91-307 RESOLUTION NO. 91R- 307 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING PERSONNEL RULE 1 AS SET FORTH IN RESOLUTION NO. 88R-166 AND PERSONNEL RULE 33 AS SET FORTH IN RESOLUTION NO. 90R-153 WHEREAS, the City Council of the city of Anaheim adopted Resolution No. 88R- 166 on April 26, 1988, adopting certain personnel rules applicable to employees in management, confidential and non-represented part-time classifications for the City of Anaheim (the "Personnel Rules"); and WHEREAS, on May 8, 1990, the city Council adopted Resolution No. 90R-153 amending said Personnel Rules, including the adoption of new Personnel Rule 33 pertaining to post retirement medical benefits; and WHEREAS, the Human Resources Director of the City of Anaheim has heretofore recommended that said Personnel Rules be amended in the manner hereinafter set forth; and WHEREAS, the City Council does find that such amendments are in the best interests of the city of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the city Council of the city of Anaheim as follows: 1. That new Section 1.5 be, and the same is hereby, added to Personnel Rule 1 as set forth in Resolution No. 88R-166, to read as follows: "Section 1.5 Nothing contained in these Rules shall be deemed to prevent the City Council from entering into a written agreement concerning or relating to the employment, continued employment or separation from employment of any employee with regard to whom the power of appointment or removal, or the approval of appointment or removal, is vested in the City Council pursuant to the City Charter and which written agreement contains one or more provisions which conflict with any provision(s) of these Rules. In the event of any such conflict between any provision of such a written agreement approved by the City Council and any provision of these Rules, the provision of said agreement shall apply and shall supersede the conflicting provision contained in these Rules." 2. That Section 33.051 of Personnel Rule 33 as set forth in Resolution No. 90R-153 be, and the same is hereby, amended to read as follows: "33.051 Once cancelled for any reason, coverage shall not be reinstated unless the specific cause of such cancellation is the return to active service with the City of Anaheim in which case coverage shall be reinstated immediately upon separation from the city following such return to active service." BE IT FURTHER RESOLVED that, except as expressly amended herein, Resolutions No. 88R-166 and 90R-153, as the same may have heretofore been amended, shall remain in full force and effect. BE IT FURTHER RESOLVED that this Resolution shall take effect immediately upon its adoption.
