A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM RESTATING CITY COUNCIL RESOLUTION
NO. 91R-313 APPROVING AND ORDERING THE
ANNEXATION TO THE CITY OF ANAHEIM OF THE
TERRITORY KNOWN AND DESIGNATED AS ANNEXATION
NO. 280 - THE GYPSUM CANYON ANNEXATION
WHEREAS, the Local Agency Formation Commission of the
County of Orange adopted its Resolution No. 91-23 on November 6,
1991, making determinations and approving the proposed annexation
to the City of Anaheim of territory described in Exhibit A
attached hereto and by this reference incorporated herein (the
"Property"); and
WHEREAS, the terms and conditions of annexation as
approved by the Local Agency Formation Commission are as set
forth in its Resolution No. 91-23, a copy of which is attached to
this Resolution as Exhibit B and the terms and conditions of
which are incorporated herein by this reference; and
WHEREAS, the reasons for the annexation are to
implement the City's adopted Mountain Park Specific Plan and
secure the benefits of that development for the City and the
region, as described in the Statement of Overriding
Considerations previously adopted by the City Council in
connection with its approval of that Specific Plan and
certification of Environmental Impact Report ("EIR") No. 302; and
WHEREAS, EIR No. 302 was prepared and certified by the
City expressly for the adoption of the Mountain Park Specific
Plan and the annexation of the Property to the city of Anaheim,
among other approvals; and
WHEREAS, the City Council has determined that since the
certification of EIR No. 302, none of the circumstances described
in Public Resources Code section 21166 to support preparation of
a subsequent or supplemental environmental impact report has
occurred, and no new mitigation measures beyond those adopted by
the City in its approval of the Mountain Park Specific Plan would
be required for approval of the annexation; and
WHEREAS, the City Council has determined that this
action is within the scope of EIR No. 302; and
WHEREAS, the City Council has determined that no
further environmental documentation is required to be prepared
for this action; and
WHEREAS, the regular County assessment role is utilized
by this city; and
WHEREAS, the Property will be taxed for existing
general bond indebtedness of this City; and
WHEREAS, the Local Agency Formation Commission has
authorized this Council to approve this annexation without notice
and hearing and without an election as permitted by Section 56837
of the Government Code.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the city of Anaheim finds:
a. That proof satisfactory to the Local Agency
Formation Commission was submitted that the owner of all of the
land comprising the Property has given its consent to such
annexation.
b. That the Property is situated in the County of
Orange, State of California, and is contiguous to the City of
Anaheim, and is uninhabited territory.
c. That the consent signed by the owner of the
Property contained a description of the Property in words and
figures as hereinafter in this Resolution described.
d. That the landowner filed the request to annex the
Property, containing the specific boundaries of the territory to
be annexed, with the Local Agency Formation Commission and the
Commission approved the annexation request pursuant to Section
56837 of the Government Code.
e. That on the 6th of November, 1991, the Local
Agency Formation Commission duly adopted Resolution No. 91-23 in
which the Commission authorized the city of Anaheim to annex the
Property in accordance with Section 56837 of the Government Code
and further approve such annexation without notice or hearing by
the City Council and without the requirement that an election be
held by the City on the question of the annexation.
BE IT FURTHER RESOLVED, THEREFORE, that the city
Council of the City of Anaheim hereby orders the territory
described in Exhibit A annexed to the City of Anaheim, subject to
the conditions specified in Exhibit B, as Annexation No. 280, and
directs the City Clerk to transmit a certified copy of this
Resolution with applicable fees required by section 54902.5 of
the Government Code to the Executive officer of the Local Agency
Formation Commission of Orange County.
BE IT FURTHER RESOLVED that the annexation shall be
effective upon the date the Executive officer of the Local Agency

Formation Commission records a certified copy of the certificate
of completion of proceedings with the County Recorder of the
County of Orange and, from and after the effective date of such
annexation, all property therein shall be subject to taxation
equally with the property within the city of Anaheim and shall be
taxed to pay its proportionate share of the existing indebtedness
and liability of the City of Anaheim contracted prior to or
existing at the time of the annexation pursuant to the written
consent of the owner of the Property.
BE IT FURTHER RESOLVED that this resolution is intended
to restate, but not to rescind, Resolution No. 91R-313 adopted by
the city Council on November 5, 1991.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 19th day of November,
1991.

RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSION
OF ORANGE COUNTY, CALIFORNIA

November 6, 1991
3 On motion of Commissioner Hart, duly seconded and carried, the
following resolution was adopted:
~ WHEREAS, a petition for the proposed annexation designated
ANNEXATION NO. 280 TO THE CITY OF ANAHEIM in the County of Orange was
6 heretofore filed by the property owner and accepted for filing on
7 September 30, 1991 by the Executive officer of this Local Agency
Formation Commission pursuant to Part 3 of Title 5, Division 3,
8
commencing with Section 56000 et seq of the Government Code; and
9 WHEREAS, the Executive Officer, pursuant to Government Code Section
]0 56838, set November 6, 1991 as the hearing date of this proposal; and
~ WHEREAS, the Executive Officer, pursuant to Government Code Section
56833, has reviewed this proposal and prepared a report including his
!2 recommendation thereon, and has furnished a copy of this report to each
]3 person entitled to a copy; and
WHEREAS, said proposal was accompanied by proof satisfactory to
this Commission that all of the owners of land within the territory
!5 proposed to be annexed have given their signed consent to such
]6 annexation and determination; and
WHEREAS, this Commission on November 6, 1991 considered the
~7
proposal and the report of the Executive Officer, and considered the
]8 factors determined by the Commission to be relevant to this proposal,
~ including, but not limited to, factors 'specified in Government Code
Section 56841; and

