A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM
AMENDING RATES, RULES AND REGULATIONS FOR THE SALE AND
DISTRIBUTION OF ELECTRICITY AS ADOPTED BY RESOLUTION NO.
71R-478 AND MOST RECENTLY AMENDED BY RESOLUTION NO. 92R-25.
WHEREAS, the city of Anaheim maintains an electric
generation and distribution system for the furnishing of
electricity to residents and inhabitants of the city of Anaheim
and has adopted Electric Rates, Rules and Regulations for the
sale and distribution of electricity; and
WHEREAS, a Notice of Hearing was published as follows:
1. On January 11, 1993, notice of the public hearing on
electric rates was published in the Orange County
Register and proof thereof is on file with the
Secretary of the Public Utilities Board.
2. On January 11, 1993, notice of the public hearing on
electric rates was published in the Orange County
Edition of the Los Angeles Times and proof thereof is
on file with the Secretary of the Public Utilities
Board.
WHEREAS, the Public Utilities Board held a public hearing on
January 21, 1993 and evidence was presented in connection with
proposed revisions of Electric Rates, Rules and Regulations; and
WHEREAS, the Public Utilities Board considered the proposal
of the Public Utilities Department and has considered the
evidence presented at the public hearing; and,
WHEREAS, the Public Utilities Board has made the following
findings with respect to the need for changes to the Electric
Rates, Rules and Regulations:
1. The Electric System revenue requirement of the Anaheim
Public Utilities Department is $217,062,000, as set
forth below, on the basis of projections for the 1992-
93 fiscal year consisting of the twelve months July 1,
1992 through June 30, 1993.

Total Revenue Requirement $217,062,000
2. The estimated service life of SONGS is thirty years and
the estimated retirement date is October 18, 2013. The
decommissioning cost estimate for SONGS is $639,700,000
(1988 dollars) of which the city of Anaheim's share is
3.16%. A reasonable estimate of the revenue
requirements for decommissioning costs for the test
period is $1,227,000.
3. It is appropriate to include decommissioning costs in
the utility rates charged to all customers.
4. It is appropriate to perform a cost-of-service study in
order to determine the allocated revenue requirement
for the test period for the following customer classes:
Residential, General Service (GS) 1A (Non Demand);
General Service (GS) lB (Demand); General Service (GS)
2; Agricultural and Pumping; Street Lights; and
Municipal.
5. Section 1221 of the City Charter provides that utility
rates charged to a class of consumers shall be uniform
within the class and shall be based on cost-of-service
revenue requirement for the class. It is also
appropriate to phase in rate changes to bring class
revenues to their cost-of-service levels when one time
changes would be burdensome to a particular class.
6. Section 1221 also provides that lifeline rates may be
established which would not necessarily be based on cost
of service. The California Public Utilities Commission
has established baseline rates for Southern California
Edison Company (Edison) and therefore, it is appropriate
to establish residential lifeline rates for Anaheim. It
is appropriate to phase in rate changes to bring class
revenues to their cost-of-service levels when one time
~, changes would be burdensome to a particular customer
class.
7. On the basis of the preceding findings, the annual class
revenues under the proposed base rates are reasonable and
appropriate.
8. It is appropriate to decrease the Electric Utility
revenue from sales budget for Fiscal Year 1992/93 from
$223,320,000 to $217,062,000.
9. It is appropriate to decrease the Electric Utility
revenue from surplus sales budget for Fiscal Year 1992/93
from $6,365,000 to $3,813,000.
10. It is appropriate to decrease the Electric Utility power
supply budget for Fiscal Year 1992/93 from $169,234,452
to $157,152,000.
11. It is appropriate that the Rate Stabilization Account
(RSA) be used as a means of providing more stable retail
electric rates for the customers of the city's Electric
Utility.
12. Reasonable estimates for engineering and service fees and
charges are contained in the proposed Electric Rates,
Rules and Regulations.
WHEREAS, the Public Utilities Board considered the California
Environmental Quality Act and made the following findings:
1. The establishment of these rates as set forth above will
ensure adequate revenues necessary to meet power supply
costs, operation and maintenance expenses, capital
expenditures, debt service requirements, reserve amounts,
and other necessary operating and maintenance expenses.
'~, 2. The transfer to the General Fund in an amount estimated
to be $8,957,000 is authorized by the City Charter and
constitutes an Intra-City transfer.
3. The matters covered in 1 and 2 above come within Section
21080 (b) (8) of the Public Resources Code of the State of
California. Section 21080 (b) (8) states that CEQA does
not apply to the establishment, modification,
structuring, restructuring, or approval of rates, tolls,
fares, or other charges which the public agency finds are
for the purpose of meeting operating expenses, materials,
meeting financial reserves, obtaining funds for capital
projects necessary to maintain service within existing
service areas, or obtaining funds necessary to maintain
those intracity transfers as are authorized by city
charter. Thus, the establishment of these rates is
exempt from the California Environmental Quality Act.
WHEREAS, based on the findings hereinabove made, the Public
Utilities Board of the city of Anaheim recommended to the city
Council that the Council adopt the findings of the Public Utilities
Board with respect to the matters contained herein and adopt the
changes to the Electric Rates, Rules and Regulations as shown in
Appendix A; and
WHEREAS, the City Council has considered the evidence and
concurs with the findings of the Public Utilities Board as set
forth hereinabove with the exceptions noted below:
1. The Electric System revenue requirement of the Anaheim
Public Utilities Department is $216,008,000, as set forth
below, on the basis of projections for the 1992-93 fiscal
year consisting of the twelve months July 1, 1992 through
June 30, 1993.

