A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM
AMENDING RATES, RULES AND REGULATIONS FOR THE SALE AND
DISTRIBUTION OF WATER AS ADOPTED BY RESOLUTION NO. 72R-600 AND
MOST RECENTLY AMENDED BY RESOLUTION NO. 91R-337.
WHEREAS, the City of Anaheim maintains a water distribution
system for the furnishing of water to residents and inhabitants of
the City of Anaheim and has adopted Water Rates, Rules and
Regulations for the sale and distribution of water; and
WHEREAS, A Notice of Hearing was published as follows:
1. On January 11, 1993, notice of the public hearing on
water rates was published in the Orange County Register
and proof thereof is on file with the Secretary of the
Public Utilities Board.
2. On January 11, 1993, notice of the public hearing on
water rates was published in the Orange County Edition of
the Los Angeles Times and proof thereof is on file with
the Secretary of the Public Utilities Board.
WHEREAS, the Public Utilities Board held a public hearing on
January 21, 1993 and evidence was presented in connection with the
proposed revisions of Water Rates, Rules and Regulations; and
WHEREAS, The Public Utilities Board has considered the
proposal of the Public Utilities Department and has considered the
evidence presented at the public hearing; and
WHEREAS, the Public Utilities Board has made the following
findings with respect to the need for changes to the Water Rates,
Rules and Regulations:
1. The Water System revenue requirement of the Anaheim
Public Utilities Department is $27,508,000, as set forth
below, on the basis of projections for the 1992-93 fiscal
year consisting of the twelve months July 1, 1992 through
June 30, 1993.

2. It is appropriate to perform a cost-of-service study in
order to determine the allocated revenue requirement for
the test period for the following customer classes:
Single-Family Residential; Multi-Family Residential;
Residential Outside City; General Service; Municipal; and
Private Fireline.
3. The customer class revenue requirements, on a Utility
basis, as determined by the cost-of-service analysis and
by rate design are appropriate. The estimated total
allocated annualized revenue requirement of $28,250,000
is appropriate.
4. Section 1221 of the City Charter provides that utility
rates charged to a class of consumers shall be uniform
within the class and shall be based on cost of service
for the class. It is also appropriate to phase in rate
changes to bring class revenues to their cost-of-service
levels when one time changes would be burdensome to a
particular class.
5. On the basis of the preceding findings, the annual class
revenues under the proposed rates are reasonable and
appropriate.
6. It is appropriate to continue to fund the Water Capital
Replacement Fund by revenues from the sale of water.
7. It is appropriate to increase the Water Utility water
supply budget for 1992/93 from $10,700,399 to
$10,880,000.
8. It is appropriate to increase the Water Utility revenue
from sales budget for 1992/93 from $27,439,000 to
$27,508,000.
WHEREAS, the Public Utilities Board considered the California
Environmental Quality Act and made the following findings:
The establishment of these rates as set forth above will
ensure adequate revenues necessary to meet water supply
costs, operation and maintenance expenses, capital
expenditures, debt service requirements, reserve amounts,
and other necessary operating and maintenance expenses.
2. The transfer to the General Fund in an amount estimated
to be $985,000 is authorized by the city Charter and
constitutes an Intra-City transfer.
3. The matters covered in 1 and 2 above come within Section
21080 (b) (8) of the Public Resources Code of the State of
California. Section 21080 (b) (8) states that CEQA does
not apply to the establishment, modification,
structuring, restructuring, or approval of rates, tolls,
fares, or other charges which the public agency finds are
for the purpose of meeting operating expenses, materials,
meeting financial reserves, obtaining funds for capital
projects necessary to maintain service within existing
service areas, or obtaining funds necessary to maintain
those intracity transfers as are authorized by city
charter. Thus, the establishment of these rates is
exempt from the California Environmental Quality Act.
WHEREAS, based on the findings hereinabove made, the Public
Utilities Board of the City of Anaheim recommended to the City
Council that the Council adopt the findings of the Public Utilities
Board with respect to the matters contained herein and adopt the
changes to the Water Rates, Rules and Regulations as shown in
Appendix B; and
WHEREAS, based on the findings hereinabove made, the Public
Utilities Board of the city of Anaheim recommended to the City
Council that the Council, by Motion, certify that the adoption of
the Water Rates, Rules and Regulations is statutorily exempt under
the California Environmental Quality Act, Public Resource Code,
Section 21080 (b) (8), in accordance with Title 14 of the California
Administrative Code, Section 15273 (a), and authorize the City
Manager to execute, and the City Clerk to file, a Notice of
Exemption for same with the Orange County Clerk; and
WHEREAS, the city Council has considered the evidence and
concurs with the findings of the Public Utilities Board as set
forth hereinabove with the exception of the items noted below:
1. The Water System revenue requirement of the Anaheim
Public Utilities Department is $27,008,000, as set forth
below, on the basis of projections for the 1992-93 fiscal
year consisting of the twelve months July 1, 1992 through
June 30, 1993.

