91-188 RESOLUTION NO. 91R~88 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ADOPTING A REVISION TO THE 1990/91 APPROPRIATIONS LIMITATION WHEREAS, the voters of California on November 6, 1977 added Article XIII B to the State Constitution placing various limitations on the appropriations of the state and local governments; and WHEREAS, each year the City is required, by resolution, to establish its appropriations limit and make other necesary determinations for the following fiscal year pursuant to Article XIII B of the State Constitution; and WHEREAS, on June 5, 1990, California voters approved Proposition 111 amending Article XIII B; and WHEREAS, in accordance with the provisions of Proposition 111, it is deemed necessary for the city of Anaheim to recalculate the 1990-91 appropriations limitation, and the appropriations limitation for fiscal years 1986/87 through 1989/90, in order to conform to the provisions of said constitutional amendment; and WHEREAS, recalculating the 1986/87 through 1990/91 appropriations limits in the manner hereinafter set forth changes the 1990-91 adopted limit from $128,116,923 to $218,809,283. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that, in accordance with the findings contained herein, the Article XIII B of the State Constitution 1990-91 year appropriations limitation be, and the same is hereby, recalculated and revised to conform to the provisions of Proposition 111. BE IT FURTHER RESOLVED that the City Council of the City of Anaheim, by recorded vote of the city Council adopting this resolution, hereby determines and selects that, with regard to fiscal years 1986/87, 1987/88, 1988/89, 1989/90 and 1990/91 and the calculations specified herein for each of said fiscal years, the term "change in the cost of living" for purposes of Section 8(e) (2) of Article XIII B of the Constitution of the State of California shall mean the percentage change in the local assessment roll from the preceding year for the City of Anaheim due to the addition of local nonresidential new construction. BE IT FURTHER RESOLVED that the City Council of the City of Anaheim, by recorded vote of the city Council adopting this resolution, hereby determines and chooses that, with regard to fiscal years 1986/87, 1987/88, 1988/89, 1989/90 and 1990/91 and the calculations specified herein for each of said fiscal years, the term "change in population" for purposes of Article XIII B of the Constitution of the State of California and Division 9 of Article 1 of the Government Code of the State of California shall mean change in population within the County of Orange. BE IT FURTHER RESOLVED, that, based on such recalculation, the revised appropriation limit for fiscal year 1990-91 is $218,809,283.
