3004ORDINANCE NO., 3004 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FI14D THAT: WHEREAS, the City Council did adopt its Resolution No. 71R-16 and 71R-32 determining that a change or changes in the zone or zones7ereinafter mentioned and described should be made as hereinafter set forth, after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COU14CIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: The North 859.96 feet 'measured along the west line' of the west half of the northwest quarter of the southwest quarter of Section 13, Township 4 South, Range 11 vest, in the Rancho Los Coyotes, County of Orange, State of California, as per map recorded in Book 51, page 11 of Miscellaneous Maps, in the Office of the County Recorder of said County. now is C-1, GENERAL COMMERCIAL ZONE, and that it be changed to and incorporated in R-3, MiULTIPLE-FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That the vehicular access rights, e.>cept at approved access points, to Orange Avenue, shall be dedicated to the City of Anaheim; and that vehicular access to Beach Boulevard shall be as approved by the California Division of Highways. 2. That the owner of subject property shall pay to the City of Anaheim the sum of 15¢ per,front foot along Beach :Boulevard and Orange Avenue for tree planting purposes. -1- 70-71-17 3. The Developer be required to participate in the necessary drainage to the extent of 16.60 of the cost of the storm drain in Beach Boulevard, from Orange Avenue northerly to the Carbon Creek Channel, including catch basins and appurtenances. T 10. That any parking area lighting proposed shall be down -lighting of a maximum height of 6 -feet. which lighting shall be directed away from the property lines to protect the residential integrity of the area. 11. That a 20 --foot wide planting strip shall be pro- vided along the easterly boundary of subject property- and said planting strip shall be densely landscaped with live plant materials including 15 ---gallon trees planted on 10 - foot centers adjacent to the required 6 ---foot masonry wall along the east property line: plans for said landscaping to be submitted to and approved by the Development Services Department. 12. That in order to provide for adequate emergency vehicular circulation to carports located near the north- west section of the proposed development, a minimum of 6 dwelling units shall be deleted from the project and an adequate vehicular circulation system, acceptable to the Fire Chief, shall be provided. 13. That Conditions Nos. 1, 2, 3, 4, 5, 6, 7, 9, 10, 11 and 12, above mentioned, shall be complied with prior to final building and zoning inspection. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning 11-4ap as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning i4ap showing the changes hereby approved and adopted. --2-- SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the sane to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