2. It is appropriate to decrease the Electric Utility
revenue from sales budget for Fiscal Year 1992/93 from
$223,320,000 to $216,008,000.
3. It is appropriate to decrease the Electric Utility
revenue from surplus sales budget for Fiscal Year 1992/93
from $6,365,000 to $6,328,000.
4. It is appropriate to decrease the Electric Utility power
supply budget for Fiscal Year 1992/93 from $169,234,452
to $159,022,298.
NOW, THEREFORE BE IT RESOLVED that:
1. The findings of the Public Utilities Board as set forth
herein are hereby adopted by the City Council of the city
of Anaheim.
2. The changes and additions to the Electric Rates, Rules
and Regulations as shown in Appendix A are hereby adopted
by the City Council of the city of Anaheim and will
become effective March 24, 1993.
3. The Public Utilities General Manager is hereby authorized
and directed to prepare, promulgate, publish, and
implement changes to the Electric Rates, Rules and
Regulations which follow the rate design methodology
considered by the Public Utilities Board at the public
hearing on January 21, 1993 and which result in the
following system average rate increases:

GENERAL SERVICE - EXPERIF/ENTAL
APPLICABILITY
For purposes of business development and retention, applicable to single and three
phase general service, including lighting and power, for production and
manufacturing operations within the City of Anaheim with 15 kw demand or greater,
but less than 200 kw demand. This schedule is available to customers whose normal
production hours would include the on-peak time periods as specified in the
Special Conditions set forth herein and who can demonstrate to the Public
Utilities General Manager that it would be to the customer's economic advantage
to locate operations elsewhere. Eligibility for this schedule is solely at the
discretion of th~ Public Utilities General Manager and the number of customers on
the schedule at any time may be limited.

The minimum charge shall be the total of the monthly Customer Charge and
Facilities Charge.
SPECIAL CONDITIONS
A. Service voltage per rules and regulations.
B. The Facilities charge shall be based on the rated transformer capacity, which
shall be 50 percent of the installed transformer kilovolt-amperes dedicated to the
customer, or the highest demand recorded in the preceding eleven billing periods,
whichever is greater, but in no event shall it be less than 15 kw.
C. The MaximumDemand shall be the average kilowatt lead to the nearest one-tenth
kilowatt during the 15-minute period of greatest use at any time during a rating
interval, as recorded by the Department's meter. In cases where demand is
intermittent or subject to severe fluctuations, the Department may establish the
Maximum Demand on the basis of measurement over a shorter interval of time or the
kilovolt-amperes of installed transformer capacity required to meet the customer's
lead.

