Westerly line there- of, North 0° 23' 29" West 370.02 feet to the Southerly line of the land of the Anaheim Union High School District as per Condemnation Proceedings recorded in Book 5493, page 515 of Official Records of said county; thence thereon parallel with the South line of said section, North 880 58' East 519.08 feet; thence South 0° 39' 57" East 370.00 feet to the point in said South line of Section 7, said point being North 880 58' East and distant 520.66 feet from the point of beginning; thence along said South line of Section 7 South 88° 58' West 520.85 feet to the point of beginning. -1- 68-69-52 PARCEL 2: That portion of the West half of the Southeast Quarter of the Southwest Quarter of Section 7, Township 4 South, Range 10 West, of the Rancho Los Coyotes, in the City of Anaheim, County of Orange, State of California, as shown on a map recorded in Book 51, page 10, of Miscellaneous Maps, records of said county described as follows: Beginning at the Southwest corner of said Southeast Quarter, of Southwest Quarter; thence along the Westerly line thereof, North 01 23' 29" West, 370.02 feet to the Southerly line of the land of the Anaheim Union High School District as per Condemnation Proceedings recorded in Book 5493 page 515 of Official Records of said county; thence thereon parallel with the South line of said Section North 88° 58' East 299.05 feet to the true point of beginning; thence at right angles North 010 02' West 75.00 feet; thence parallel with said Southerly line of Section 7 North 880 58' East 100 feet; thence at right angles South 01° 02' East 75.00 feet; thence South 88° 58' West 100 feet to the true point of beginning. now is R -A, AGRICULTURAL ZONE, and that it be changed to and incor- porated in R-3 MULTIPLE -FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That a parcel map to record the approved division of subject property shall be submitted to the City of Anaheim for approval and then recorded in the Office of the Orange County Recorder. 2. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets. 3. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 4. That a strip of land 35 feet in width along the Lincoln Avenue frontage shall be landscaped, and said landscaping maintained, as indicated on Exhibit No. 1 on file with the City of Anaheim; and that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance. 5. That 6 -foot masonry walls shall be constructed along the west, north and east property lines, where car- ports are not constructed adjacent to these property lines, and that said walls shall be stepped down to 42 inches in height in the 35 -foot Lincoln Avenue set- back area. 6. That all air-conditioning facilities shall be properly shielded from view and the sound buffered from adjacent residential homes. 7. That the owners of subject property shall pay to the City of Anaheim the sum of $25.00 per apartment unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued; PROVIDED, HOWEVER, that in the event said sum shall not have been paid by May 1, 1969, there shall be due and payable at the time the building permit is issued the sum of $75.00 per apartment unit. -2- 8. That the parking areas shall be lighted with down - lighting of a maximum height of six (6) feet, and said lighting shall be directed away from the property lines to protect the residential integrity of the area. 9. That Conditions Nos. 1, 2, 3, 4, 5, 6 and 8, above- mentioned shall be complied with prior to final building and zoning inspections. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
