3097ORDINANCE; NO. 3097 AN ORDINANCE OF THE CITY OF ANAHEIM APPROVING THE ANNEXATION TO THE CITY OF ANAHEIM OF THE TERRITORY KNOWN AND DESIGNATED AS SANTA ANA CANYON NO. 4 ANNEXATION. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Anaheim did on the 18th day of September, 1972, receive a written petition asking that certain new territory described in said petition be annexed to the City of Anaheim. That prior to the circulation or filing of said petition, notice of intention to annex said territory, contain- ing the specific boundaries of the territory to be annexed, was filed with the Local Agency Formation Commission, and said Local Agency Formation Commission rendered its decision, as provided in Section 54797 of the Government Code, approving said annexa- tion. That said territory proposed to be annexed to said City of Anaheim is situated in the County of Orange, State of California, and is contiguous to the City of Anaheim, and is uninhabited territory. That said petition contained a description of said territory in words and figures as hereinafter in this ordinance described. That the City Council duly assembled at a regular meeting of said City Council held on the 3rd day of October, 1972, did find that said petition at the time it was filed and received was signed by the owners of not less than one-fourth of the land in the territory by area and by assessed value, as shown on the last preceding equalized assessment roll of the County of Orange, State of California, in which said territory is situated, and that said territory did not form a part of any municipal corporation, and did find that said territory is contiguous to the City of Anaheim and is uninhabited territory. That on the 3rd day of October, 1972, at a regular meeting of said City Council of the City of Anaheim, resolution No. 72R-456 was duly passed and adopted specifically describing the boundaries of the territory so proposed to be annexed to the City of Anaheim and designating such territory as SANTA ANA CANYON NO. 4 ANNEXATION and giving notice of such annexation and fixing the 21st day of November, 1972, at the hour of 1:30 o'clock P.M. at the City Council Chamber in the City Hall in the City of Anaheim, as the day, hour and place for hearing of written pro- tests to said annexation and when and where any person owning real property within such territory so proposed to be annexed and having objections to the proposed annexation might appear before the City Council of the City of Anaheim and present written objec- tions to the annexation of said territory to the City of Anaheim, and directing the City Clerk to publish or cause to be published a copy of said resolution at least twice, but not oftener than once a week, for two successive weeks prior to the date of said hearing, in a newspaper of general circulation, published in the City of -1- Anaheim, to wit: the Anaheim Bulletin of Anaheim, Orange County, California, and also in a newspaper of general circulation, Published outside of the City of Anaheim, but in the County of Orange, in which is located the territory hereinafter proposed to be annexed to the City of Anaheim, to wit: the Placentia Courier, and directing that said publications be completed at least twenty (20) days prior to the date of hearing hereinabove mentioned; and further directing the City Clerk of the City of Anaheim to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized County assessment roll available on the date the proceedings were initiated, at the address shown on said assessment roll or as known to said City Clerk, and to any person who has filed his name and address and the designation of lands in which he has any interest, either legal or equitable, with said City Clerk; and that in the event that land within the territory proposed to be annexed to the City of Anaheim is owned by a county, that the City Clerk shall cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such county, and directing that such notices be given not less than twenty (20) days before the first public hearing on the proposed annexation. That on the hour, day and at the place specified in said Resolution No. 72R-456, to wit: On the 21st day of November, 1972, at the hour of 1:30 o'clock P.M. in the City Council Chamber in the City Hall in the City of Anaheim, California, the City Council of the City of Anaheim did meet and assemble to hear -and pass on all protests filed or received up to the closing of the hearing on said protests. That the City Council did find that the resolution fixing the time and place of said hearing was pub- lished by the City Clerk as therein directed, and that written notice of such proposed annexation was mailed by the City Clerk as directed in said resolution and as set forth above, and that written protests were not made by the owner or owners of one-half of the value of the territory proposed to be annexed according to the last equalized assessment roll of the County of Orange, State of California, nor were protests made by public or private owners equal to one-half of the value of the territory proposed to be annexed as determined by the City Council. Said findings were then duly adopted by Resolution No. 72R-542 on November 21, 1972. SECTION 2. That the annexation of the territory included within the boundaries of the SANTA ANA CANYON NO. 4 ANNEXATION, and more particularly described as follows, to wit: -2- That parcel of land located in the County of Orange, State of California, described as follows: Beginning at a point in the existing City limit line of the City of Anaheim, as established by the Imperial Highway-Esperanza Annexation to said City, said point of beginning being at the southeasterly terminus of the line described in said annexation as having a bearing and distance of S 560 19' 06" E, 88.02 feet; thence following along the existing