D. The on-peak demand charge shall be based on the Maximuln Demand recorded within
the applicable rating period.
Time periods are defined as follows:
On-Peak: 1:00 p.m. to 5:00 p.m.; sununer weekdays except holidays.
Holidays are New Year's Day, Washington's Birthday, Memorial Day,
Independence Day, Labor Day, Veterans Day, Thanksgiving Day, and Christmas.
When any holiday listed above falls on Sunday, the following Monday will be
recognized as an off-peak period.
The summer season shall commence at 12:01 A.M. on June 1 and continue until 12:00
mi~]ight on September 30 in each year. The winter season shall commence at 12:01
A.M. on October 1 of each year and continue until 12:00 midnight on May 31 of the
following year.
F. Where the Department installs the standard transformer capacity requested by
a customer to separately serve any X-ray installation, the Customer Charge will
be increased by $1.00 per kva of trm~sformer capacity requested.
G. No adjustment will be made for any temporary reduction in lead. Any customer
who resumes service within twelve months must pay all charges that would have been
billed had service been continuous.
H. Power Cost Adjustment:
The rates above are subject to adjustment as provided for in Schedule PCA.
The applicable power cost adjustment billing factor set forth therein will be
applied to all kilowatt-hours billed under this schedule.

This schedule is mandatory for all customers whose monthly maximum demand has
exceeded 200 kw for any three months during the preceding 12 months and whose
average demand for the preceding 12 months also exceeds 200 kw. Any customer
whose monthly maximum demand has fallen below 200 kw for any three months during
the preceding 12 months and whose average demand for the preceding 12 months also
is less than 200 kw may elect to take service on Schedule GS-1B

B. Billing Demand:
The billing demand in any month shall be the average kilowatt input
indicated or recordedby instruments to be supplied, owned, and maintained by the
City and at the City's expense upon the consumer's premises adjacent to the
watt-hour meter, in the 15 minute interval which the consumption of electric
energy is greater than in any other 15 minute interval in the month, but not less
than either tl) 50% of the contracted for or connected lead, or (2) 50% of the
highest billing demand in the preceding eleven months, whichever is the greater.
However, in no case shall the billing demand be less than 200 KW. Billing demand
shall be determined to the nearest KW. Whenever the measured maximum demand has
exceeded 400 KW for three consecutive months and thereafter until it has fallen
below 300 KW for 12 consecutive months, a 30 minute interval will be used. Where
the demand is intermittent or subjected to violent fluctuations, the maximum
demand may be based on a shorter interval.

the nearest unit. A rachet device will be installed on the kilovat-hour
meter to prevent its reverse operation on leading power factor.
D. Voltage Discount:
The charges excluding the customer charge and Power Factor and Power Cost
Adjustments will be reduced by 3% for service delivered and metered at
voltages from 2 to 10F3;; by 6% for service delivered and metered at voltages
from 11KV to 50KV; customer equipment and metering per Department standards.
Service at voltage levels above 50KV will be by contract.
E. Temporary Discontinuance of Service:
Where the use of energy is seasonal or intermittent, no adjustment will be
made for a temporary reduction of load. Any customer who resumes service
within twelve months must pay all charges that would have been billed had
service been continuous.
F. Power Cost Adjustment:
The rates above are subject to adjustment as provided for in Schedule PCA.
The applicable power cost adjustment billing factor set forth therein will
be applied to all kilowatt-hours billed under this schedule.
G. X-Ray Installation
Where the City installs the standard transformer capacity requested by a
customer to service separately an X-ray installation, the customer charge
will be increased by $1.00 per kva of transformer capacity requested.

