A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ANAHEIM ADOPTING THE
FINAL SOURCE REDUCTION AND
RECYCLING ELEMENT AND HOUSEHOLD
HAZARDOUS WASTE ELEMENT OF THE
SOLID WASTE MANAGEMENT PLAN AND
APPROVING NEGATIVE DECI2~RATIONS FOR
THE PROJECT.
WHEREAS, the California State Legislature has declared that
over 90 percent of California's solid waste currently is disposed
of in landfills, some of which pose a threat to groundwater, air
quality, and public health; and
WHEREAS, the California State Legislature has declared that
while California will exhaust most of its remaining landfill
space by the mid-1990's, there presently is no coherent state
policy to ensure that the state's solid waste is managed in an
effective and environmentally sound manner for the remainder of
the 20th century and beyond; and
WHEREAS, the California State Legislature has declared that
the amount of solid waste generated in the state coupled with
diminishing landfill space and potential adverse environmental
impacts from landfilling constitutes an urgent need for state and
local agencies to enact and implement an aggressive new
integrated waste management program; and
WHEREAS, pursuant to State Assembly Bill 939 and Assembly
Bill 2707, the California State Legislature has mandated that the
City of Anaheim adopt and submit to the County of Orange a Source
Reduction and Recycling Element ("SRRE") and Household Hazardous
Waste Element ("HHWE") which includes a program for the
management of solid waste generated within the City of Anaheim;
and
WHEREAS, Negative Declarations for the SRRE and HHWE ("the
project") were prepared and circulated through the State
Clearinghouse for public review from September 30, 1991 to
October 30, 1991; and
WHEREAS, the California Integrated Waste Management Board,
the Orange County Local Task Force (Waste Management Commission),
Southern California Association of Governments, adjoining cities,
and the general public have reviewed and commented on the
Preliminary Draft SRRE and HHWE from August 7, 1991 to September
30, 1991 as required by Chapter 9, Title 14 of the California
Code of Regulations; and
WHEREAS, the Department of Maintenance of the City of
Anaheim held community meetings on January 22, 23, and 24, 1991
to solicit comments.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ANAHEIM AS FOLLOWS:
1. That the Negative Declarations have been completed in
compliance with California Environmental Quality Act ("CEQA") and
State and City CEQA Guidelines.
2. That the City Council does hereby approve the Negative
Declarations upon finding that it has considered the information
contained in the Negative Declarations together with any comments
received during the public review process prior to approving the
project; and further finding on the basis of the Initial Study
and any comments received that there is no substantial evidence
that the project will have a significant effect on the
environment.
3. That the City Council acting as lead agency for said
projects declares that when considering the record as a whole,
there is no evidence before the agency that the proposed projects
will have potential for adverse effect, individually or
cumulatively, on wildlife resources or the habitat upon which the
wildlife depends as defined in Section 711.2 of the Fish and Game
Code.
4. That the City Council hereby adopts the Source Reduction
and Recycling Element and Household Hazardous Waste Element
attached hereto as Exhibits "A" and "B", respectively, and
incorporated herein as though set forth in full.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 17th day of December ,
1991.
