ORDINANCE NO. 2930
AN ORDINANCE OF THE CITY OF AivAHEI-Iii AMEN DING
TITLE 17, MAPTER 17.06 OF T11]] ANAHEIM MUNI--
CIP21L CODE.
THE CI'T'Y COUNCIL OF THE CITY OF ANAHEI:Z DOES ORDAIN AS
SECTION 1;
That Title 17, Chapter 17.06, Section 17.06.110 of the
Anaheim Municipal Code be, and the same is hereby amended to read
as follows:
"SECTION 17.06.110 EXCAVATION - GENERALLY.
SUBSECTION ( a) SLOPE STANDARDS GENERALLY. No excavation shall
be made with a cut face steeper then two (2) horizontal to one (1)
vertical unless otherwise recommended in the approved soil engineer-
ing and/or engineering geology report.
The soil engineer or engineering geologist shall furnish a
written opinion certifying that he has investigated the site and
that the proposed deviation will not endanger any public or private
property or result in the deposit of debris on any public way or
cause any public way to be endangered due to loss of supporting
foundation as a result of slope instability.
SUBSECTION (b) CUT FACES. The City Engineer may require the
excavation to be made with a cut face flatter in slope than two
(2) horizontal to one (1) vertical if, in his opinion, existing
conditions make such flatter cut necessary for stability and safety.
The entire area of cut slope shall be confined within one lot
or parcel and the top of cut slopes shall be located a minimum of
one (1) foot from the adjoining property line. All exposed cut
slopes shall be protected upon completion with planting as set forth
in Chapter 17.06, rection 17.06.130.
SUBSECTION (c) `'ERRACING. Cut slopes exceeding twenty-five
(25) feet in vertical height shall be terraced at approximately mid --
height. Cut slopes shall not exceed fifty (50) feet in vertical
height. Terraces shall be not less than six (6) feet wide, shall be
constructed with impermeable materials which shall include indigenous
stone and/or paving, using :tedium or dark earthen tones (black, tan,
sienna, umber, ochre, green), and shall carry water to a safe dis-
posal area as approved by the City Engineer.
SUBSECTION (d) APPLICABILITY OF SECTION. This section applies
to all hillside area excavations in the City regardless of whether
or not a permit is required by this chapter."
SECTION 2:
That Title 17, Chapter 17.06, Section 17.06.120 of the
Anaheim Municipal Code be, and the same is hereby amended to read as
follows:
"SECTION 17.06.120 FILLS - G%4EPLALLY.
SUBSEC`T'ION (b) SLOPE STANDARDS. The slope of fill surfaces
shall be no steeper than two (2) horizontal to one (1) vertical
unless otherwise recommended in the approved soil engineering report.

SUBSECTION (c) WHEN SURFACE TO BE FLATTER. The City Engineer
may require that fills be constructed with an exposed surface flatter
than two (2) horizontal to one (1) vertical if he finds that such
flatter surface is necessary for stability and safety.
SUBSECTION (g) TERRACES. Fill slopes exceeding twenty-five (25)
feet in vertical height shall be terraced at approximately midheight.
Fill slopes shall not exceed fifty (50) feet in vertical 'height.
Terraces are to be not less than six (6) feet wide, shall be construc-
ted with impermeable materials which shall include indigenous stone
and/or paving, using medium or dark earthen tones (black, tan, sienna,
umber, ochre, green), and shall carry water to a safe disposal area
as approved by the City Engineer."
SECTION 3:
That Title 17, Chapter 17.06, Section 17.06.130 of the
Anaheim Municipal Code be, and the same is hereby amended to read as
follows:
"SECTION 17.06.130 LANDSCAPING. All filled slopes and cut
slopes shall be planted and irrigated with a sprinkler system to
promote growth of plants and ground cover to protect the slopes
against erosion.
In developing a site for subdivision or similar purposes, it
shall be the responsibility of the developer to plant and maintain
all slopes where required by this chapter until the property is
occupied by reason of lease or purchase. No grading bond posted by
the permittee shall be withheld beyond the date of this responsibility
unless specifically ordered by action of the City Council.
The minimum requirements are as follows:
A. SLOPE AREAS
1. All cut or fill slopes except slopes not exceeding
five (5) feet in vertical height between two (2)
or more contiguous lots shall be planted with ade-
quate plant material to protect the slopes against
erosion. Plant material shall be selected from the
list of bank plant in Section 17.06.130 C. Said
planting shall consist of at least one (1) tree per
300 square feet and one (1) shrub per 150 square feet
of actual bank slope area (preferably in irregular
patterns) and a ground cover to completely cover
the bank within two years from the time of planting.
2. A sprinkler system shall be installed to irrigate
these slopes preferably as a part of the house plu:lb--
ing installation, unless otherwise authorized by the
City Engineer.
3. The permittee, owner or developer shall water the
slopes which have been planted at sufficient time
intervals to promote growth.