Each contract for electric service shall contain the following
provision:
"This contract shall at all times be subject to such changes or
modifications by the City Council of the City of Anaheim as said City
Council may, from time to time, direct in the exercise of its
jurisdiction."
B. UTILITY BILL
The following statements will be printed on each utility bill:

Should you have a question regarding this bill, please request an

92803). If, after you receive the explanation from Customer
Service,. you still believe you have been billed incorrectly, you
have ten days to send your remittance (payable to the City of
Anaheim) with the bill and a statement supporting your belief that

discontinuance of service. The General Manager will review the

C. DISCONTINUANCE OF SERVICE NOTICE
The following statement will be printed on each discontinuance of
service notice:
"If payment is not received by 5:00 p.m. on the date shown above,
your service will be disconnected without further notice. Full
payment of the bill plus any reconnection charges will be required
prior to any restoration of services. A deposit may be required to
reestablish your credit, whether or not service is disconnected for
nonpayment."
"Tampering with meter or unauthorized breaking of seal constitutes
a misdemeanor. Charges for equipment replacement must be paid in
advance of restoring the service."

RULE NO. 6
ESTABLISHMENT AND REESTABLISHMENT OF CREDIT
A. ESTABLISHMENT OF CREDIT - ALL CLASSES OF SERVICE
Each applicant for utility service will be required to satisfactorily
establish credit which will be deemed established upon qualifying under any
one of the following:
1. If applicant makes a cash deposit to secure payment of bills for
service in the amount prescribed in Rule NO. 7; or
2. If applicant furnishes a guarantor, satisfactory to the Utility, to
secure payment of bills for service requested; or
3. If applicant has been a customer of the Utility for a similar type of
service within the past two years and during the past twelve
consecutive billing periods of that prior service has had not more than
two final notices as prescribed in Rule No. 11-B, provided that the
periodic bill for such previous service was equal to at least 50% of
that estimated for the new service and provided further, that the
credit of the applicant is unimpaired in the opinion of the Utility; or
4. If applicant's credit is otherwise established to the satisfaction of
the Utility.

B. REESTABLISHMENT OF CREDIT - ALL CLASSES OF SERVICE
1. An applicant who previously has been a customer of the Utility and
whose service has been discontinued by the Utility one or more times
during the past twelve billing periods of that prior service because of
nonpayment of bills, may be required to reestablish credit by (1)
depositing the amounts prescribed in Rule No. 7 for that purpose, or
(2) furnishing a guarantor in the amount prescribed in Rule No. 7
satisfactory to the Utility, to secure payment of bills for service
requested, and by paying utility bills regularly due; except, an
~ applicant for domestic service will not be denied service for failure
to pay such bills for other classes of service.
2. A customer who fails to pay bills before they become past due as
prescribed in Rule No. 11-B, and who further fails to pay such bills by
the date indicated on a discontinuance of service notice for nonpayment
of bills, may be required to pay said bills and reestablish credit by
depositinG the amount prescribed in Rule No. 7. This rule will apply
regardless of whether or not service has been discontinued for such
nonpayment.
3. A customer may be required to reestablish credit in accordance with
Rule No. 6-A in case the conditions of service or basis on which credit
was originally established have, in the opinion of the Utility,
materially changed.

RULE NO. 7
DEPOSITS
A. GENERAL
Deposits will be required when a customer is otherwise unable to
satisfactorily establish or reestablish credit as set forth in Rule No. 6.
AMOUNT OF DEPOSIT
The amount of deposit required to establish or reestablish credit for
electric service is twice the estimated average bill or an amount equal to
the expenses incurred by the Public Utilities Department in supplying the
service plus a sum equal to twice the estimated average bill for such
services; but in no case shall the amount be less than the minimum deposit
as set forth in Rule No. 23.
C. RETURN OF DEPOSIT
1. Upon discontinuance of service the Utility will refund the customer's
deposit or the balance in excess of the unpaid bills for service;
except the City shall not be required to refund any advanced deposit
balance where the cost to the City for processing such refund, which is
herewith determined to be five dollars ($5.00) exceeds said advanced
deposit balance.
2. After the customer has paid bills for service for twelve consecutive
billing periods without having had more than two final notices as
defined in Rule No. 11-B, the Utility will refund the deposit. If the
customer has had more than two final notices the Utility will
thereafter review the account every twelve billing periods and will
refund the deposit after the customer has not had more than two final
~ notices during the twelve billing periods prior to any review.
3. The Utility may return the deposit at any time upon request, provided
the customer's credit may otherwise be established in accordance with
Rule No. 6.
D. INTEREST ON DEPOSITS
There shall be no interest paid on utility deposits held by the City.

