2975A ORDINANCE NO. 2975 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND WHEREAS, the City Council did adopt its Resolution No. 71R-25 determining that a change or changes in the zone or zones hereinafter mentioned and des- cribed should be made as hereinafter set forth, after dulv noticed hearings and receipt of the report and recommendation of the Citv Planning Commission; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been com- plied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 13 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: Tract No. 7288 recorded 10-22-71 in Book 287, pages 18 through 25, Miscellaneous Maps, in the office of the Orange County Recorder. now is R -A, AGRICULTURAL ZONE, and that it be changed to and incorporated in R-2, MULTIPLE FAMILY ZONE upon the conditions hereinafter set forth: 1. That street names shall be approved by the City of Anaheim prior to approval of a final tract mao. 2. Drainage of subject property shall be disposed of in a manner that is satisfactory to the City Engineer. 3. That any use, subdivisions, site design or the con- struction of any building, fence, sign or structure, or the removal or deposit of natural material for each phase of development shall be subject to review by the Development Services Department. Plans shall be sub- mitted indicating front side, and rear elevations, plan view and a cross section through the proposal and through sufficient adjacent properties to indicate the -1- 70-71-13 (1) relationship of the proposal to those properties. Plans or drawings should also show proposed building or structure locations, and in reasonsable detail walls, walks, topography, existing vegetation, proposed park- ing layout and location, landscape and irrigation pro- posals, building materials and color schemes. The Development Services Department shall consider the request to insure that the proposed improvements will meet the purpose and intent of the proposed Scenic Corridor, not present an unsightly appearance, limit the opportunity to obtain the optimum use and value of the land improvements, or impair the desirability of living conditions in the same or adjacent areas.µ It shall be the responsibility of the Development Services Department to maintain the objective of the Anaheim Citv Council to retain the natural topography and scenic beauty of the Santa Ana Canyon Scenic Corridor. To achieve these ends, the Development Services Department shall require such changes as are deemed necessary to accomplish the purpose of this section. The Development Services Department shall not grant approval until satisfied that the purpose set out herein shall be accomplished and no Building Permit or final building inspection shall be issued until approval is given. Where a question arises as to the administration of these conditions or where there is a difference of opinion as to whether the intent and purpose of these conditions for the proposed Scenic Corridor is being met, the Planning Commission shall, upon recept of a written request outlining in detail reasons for said request, hear the matter at a public hearing. Appeal from decidion of the City Planning Commission shall be to the Citv Council in written form stating in detail the reasons for said appeal, and said appeal shall also be made at a public hearing. 6. That this reclassification is granted subject to the completion of Conditional Use Permit No. 1202, and any plans developed and approved under said conditional use permit. 7. Prior to the issuance of a building permit for the first phase of the planned community, a standard shall be established by the Planning Commission and City Council for the total number of units to be developed within the entire project, and the developer shall commit himself to a maximum number of units that will be developed on each building pad. The total of all the units to be built on all of the pads shall not exceed the total number of units established for -the entire project. 8. The owner of subject property shall pay to the City of Anaheim appropriate fees as established by the City Council for park and recreation purposes, said amount to be paid at the time the building permit is issued for each phase of development. -2- SECTION 2. The City Zoning Map shall be, and the same is hereby amended, and the property above described shall be excluded from the zone in which it is now situated, and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map as amended is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circu- lated in said City, and thirty (30) days from and after its final passage it shall take effect and be in full force.