City limit line of the City of Anaheim, being the southerly annexation boundary line of the following annexations to said City: Imperial- Highway-Esperanza, Esperanza-Fairmont, Esperanza-Roth and a portion of the Esperanza-Carillo Annexation, the follow- ing courses and distances: (1) N 780 23' 00" E, 1,239.49 feet to the beginning of a curve concave northwesterly and having a radius of 5,780.00 feet; thence (2) North- easterly along said curve through a central angle of 18° 12' 03" an arc distance of 1,836.10 feet; thence (3) N 600 38' 00" E, 5,848.82 feet tangent to said curve to an intersection with the northerly prolongation of the westerly line of Lots 27 and 26 in Tract No. 117, as shown on a map recorded in Book 11, page 15, Miscellaneous Maps, records of said Orange County; thence leaving said existing City limit annexation boundary and following along said prolongation and westerly line of said Lots 27 and 26 and the southerly line of said Lot 26 the following courses and distances: (4) S 00 58' 18" W, 1,044.38 feet; (5) N 54° 07' 30" E, 87.64 feet; (6) N 61° 13' 30" E, 65.82 feet; (7) N 680 37' 30" E, 365.23 feet; (8) S 530 15' 18" E, 20.00 feet to an intersection with the northerly right of way line of Santa Ana Canyon Road, as shown on State Highway Reference Map VII -ORA -91-(43-B) on file in the County Surveyor's office of said County as Index No. 9053; thence following along the northerly right of way line of said Santa Ana Canyon Road, the following courses and distances: (9) S 360 44' 42" Tri, 597.52 feet to the beginning of a tangent curve concave southeasterly and having a radius of 3,050.00 feet; thence (10) Southwesterly along said curve through a central angle of 90 17' 00" an arc distance of 494.17 feet; thence (11) S 27° 27' 42" W, 283.01 feet tangent to said curve to the beginning of a tangent curve concave northwesterly and having a radius of 1,950.00 feet; (12) thence Southwesterly along the last mentioned curve through a central angle of 190 24' 30" an arc distance of 660.54 feet; thence (13) S 460 52' 12" W, 771.70 feet tangent to said curve to the beginning of a tangent curve concave southeasterly and having a radius of 5,050.00 feet; thence (14) Southwesterly along the last mentioned curve through a central angle of 2° 45' 30" an arc distance of 240.71 feet; thence (15) S 440 07' 42" W tangent to said curve 663.27 feet; thence (16) N 38° 38' 30" W, 20.12 feet to a point in a curve concave northwesterly and having a radius of 1,950.00 feet, a radial line bearing S 440 13' 04" E passes through said point; thence (17) Southwesterly along the last mentioned curve through a central angle of 14° 43' 06" an arc distance of 500.92 feet; thence (18) S 60° 30' 02" W, 1,043.24 feet tangent to said curve to the southeast corner of the Santa Ana Canyon Annexation No. 2 to said City; thence following along the last mentioned -3- annexation boundary, the following courses and distances: (19) N 2811 42' 5091 W, 960.07 feet, more or less; (20) S 67° 54' 30" W, 1,181.27 feet, more or less; (21) N 00 00i1 30" W, 119.37 feet, more or less; (22) S 73° 53' 14" W, 120.70 feet, more or less; (23) S 0° 07' 00" E, 10.72 feet, more or less; (24) N 740 54' 00" E, 27.42 feet, more or less; (25) S 0° 07' 00" E, 521.08 feet, more or less; (26) N 890 53' 00" E, 65.08 feet, more or less; (27) S 30 52' 40" E, 798.71 feet to the southwest corner of said annexation, said southwest corner being a point in a curve concave northwesterly and having a radius of 1,950.00 feet, a radial line bearing S 20° 49' 07" E passes through said point, said point also being a point in the northerly boundary line of the Santa Ana Canyon Annexation No. 1 to said City; thence leaving the boundary line established by said Santa Ana Canyon Annexation No. 2 and following along a portion of the northerly line of the boundary established by the Santa Ana Canyon Annexation No. 1, the following courses and distances: (28) Southwesterly along the last mentioned curve through a central angle of 4° 51' 07" an arc distance of 165.13 feet; (29) S 74° 02' 00" W, 726.17 feet; (30) S 74° 01' 00" W, 517.37 feet; (31) N 1,390 feet, more or less; (32) S 69° 00' 00" W, 287.20 feet; (33) N 60 00' 001' W, 87 feet, more or less; (34) N 871 30' 0011 W, 953.07 feet; (35) N 56° 30' 00" W, 832.25 feet to the point of beginning. is hereby approved and said territory is hereby annexed to and incorporated in the City of Anaheim, County of Orange, State of California, and is hereby designated as the SANTA ANA CANYON NO. 4 ANNEXATION to the City of Anaheim. SECTION 3. That from and after the effective date of this ordinance and the filing of a certified copy thereof with the Secretary of State of the State of California, the annexation of the territory herein described shall be deemed to be and shall be complete and thenceforth such annexed territory shall be, to all intents and purposes, a part of the City of Anaheim, and from and after the effective date of such annexation, all property therein shall be subject to taxation equally with the property within the City of Anaheim and shall be taxed to pay its proportionate share of the existing indebtedness and liability of said City of Anaheim contracted prior to or existing at the time of such annexation pursuant to the written consent of the owners of property in said annexed territory filed with the Clerk of the City of Anaheim prior to the adoption of this ordinance. SECTION 4. The City Clerk shall certify to the passage of this ordinance and cause the same to be published once in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in the City of Anaheim, County of Orange, State of California, and thirty days from and after its final passage it shall be in full force and effect. -4- THE FOREGOING ORDINANCE is approved and signed by me this 28th day of November, 1972.