4. Pro rata Computation.
All bills for electric service rendered will be computed in accordance
with the applicable thirty-day rate schedule, but the size of the
energy blocks and the amount of the customer, service, demand or
minimum charge, specified therein, will be prorated on the basis of the
ratio of the number of days service has been rendered to the number of
days in an average month of thirty days.
B. READINGS OF SEPARATE METERS NOT COMBINED
For the purpose of billing, each meter upon the customer's premises will be
considered separately, and the readings of two or more meters will not be
combined, except as follows:
1. Where combinations of meter readings are specifically provided for in
the tariff schedules.
2. Where the Utility's operating convenience requires the use of more than
one meter.
C. PAYMENT OF BILLS
1. All bills are due upon receipt. Payment shall be made at the City of
Anaheim, Division of Collections.
2. Bills for connection or reconnection of service and payments for
~ deposits or to reinstate deposits as required under the rules of the
Utility shall be paid before service will be connected or reconnected.
D. RETURNED CHECK CHARGE
The Utility may require payment of a returned check charge equal to that
permitted under the City of Anaheim Municipal code for any check returned
from the bank unpaid.

RULE NO. 11
DISCONTINUANCE AND RESTORATION OF SERVICE
A. PAST DUE BILLS
Bills rendered will be considered past due if not paid within fifteen (15)
days after date of presentation.
B. NONPAYMENT OF BILLS
1. When a bill for utility service has become past due and an overdue
notice and final notice have been issued, service may be discontinued
if the bill is not paid within the time required by such notice. A
charge ~ill be assessed if personal 48-hour notification is delivered.
Any customer who contests a bill, and has initiated a complaint or
requested an investigation within 5 days of receiving said bill shall
not have service discontinued for nonpayment during the pendency of an
investigation by the City of such customer's dispute or complaint
provided the customer also keeps current the account for utility
services as charges accrue in each subsequent billing period. Services
shall not be discontinued for nonpayment for any customer complying
with an amortization agreement entered into with the City, provided the
customer also keeps current the account for utility services as charges
accrue in each subsequent billing period. If a customer fails to
comply with an amortization agrsement, the City will give a 7-day
discontinuance of service notice before discontinuing services, but
such notice shall not entitle the customer to further investigation by
the City.
2. Utility services to a domestic customer will not be discontinued for
non-payment when the customer has established to the satisfaction of
the City that such termination would be especially dangerous to the
~" health of the customer or a full time resident of the customer's
household. Certification from a licensed physician, public health
nurse, or a social worker may be required by the City. The City shall
make available to customers, upon request, information regarding
agencies and/or organizations that may provide financial assistance.
3. A customer's service may be discontinued for nonpayment of a bill for
service previously rendered him at any location served by the Utility
provided such bill is not paid within 15 days after presentation of a
notice that present service will be discontinued for nonpayment of such
bill for prior service. However, residential service will not be
discontinued because of nonpayment of bills for other classes of
service.

4. If a customer is receiving more than one service, any or all services
may be discontinued when any service, regardless of location, is
discontinued for nonpayment. However, residential service will not be
discontinued because of nonpayment of bills for other classes of
service.
5. Under no circumstances may service be discontinued for nonpayment of a
bill to correct previously billed incorrect charges for a period in
excess of the preceding three months, unless such incorrect charges
have resulted from the customer not abiding by the tariff schedules.
6. Bills collected on the premises by a field utility representative shall
include a collection fee which is contained in Rule No. 23.
7. On any Saturday, Sunday, legal holiday recognized by the City of
Anaheim, or at any time during which the business office of the City is
not open to the public, service will not be discontinued by reason of
delinquency in payment for utility services.
C. UNSAFE EQUIPMENT
The Utility may refuse or discontinue service to a customer if any part of
the customer's wiring or other equipment, or the use thereof, shall be
determined by the Utility to be unsafe or in violation of applicable laws,
ordinances, rules or regulations of public authorities, or if any condition
existing upon the customer's premises shall be thus determined to endanger
the Utility's service facilities, until it shall have been put in a safe
condition or the violation remedied.
The Utility does not assume any responsibility of inspecting or repairing
the customer's wiring or other equipment or any part thereof and assumes no
liability therefor.
D. SERVICE DETRIMENTAL TO OTHER CUSTOMERS
The Utility will not provide service to utilizing equipment, the operation
of which will be detrimental to the service of the Utility or its other
customers, and will discontinue electric service to any customer who shall
continue to operate such equipment after having been given notice by the
Utility to cease so doing.

