3016ORDINANCE NO, 3016 AN ORDINANCE OF THE CITY OF ANAHEIM ADOPT- ING THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS UNIFORM BUILDING CODE, VOLUME III, HOUSING, AND THE APPENDIX, 1970 EDITION, WITH AMENDMENTS THERETO, AND AMENDING TITLE 15, CHAPTER 15.36 OF THE ANAHEIM MUNICIPAL CODE. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 15, Chapter 15.36 of the Anaheim Municipal Code be, and the same is hereby amended to read as follows: "CHAPTER 15.36 UNIFOP14 BUILDING CODE, VOLUME III HOUSING. SECTION 15.36.001 APPROVAL. The City Council does find and determine, as the result of study and investigation conducted by the City and its Building Officials that the International Conference of Building Officials Uniform Building Code, Volume III, Housing, 1970 Edition, is an approved Code for adoption by reference within the meaning of Section 50022.1 of the Government Code of the State of California, SECTION 15.36.010 ADOPTION OF UNIFORM BUILDING CODE, VOLUME III, HOUSING, AND APPENDIX. Pursuant to the authority granted to the City by Sections 50022,1 to 50022.8 of the Government Code of the State of California, the City Council does hereby adopt, by reference, the International Conference of Building Officials Uniform Building Code, Volume III, Housing, and Appendix, 1970 Edition, as amended. The City Clerk shall file three (3) certified copies in the City Clerk's Office for public inspection while the Code is in force and shall maintain a reasonable supply of said Code available for purchase by the public. SECTION 15.36,020 AMENDMENTS. Certain portions of Uniform Building Code, Volume III, Housing, are hereby amended as follows; 1. Section H-204, on page 9 is hereby amended to read as follows: "Any person, firm or corporation violating any of the provisions of this Code shall be guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this Code is committed, or permitted, and upon conviction of any such violation such person shall be punishable by a fine of not more than $500.00 or by imprisonment for not more than 6 months, or by both such fine and imprisonment in the County or City Jail." -1- 2. Section 303 of said Code on pages 41 and 42 is hereby deleted. 3. Section 304 (e), page 44, is hereby amended by changing the wording "Building Department" to "Building Division". 4. Section 407, on page 49, is hereby amended to read as follows; "FRONT OF LOT is the front boundary line of a lot bordering on the street, and in the case of a corner lot the narrow portion is the front." 5. Section 1709 (a-4), page 63, is hereby deleted and subsection (c) is hereby added to read as follows; "(c) Buildings having not more than 1000 square feet of floor area, on property line, shall have a minimum of 18 inch parapet." SECTION 15.36.030 MODIFICATIONS. The City Council reserves the right and power at its own discretion or upon the recommendation of the Chief Building Inspector to modify any of the provisions of the Building Code when there are practical difficulties in the way of carrying out the strict letter thereof provided that the spirit of the Code shall be observed, public safety secured and substantial justice done. SECTION 15.36.040 SEVERABILITY. The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this chapter of the Code hereby adopted be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other por- tions of this chapter independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 2. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