2. Sprinkler systers shall be designed to provide a
uniform water coverage. In no event shall the rate
of precipitation or duration of sprinkling be per-
mitted to create an oversaturated condition or cause
an erosion problem.
3. A functional test of the sprinkler system shall be
performed by the installer in the presence of a City
Inspector for every sprinkler systeai prior to approval
by the City Engineer.
4. All plants shall be maintained in a healthy and living
condition during the duration of responsibility.

made to prevent any surface waters from damaging the cut face of
an excavation or the slope surface of a fill. All drainage shall be
so designed as to prevent erosion of any slope; structures may be
constructed of impermeable materials which shall include indigenous
stone and/or paving, using medium or dark earthen tones (black, tan,
sienna, umber, ochre, green, and shall be of such design as to
carry surface water to the nearest street storm drain or natural
water course approved by the City Engineer as a safe place to deposit
and receive such waters
SECT2ON 5
That Title 17, Chapter 17.06, Section 17.06.290 of the
Anaheim Municipal Code be, and the same is hereby amended to read as
follows:
"SECTION 17.06.290 CONDI1IONAL EXCEP`T'IONS TO CHAPTER. Condi-
tional exceptions to the requlations herein defined may be authorized
if exceptional or special circumstances apply to the property. Such
special circumstances may include limited size, unusual shape,
extreme topography, dominating drainage problems or the impractica-
bility of employing a conforming plan or layout by reason of prior
existing recorded subdivisions of contiguous properties.
The City Council shall have the right to waive the requiresients
of this chapter for good cause shown. Application for waiver of
the requirements of this chapter shall be made at the time of the
filing of a tentative map with the City Planning Commission."

depth of 150 feet.
(b) Lots adjacent to all other classifications of arterial
highways or railroad rights of way shall have a minimum
depth of 120 feet.
(c) Conditional exceptions to the regulations set forth in
Section 17.08.352 (a) and (b) above may be authorized
if a specific plan is approved by the City for lots
adjacent to freeways, expressways, arterial 'highways,
and railroad rights of way in accordance with City Council
Policy No. 538.

Subdivisions, Section 17.03.354 of the Anaheirc; Municipal Code be,
and the same is hereby amended to read as follows:
"SECTION 17.08.354 LANDSCAPI_vG AND NATURAL FEATURES
(a) On all lots adjacent to freeways and expressways a six (6)
foot high, landscaped, earthen berm shall be provided
adjacent to the right of way line.
(b) Where special circumstances exist for a property such as
1LAted size, unusual shape, extreme topography, domina-
ting drainage problems or the impracticability of employ-
ing (a) above a decorative masonry wall may be required
in lieu of the earthen berm.
""he decorative masonry wall shall include design variations.
Variations in the required wall that are designed to in-
clude such decorative materials as wood, stone, or offsets
for landscaping are encouraged.
(c) On each building site or lot of a subdivision there shall
be ten (10) trees per gross acre or two (2) trees per
lot whichever is greater and shall be spaced at intervals
of not more than forty (40) feet.
(d) Those lots adjacent to freeways, expressways, arterial
highways, or railroad rights of way shall plant trees
within ten (10) feet of the property line nearest the
right of way line, except where existing trees are being
preserved.

(e) New trees may be selected from the plant material list in
Section 17.03.352 (h) and shall be at least six (6) feet
tall at the time of planting.
(f) !Z functional test of the sprinkler system shall be performed
by the installer in the presence of the City Inspector.
(g) Recognizing the existing'Eucalyptus tree windbreaks as one
of the primary natural features of Orange County and the
City of Anahei.a, this Section attempts to retain the
character they exemplify. Developers are encouraged to
leave existing windbreaks and use the techniques of prun-
ing or thinning to preserve them where feasible. Where a
developer retains existing trees, said trees may be counted
in calculating the number of reqtired`trees set forth in
Section 17.03.354 (c) .
(h) SUGGESTED TREES
SECTION 5.
The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be printed once within
fifteen (15) days after its adoption, in the Anaheim, Bulletin,
a newspaper of general circulation, printed, published and circu-
lated in said City, and thirty (30) days from and after its final
passage it shall take effect and be in full force.