E. FRAUD
The Utility may refuse or discontinue service if the acts of the customer or
the conditions upon the customer's premises are such as to indicate to it an
intent to defraud the Utility. A fee will be collected for the
investigation of acts of fraud and/or diversion as referenced in Rule 23.
F. FAILURE TO ESTABLISH OR REESTABLISH CREDIT
If, for an .applicant's convenience, the Utility should provide service
before credit is established or should continue service to a customer when
~ credit has not been reestablished in accordance with Rule No. 6, and the
customer fails to establish or reestablish credit, the Utility may
discontinue service.
G. NONCOMPLIANCE
Except as otherwise specifically provided in this Rule NO. 11, the Utility
may discontinue service to a customer for noncompliance with tariff
schedules if, after written notice of at least 5 days, the customer has not
complied with the notice. The Utility may dispense with the giving of such
notice in the event there exists in the Utility's opinion a dangerous
condition, thus renderin~ the immediate discontinuance of service to the
premises imperative.
H. CUSTOMER'S REQUEST FOR SERVICE DISCONTINUANCE
When a customer desires to terminate responsibility for service, the
customer shall give the Utility not less than two days' notice of this
intention, state the date on which the customer wishes the termination to
become effective, and provide the Utility with the address to which the
closing bill should be mailed. A customer may be held responsible for all
service furnished at the premises until two days after receipt of such
notice by the Utility or until the date of termination ~peclfied in the
notice, whichever date is later.
I. RESTORATION--RECONNECTION CHARGE
The Utility will require payment of a reconnection charge for each incident
in which the service(s) were disconnected before restoring service that has
been disconnected for nonpayment of bills or for failure otherwise to comply
with tariff schedules. If service(s) has been illegally restored or damaged
due to t~npering, the customer must pay all damage charges prior to
reconnectlon. The customer and/or beneflciaryof service is responsible for
all damage charges whether or not service is reconnected.

RULE NO. 14
VARIATIONS IN THE QUALITY OR SUPPLY OF ELECTRICITY
A. QUALITY
The Public Utilities Department does not give any warranty, expressed or
implied, as to the quality, adequacy, safety, or other characteristics
of the electricity and/or electric service provided by the Public
Utilities Department.
B. SHORTAGES, BROWNOUTS, INTERRUPTIONS, SPIKES, SURGES
1. The Public Utilities Department will exercise reasonable diligence 1) to
furnish a continuous and sufficient supply of electricity to its
customers and 2) to minimize the occurrence of shortages, brownouts,
interruptions, spikes, surges, or other electricity delivery problems;
~"'~ however, the Public Utilities Department cannot and does not guarantee
a continuous or sufficient supply, or freedom from such conditions which
may affect the quality of the electricity provided.
2. The Public Utilities Department will not be liable for variations in the
quality of electricity supplied, nor for failure to supply a continuous
or sufficient supply of electricity, nor will it be liable for
variations in the quality of electricity supplied, nor for damage or
loss occasioned by such failure to supply, or by shortages, brownouts,
interruptions, spikes, surges, or other electricity delivery problems.
3. Whenever, in the operation of the Public Utilities Department's electric
plants, properties, and/or systems, interruption in the delivery of
electricity to customers results from or is occasioned by causes other
than the exercise by the Public Utilities Department of its right to
suspend temporarily the delivery of electricity for the purpose of
making repairs or improvements to its system, notice of any such
interruption will not be given to the customers of the Public Utilities
Department, but the Public Utilities Department will exercise reasonable
diligence to reinstitute delivery of electricity.

