4477FOLLOWS: ORDINANCE NO. 4477 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ADDING SECTION 4.18.045 TO THE ANAHEIM MUNICIPAL CODE PERTAINING TO AMUSEMENT AND ENTERTAINMENT PREMISES - RESTAURANTS THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1. That Section 4.18.045 be and the same is hereby added to the Anaheim Municipal Code to read as follows: "4.18.045 REVOCATION OF PERMIT - CITY COUNCIL MAY MAKE RULES - NEW PERMIT AFTER REVOCATION When the Council issues any permit under the terms of the preceding section, the same may be revoked or suspended at any time thereafter by the Council if the Council becomes satisfied that the conduct of any entertainment permit - restaurants does not or will not comport with the public welfare, or that the same has been conducted in an illegal, improper or disorderly manner. The Council may make rules governing entertainment permit - restaurants and may revoke or suspend a permit issued therefor when the proprietor or person in charge thereof violates or permits any infraction of such rules or any law of the State or any ordinance of the City; provided, however, that no permit shall be revoked or suspended under the terms of this section unless hearing and notice thereof be given, which hearing shall be had before the Council not less than ten days from the date of service of notice upon the permittee, and that at the hearing the permittee shall be permitted to introduce such evidence as is material to the hearing. Upon revocation of a permit, the license fees paid hereunder shall be forfeited and no new permit shall be issued to such permittee for at least one year thereafter. SECTION 2. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elim- ination herefrom of any such portion as may be declared invalid. SECTION 3. CERTIFICATION The City Clerk shall certify to the passage of this or- dinance and shall cause the same to be printed once within fifteen .- (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