WHEREAS, the City of Anaheim has reviewed all environmental
2] documentation comprising EIR 302 and has found that'EIR 302 considers
22 all environmental effects of the proposed Mountain Park Specific Plan,
and is complete and adequate, and fully complies with all requirements
of CEQA and the Guidelines; and
24 WHEREAS, Section 21081 of CEQA~and Section 15091 of the Guidelines
~-~m~/ require that this Commission make one or more of the following findings
~ prior to approval of a project for which an EIR has been completed,

! identifying one or more significant effects of the project, along with
other statements of facts supporting each finding:
FINDING 1 Changes or alterations have been required in, or
3 incorporated into, the ~roject which avoid or
substantially lessen the significant environmental
~ effects thereof as identified in the EIR.
FINDING 2 Such changes or alterations are within the
6 responsibility and jurisdiction of another public
? agency and not the agency making the finding. Such
8 findings have been adopted by such other agency or
can and should be adopted by such other agency.
9 FINDING 3 Specific economic, social, or other considerations
[0 make infeasible the mitigation measures or project
alternatives identified in the EIR; AND
WHEREAS, this Commission has reviewed and considered the c~rtified
!2 Final EIR 302~which was prepared to evaluate the proposed project.
[3 NOW, THEREFORE, the Local Agency Formation Commission of the County
of Orange DOES HEREBY RESOLVE, DETERMINE and ORDER AS FOLLOWS:
Section 1. Subject to the terms and conditions hereinafter
[5 specified, said proposal is approved.
[6 Section 2. This Commission does hereby certify that Final EIR
302 is complete and adequate in that it addresses
all environmental effects of the proposed Mountain
18 Park Specific Plan related to the actions of this
lg~ Commission and fully complies with the requirements
of CEQA and the Guidelines.

This Commission makes the findings contained in the
2[ Statement of Findings/Facts and Overriding
22 Considerations adopted on July 23, 1991 by the City
23 of Anaheim and finds that ~ach fact in support of
the findings is true and is based upon substantial
24 evidence in the record, including the Final EIR 302.
2~. This Commission finds that a Mitigation Monitoring
26 and Reporting Program has been prepared and adopted

! by the City of Anaheim to ensure that the proposed
2 mitigation measures in Final EIR 302 are
implemented.
3 Section 3. The boundaries of the territory proposed to be
annexed to the City of Anaheim are specifically
~ described in the legal description attached hereto
and by this reference made a part hereof. Said
6 territory is found to be uninhabited and is assigned
? the following distinctive short-form designation:

Section 4. The annexation shall be subject to the following
9 terms and conditions:
10 a. Should development proposed within the
annexation area require fuel modification that
extends into County lands, the County of Orange
12 shall review the proposed development plans to
13 ensure that appropriate fuel modification
installations are addressed prior to
development. Provisions for maintenance of the
[5 fuel modification areas will remain the
16 responsibility of the development.
b. The city of Anaheim and The Irvine Company
shall have reached an agreement with the
18 California Department of Forestry to provide
~ wildland fire protection for the annexed lands,
or shall jointly represent in writing to the
20
Executive Officer that adequate wildland fire
2! protection has been secured for the annexed
lands, prior to issuance of the certificate of
22
23 completion.
c. The Orange County Flood Control District
74 (OCFCD) shall retain ownership and maintenance
~ responsibilities on District facilities owned
~ ~' in fee or easement.

! d. The City shall be responsible for local storm
drains, channels and ~ppurtenant facilities,
site drainage and all master plan storm d~ain
3 facilities previously managed by the County of
Orange.
~ e. The City shall coordinate all development
adjacent to existing and planned OCFCD
6 facilities by submitting plans and
? specifications to the OCFCD for review to
ensure necessary flood control right-of-way and
improvements are provided. Such improvements
9 shall be consistent with the Santa Ana Canyon
10 Master Plan of Drainage (MPD) applicable within
the annexed area and with OCFCD standards and
!~ engineering criteria.
!2 f. The city shall continue to collect fees as
13 prescribed by the Major Thoroughfare and Bridge
Fee Programs for the Foothill and Eastern
Transportation Corridors and deposit said fees,
15 plus interest earned, with the Transportation
~6 Corridor Agency each quarter.
{7 g. The City shall continue to collect fees as
prescribed by the Major Thoroughfare and Bridge
18 Fee Program for Santiago Canyon Road and
!~w deposit said fees plus interest earned with the
20 County of Orange each quarter of the County's
fiscal year.
21 h. The City shall make application to the County
22 of Orange for amendment to the County Master
23 Plan of Arterial Highways and Master Plan of
Countywide Bikeways in the proposed annexation
24 area to provide consistency with the
2~' circulation system required to implement the
26 Mountain Park Specific Plan.

! Section 5. The City of Anaheim is designated as the conducting
2 authority and is hereby directed to initiate
proceedings in compliance with this resolution.
3 Section 6. The City Council of said conducting authority~ is
authorized to annex said territory without notice

Section 56837 of the Government Code.
6 Section 7. The Irvine Company, as applicant, shall be liable
? and pay the applicable State Board of Equalization
8 filing and processing fee prior to the issuance of
the final statement of boundary change by the
9 Executive officer of the Local Agency Formation

Section 8. The Executive officer is hereby authorized and