C. TEMPORARY SUSPENSION FOR REPAIRS
1. The Public Utilities Department, whenever it shall find it necessary for
the purpose of making repairs or improvements to its system, shall have
the right to suspend temporarily the delivery of electricity. In all
cases, as reasonable notice thereof as circumstances will permit will be
given to the customer, and the making of such repairs or improvements
will be prosecuted as rapidly as may be practicable consistent with
prudent Utility practices; and, to the extent practicable and consistent
with prudent Utility practices will minimize the inconvenience to the
~ Public Utilities Department's customers.
2. When it is necessary to suspend temporarily the delivery of electricity
for repairs or improvements to the system in accordance with Rule 14.C.1
above, and the customer requests that such suspension of service occur
at other than during normal Public Utilities Department working hours,
the Utility reserves the right to receive, in advance, the total
estimated labor-related costs to be incurred by the Public Utilities
Department for performing the work during non-regular Public Utilities
Department work hours. The customer shall also pay any additional cost
actually incurred in excess of the estimated costs.
D. APPORTIONMENT OF SUPPLY DURING TIME OF SHORTAGE
Should a shortage of supply ever occur, the Public Utilities Department will
apportion its available supply of electricity among its customers as
authorized or directed by the Public Utilities General Manager in the manner
which he determines, at his discretion, to be equitable under conditions then
prevailing. The decision of the public Utilities General Manager shall be
final in such matters.

C. OPERATION OF RATE STABILIZATION ACCOUNT
1. Within 15 days after the end of each month, the Stabilization Transfer will
be calculated based on the recorded monthly kwh sales and existing
Stabilization Rate.
2. Within 15 days after the end of each month utilities Accounting takes
appropriate action to move the Stabilization Transfer from the restricted
cash of the Rate Stabilization Account to the unrestricted cash of the
Electric utility Operating Fund.
3. Within 15 days after the end of each month, the Public Utilities Department
shall furnish to the City Manager, City Council and Public Utilities Board
a report on the status of the RSA.

RULE NO. 24
ELECTRIC DIVISION CHARGES
The following charges, fees and bonds are to bs assesssed, as appropriate, from
builders, developers and customers requiring the Utillty's services or relocations.
I. SUBDIVISIONS - RESIDENTIAL
A. Chapter 17.08.450 of Municipal Code requires developers to post a
Subdivision and Tract Improvement Bond for Public Improvements. The
estimated cost for electrical underground utilities: $4.S00 Der acre.
B. Rule 15.1, Underground Extension Within New Residental Subdivision, of the
Eleotri~al Rates, Rules and Regulations provides that the developer,
subdivider or other customers requesting extensions within new residential
~ subdivisions shall pay, before start of construction, a nonqrefundable sum
as determined by the Utility based upon:
1. All costs for labor and material for the installation of said
underground system, and the preparation of plans, specifications and
inspecti.ons for said system.
2. By a unit price per lot or dwelling unit, as established in paragraph
B.4.b of Rule 15.1, based upon historical costs adjusted annually.
In accordance with these Rules and Regulations, the following charges are
established:
a. $1,350 per lot for RS-5000 and RS-7200 subdivision where single
family lots are between 5,000 and 9,999 square feet.
b. $1,485 per single family lot for lots in RS-10,000 and RS-22,000,
~ and RSHS-10,000 and RSHS-22,000 subdivisions where lots are
larger than 10,000 square feet.
c. $3,642 per individual single family residence where an individual
URD transformer is required;
or,
$1,900 per individual single family residence where an individual
overhead transformer is required.
d. $231 per unit for a multifamily residential development with
grouped meterlng served from an existing overhead or underground
transformer.

