3067ORDINANCE NO. 3067 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. 72R-170 determining that a change or changes in the zone or zones hereinafter mentioned and des- cribed should be made as hereinafter set forth, after dulv noticed hearings and receipt of the report and recommendation of the Citv Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changinq the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: Parcel 1: That portion of the North half of the Northwest quarter of the Southeast quarter of Section 8, Township 4 South, Range 10 West, in the Rancho Los Coyotes, as shown on map recorded in Book 51, page 10 of Miscellaneous Maps, in the Office of the County Recorder of said County, described as follows: Beginning at the Northeast corner of said Northwest quarter of the Southeast quarter; thence South 00 08' 52`° East along the Easterly line of said Northwest quarter of the Southeast quarter to the Northeasterly line of the land described in Certificate of Title No. 13252, to the State of California, filed January 10, 1950, in the Office of the Registrar of Titles of said County; thence North 56° 45' 25" West 217.34 feet along said Northeasterly line to the most Southerly corner of the land described to Carl Peltzer, and wife filed October 15, 1954, as Torrons Document No. 30000, in the Office of said Registrar of Titles, thence along the Easterly boundary of said Peltzer's land the following bearings and distances: North 1° 17' 57" West 102.85 feet, South 88° 55' 52" East 54.56 feet, North 10 17' 57" West 50.00 feet, South 880 56' 52" East 107.00 feet to a line parallel with and Westerly 23.00 feet from said -1- 71-72-38 Easterly line of the Northwest quarter of the Southeast quarter, North 00 08' 52" West 313.72 feet along said parallel line to a point on the North line of said North- west quarter of the Southeast quarter distant thereon 23.00 feet from the point of beginning; thence leaving the boundary of said Peltzer's land, South 89° 43' 30" East 23.00 feet to the point of beginning. Parcel 2: That portion of the North half of the Northwest quarter of the Southeast quarter of Section 8, Township 4 South, Range 10 West, S.B.B. & M., in the Rancho Los Coyotes, County of Orange, State of California, as said section is shown on a map recorded in Book 51, page 10, Miscellaneous Maps, in the Office of the County Recorder of said County, described as follows: Beginning at a point on the North line of said Northwest quarter of the Southeast quarter North 890 43' 30" West 23.00 feet from the Northeast corner of said Northwest quarter of the Southeast quarter, thence North 89° 43' 30" West 736.73 feet to the Northeast corner of the land describe in Certificate No. 13252 to the State of California, in the Office of the Registrar of Titles, of said County; thence South, Southwesterly and Southeasterly along the Easterly lines of said land to the State of California to a point on said Easterly line North 560 45' 25" West 217.34 feet thereon from the East line of said Northwest quarter of the South- east quarter; thence North 10 17' 57" West 102.85 feet; thence South 880 56' 52" East 54.56 feet; thence North 10 17' 57" West 50.00 feet; thence South 880 56' 52" East 107 feet to a line parallel with and Westerly 23.00 feet from the East line of the Northwest quarter of the Southeast quarter of said Section; thence North 0° 08' 52" West 313.72 feet along said East line to the point of beginning. Excepting from Parcels 1 and 2 that portion of the North half of the Northwest quarter of the Southeast quarter of Section 8, Township 4 South, Range 10 West, S.B.B. & M., more particularly described in a deed by Urban Carl Peltzer and Zoe J. Peltzer to the State of California, recorded May 10, 1956, in Book 3504, page 171 of Official Records of Orange County. now is R -A, AGRICULTURAL ZONE, and that it be changed to and incorporated in the R-3, MULTIPLE FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 2. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 3. That a 6 -foot masonry wall shall be constructed along the east, west and southwest propertly lines. 4. That subject property shall be served by underground utilities. 5. That the owners of subject property shall pay to the City of Anaheim the appropriate park and recreation in --lieu fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 505 6. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 7. That the alignment of the southwesterly property line adjacent to the Santa Ana Freeway and the northerly property line adjacent to Crescent Avenue shall be approved by the California Division of Highways, and that the owner of subject property shall deed to the City of Anaheim the right of way and access rights required for the future Crescent Avenue overcrossing of the Santa Ana Freeway as has been determined necessary by the California Division of Highways. 8. That all air conditioning facilities shall be properly shielded from view. 9. That any parking area lighting proposed within 120 feet of any single-family residential development shall be down -lighting of a maximum height of 6 feet, which lighting shall be directed away from the property lines to protect the residential integrity of the area. 10. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1, 2, 3, 4, 5 and 6. 11. That Conditions Nos. 1, 2, 3, 4, 6, 7, 8, 9 and 10, above mentioned, shall be complied with prior to final building and zoning inspections. SECTION 2. The City Zoning Map shall be, and the same is hereby amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning snap to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circu- lated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
