4473ORDINANCE NO. 4473 AN ORDINANCE OF THE CITY OF ANAHEIM AMEND- ING TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the City Council did adopt its Resolution No. g�u_�nti determining that a change or changes in the zone or zones Tereinafter mentioned and described should be made as hereinafter set forth after duly noticed hearings and receipt of the report and recommendation of the City Planning Commission; and WHEREAS, said Resolution did impose certain conditions and requirements precedent to the adoption of an ordinance chang- ing said zone or zones, which conditions and requirements have been satisfied. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That Title 18 of the Anaheim Municipal Code relating to Zoning be, and the same is hereby, amended by changing the boundaries of the zones set forth in said Title 18 by adopting a sectional zoning map or maps showing such change or changes as follows: That all of the area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: THAT PORTION OF THE EAST HALF OF THE NORTHWEST QUARTER OF FRACTIONAL SECTION 3, T 4 S, R 10 W, WITHIN THE RANCHO SAN JUAN CAJON DE SANTA ANA, CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, CONVEYED TO HENRY G. MEISER BY DEED RECORDED IN BOOK 636, PAGE 354 OF DEEDS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY, DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHEASTERLY CORNER OF PARCEL 4 OF THE HIGHWAY RIGHT OF WAY RELINQUISHED (REL -254) TO THE CITY OF ANAHEIM BY RESOLUTION OF THE CALIFORNIA HIGHWAY COMMISSION, A CERTIFIED COPY OF WHICH RESOLUTION IS RE- CORDED NOVEMBER 30, 1965 IN BOOK 7756, PAGE 472 OF OFFICIAL RECORDS, IN SAID OFFICE;. THENCE NORTHERLY ALONG THE EASTERLY LINE OF SAID PARCEL 4 DESCRIBED THEREIN AS 9WC ATTY-50 E � 314m i7 N 10 36' 48" E, 141.69 FEET TO THE NORTHERLY TERMINUS OF SAID COURSE SO DESCRIBED: THENCE S 890 36' 00" E, 322.00 FEET; THENCE S 40° 56' 24" E, 33.03 FEET; THENCE S 70 43' 07" W, 90.40 FEET; THENCE S 58° 28' 27" W, 75.96 FEET TO THE SOUTHERLY LINE OF SAID LAND OF MEISER; THENCE N 86° 51' 29" W, 271.14 FEET TO THE POINT OF BEGINNING, be changed to the "ML" INDUSTRIAL, LIMITED ZONE, subject to the following conditions: 1. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Executive Director of Public Works. 2. That fire hydrants shall be installed and charged as re- quired and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 3. That subject property shall be served by underground utilities. 4. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 5. That appropriate water assessment fees as determined by the Office of Utilities General Manager shall be paid to the City of Anaheim prior to the issuance of a building permit. 6. That the owners of subject property shall pay the traffic signal assessment fee (Ordinance No. 3896) in an amount as deter- mined by the City Council for industrial buildings prior to the issuance of a building permit. 7. That the proposed driveway from Lemon Street shall have a maximum grade of 2% for a distance of 40 feet from the back (east) of the sidewalk adjacent to said street. 8. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 and 2. 9. That Condition Nos. 1, 3, 4, 7 and 8, above-mentioned, shall be complied with prior to final building and zoning inspec- tions. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. Iwa SECTION 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of,general circulation, printed, published and cir- culated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
