91-195 RESOLUTION NO. 91R-195 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ESTABLISHING THE PARK IN LIEU OF FEES FOR THE CITY OF ANAHEIM AND RESCINDING RESOLUTION NO. 90R-199. WHEREAS, the City Council has adopted an ordinance establishing a park and recreation land or in lieu fees formula for the City of Anaheim; and WHEREAS, the following fees to be charged are reasonable and do not exceed the actual cost of acquisition and development of the City's parks; and WHEREAS, the City Council hereby finds and determines that the average cost of park development is One Hundred Thirty One Thousand Seven Hundred Ninety Six Dollars ($131,796.00) per acre and the average cost of park land acquisition is Four Hundred Ninety-Four Thousand Dollars ($494,000.00) per acre. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: I. The fee to be paid for the development of residential property for parks and recreational purposes shall be: 1. Single Family Unit $4,130.25 2. Condominium Family Unit $3,041.37 3. Multiple Family Unit $2,778.53 4. Mobile Home Family Unit $2,127.71 II. The Park in lieu fees established herein by this Resolution shall not be effective until sixty (60) days following the date of its adoption by the City Council. III. Resolution No. 90R-199 will be of no further force and effect sixty (60) days after adoption of this Resolution. ATTACHMENT "A" HOW THE PARK DEDICATION ORDINANCE (PDO) FORMULA IS COMPUTED The formula for determining the fee exacted from a developer, which is set by State law, is based upon Anaheim's adopted standard of two acres of park land for every 1000 new residents. A determination is made of the number of new residents to be accommodated by a new project. Then the acreage requirement is assessed and, if fees are to be required, the cost per acre of park acquisition and development is multiplied times the acreage requirement for the project. The following illustrates how the formula would be applied to the existing conditions and under the revised ordinance: PDO = (Cost/acre + Cost/acre x City x Residents/ (Acquisition Development) Park Std. ATTACHMENT C CONSULTANT COMPARISONS PARK DEVELOPMENT COST/ACRE ASSUMPTION: Park development costs/acre includes actual construction costs, design and construction administration fees (by both city and consultant staff), water and miscellaneous project assessment fees and utility hookup charges. Current experience is based upon $131,796 per acre cost for Sycamore Park. METHODOLOGY: Various consultants were contacted to ascertain the validity of the park development cost/acre referenced above. Results of those contacts are indicated below: CONSULTANT CONTACTS: 1. T.I. Maloney, Inc. Indicated new park construction (Tim Maloney, Owner) will be in the $140,000 to $150,000 per acre range for development. Development will include utility hookups, permits, inspection costs, etc. 2. Meyer & Associates Indicated new park construction (Randy Meyer, President) will range between $150,000 to $200,000 per acre during next year period. $140,000 per acre will be a "bare bones" park facility. These figures will include all design utility hqpkups, permits, ~ inspections, etc. 3. Cardoza-Dilallo-Harrington Indicated that with a building, (Ken Shappet, Associate) play equipment, parking and landscaping, $132,000 per acre was currently a realistic cost for neighborhood park improvements. These costs would include utility hookups, design fees, etc.
