4467FOLLOWS: ORDINANCE NO. 4467 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING SECTION 18.03.070 OF CHAPTER 18.03 OF TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1. That Section 18.03.070 of Chapter 18.03 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: "18.03.070 PLANNING COMMISSION ACTIONS. — .010 Not more than forty (40) days -- --- following completion of the public hearing for any reclassification, conditional use permit or variance before the Planning Commission, the Planning Commission shall announce its findings by formal resolution and said resolution shall recite, among other things, the facts and reasons which, in the opinion of the Commission, make the granting or denial of the reclassification, conditional use permit or variance necessary to carry out the provisions and general purpose of this title and shall also recite such conditions and limitations as may be imposed to serve the purpose of this chapter. All such resolutions shall be numbered consecutively in the order of their passage and shall become a permanent record of the Planning Commission. .020 In the event the Planning Commission is unable to act upon any matter at any meeting due to a tie vote among its members, and notwithstanding any other provision of this Code, the Planning Commission may, by motion duly adopted, refer such matter to the City Council without further action or recommendation. In the absence of the adoption of such a motion by the Planning Commission referring such matter to the City Council without action or recommendation, such matter shall be deemed auto- matically continued to the next regular meeting of the Planning Commission for further consideration. In the event the Planning Commission fails to take action upon any matter within forty (40) days fol- lowing completion of the public hearing upon such matter, or, if no public hearing is required upon such matter, within forty (40) days following the date of first consideration of such matter by the Planning Commission, such matter shall, upon the expiration of said fortieth day, be deemed automatically referred to the City Council without action or recommendation for such further proceedings as may be required by law. SECTION 2. CERTIFICATION The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