e. $242 per unit for a multifamily residential development with
grouped metering (16 or more meters) from a new 3 phase padmount
transformer.
f. $356 per unit for a multifamily residential development with
grouped metering served from a new overhead or underground
transformer.
g. If a residential subdivision/development, or individual residence
is of a nontypical layout (based on current typical single family
or multifamily developments as outlined above), the per lot/unit
~ charge will be established by the Electrical Engineering Division
in accordance with the Electric Rates, Rules, and Regulations.
C. In addition to the above fees, the developer shall provide all necessary
trenching, conduits, pull/splice vaults, backfilling, and related work in
accordance with Rule 15.1.
D. If construction of the subdivision underground utility facilities has not
begun within 12 months of the date of the fee payment, the per lot fee
shall be escalated by 10% per lot and paid by the developer before
construction proceede.
E. These unit costs are reviewed and updated on an annual basis to reflect
current expenses incurred by the City for installation of this type of
underground facility.
F. Fees for installation of an Underground Line Extension (backbone) in
developer provided conduit and substructure systems will be determined by
the Electrical Engineering Division, and billed accordingly.

II. COM~4ERCIAL/INDUSTRIAL SERVICE FEES
Applicants requesting new commercial/industrial service shall pay, before
start of construction, the following charges:
1. $1,400 for an underground service fed from an existing transformer.
2. $1,900 for an underground service fed from a new overhead transformer.
3. $4,032 for an underground service fed from a new padmount transformer.
III. ENGINEERING FEE FOR REDESIGN
If a contractor/builder/developer requests the Utility to revise, redesign, or
change the Electrical Utility system design for a project after final approval
by the Planning Commission, and such request requires duplication of
engineering effort and a reassignment of priorities to accommodate his
construction schedule, a fee shall be charged.
Unless specific circumstances or magnitude of the project indicate a special
cost estimate is necessary to recover all the City's expenses of labor,
overhead, burdens and printing expense, the engineering fee shall be $500.
IV. TEFEPORARY POWER AND SERVICE CHARGES
Applicants requesting temporary electrical service shall pay, before start of
construction, the following charges:
A. Single phase meter & overhead service $260.00
B. Span of single phase, three-wire secondary, plus
meter & service $710.00
C. Single phase overhead transformer plus meter & service $1,750.00
D. Single phase underground meter & service using
existing connections at pull box $1~0.00
E. Single phase underground meter & service using new
connections at pull box $450.00
F. Three phase service from new overhead transformer $3,500.00
G. Three phase service from new padmount transformer $6,250.00

and riser $7,750.00
I. Any temporay job that appears unusally complicated or difficult, as
determined by the Electric Utility, will be charged on an individual
estimated basis to recover all costs of labor and expense including
depreciation and loss of salvage incurred by the City in making such
installation.
V. STREET LIGHTS
I. Chapter 18.04.080.030 of the Municipal Code requires the installation of
street lighting facilities or payment of street lighting per front foot
fee. The ordinance requires all new developments to install the street
lighting facilities required in accordance with the official street
lighting standards on file in the Public Utilities Department. Front
foot fees are only collected when street lighting facilities are existing
and if the property has not previously paid a street light front foot
fee.
The front foot fee for street lighting is $6.00 Der front foot (Ordinance
4017 - June 5, 1979).
2 Developers/builders/contractors are required to post a performance bond
with the City to assure installation of public improvements. The bond
required for the street lighting facilities, which is a part of the
~ Public Improvements Bond deposited with the Real Property Section of the
Engineering division, Public Works Department, is determined on a per
front foot basis for abutting dedicated streets or highways at $32.00 Der
front foot; minimum $3,200.00 bond.
3. Private Streets - Public Works department, Engineering Division Standard
Detail No. 122, Note 10-A-4, states: "Lighting adequate for pedestrian
and vehicle safety and sufficient to minimize police problems as approved
by the Public Utilities General Manager shall be provided."
It is the Public utilities Department's policy that street lighting on
private streets be in aocordanee with IES street lighting
recommendations. The luminaire and pole should be as required by the
developer and not the City's street lighting unit. Street lighting on
private street shall be metered in accordance with the Utilities Rates,
Rules and Regulations and service requirements. If a private street is
approved for dedication to the City as a public street, the street lights
shall be installed per City Standards and Specifications by the owner and
the circuit re-wired for City service prior to acceptance of dedication
by the City.