from sales budget for 1992/93 from $27,439,000 to
$27,008,000.
NOW, THEREFORE BE IT RESOLVED that:
1. The findings of the Public Utilities Board as set forth
herein are hereby adopted by the City Council of the City
of Anaheim.
2. The changes to the Water Rates, Rules and Regulations as
shown in Appendix B are hereby adopted by the City
Council of the City of Anaheim and will become effective
March 24, 1993.
3. The Public Utilities General Manager is hereby authorized
and directed to prepare, promulgate, publish, and
implement changes to the Water Rates, Rules and
Regulations which follow the rate design methodology
considered by the Public Utilities Board at the public
hearing on January 21, 1993 and which result in the
following system average rate increases:

COMMODITY ADJ~3STMENT CLAUSE
APPLICABILITY
Applicable to all areas served by the Utility and to all rate schedule
commodity charges.
PURPOSE
TO provide for the automatic adjustment of the Utility's water zate scbedule
commodity charges per 100 cubic feet whenever the cost per acre foot
of water is increased with respect to the base year of 1971-72 due to
changes in the Orange County Water District (OCWD) pump tax and basin equity
assessment, the Metropolitan Water District of Southern California (MWD) and
the Municipal Water District of Orange County (MWDOC) acre foot charge for
treated and untreated water and/or the costs of electricity associated with
underground water production.
To provide for the automatic adjustment of the Utility's water zate schedule
commodity charges per 100 cubic feet to recover expenditures made or
proposed within a designated time period, not to exceed oue year, to
accommodate Federal and/or State mandated rules and regulations pertaining
to water quality.
To establish the method for determining the cost of water per acre foot and
any resulting change (to the nearest mill) to the rate schedule commodity
charges per 100 cubic feet.
COST OF WATER
The cost of water shall be the sum of tbe percent of water pumped times its
total cost per A.F.* plus the percent of water purchased tim~,s its total
costs per A.F. The total cost per A.F. of pumped water is th~ sum of the
OCWD pump tax plus the cost of electricity to pump water per A.P. The total
cost per A.F. of purchased water is the MWD price per A.F. for treated
domestic water or the MWDOC price per A.F. for treated or untreated water.
For the base year 1971~72, 70 percent of the water was pumped and 30 percent
was purchased. Based on the A.F. costs indicated below, the cost of water
for the base year is $28.90 per A.F. for all water except agriculture and
$18.85 per A.F. for agriculture water.

Starting July 1, 1976, the commodity adjustment amount calculated as
illustrated in D.1 and D.2 above shall be adjusted to include system
losses as shown below. The System LOSS Factor used to calculate the
commodity adjustment shall be based on water system losses for the most
recent complete fiscal year.

4) The percent of water to be pumped and purchased established as of July
1 each fiscal year shall apply in any commodity adjustment computation
throughout that fiscal year.
The amount of the commodity adjustment and the data elements required
to compute the commodity adjustment shall be shown in the COMMODITY
ADJUSTMENT SUMMARY Section each time the commodity adjustment is
changed beginning with the base year 1971-72.
E. COST OF WATER 0U3kLITY ADJUSTMENT
The cost of the Water Quality Adjustment shall be calculated in accordance
with the following formula,

A Water Quality Adjustment Account shall be maintained by the Department,
Entries to ~his account shall include:
(a) An amount equal to water quality expenditures as recorded during the
month.
lb) Less: J~ amount equal to revenue billed during the time period that
is attributable to the Water Quality Adjustment.
F. APPLICATION OF COMMODITY ADJUSRI4ENT
The conTmodity charge for all rate schedules shall be adjusted as necessary
by the Utilities General Manager to reflect the cost per A.F. of water at
that time compared to the cost of water for the base fiscal year 1971~72 and
to reflect mandated expenditures for water quality improvements. The
increased cost of water shall be rounded to the nearest mill per 100 cubic
feet and added to the commodity charge for each rate block of each water
schedule rate charge.

Spacer Connections:
For tract developments requiring two inch or smaller meters, spacer connections may
be provided for the purpose of eliminating damage to permanent meters durin~ the
grading of parkways, and for pressure testing of plumbing. The rate shall be tile same
as the Rate 31, Single-Family Residential, customer charge for a 3/4" meter per month
for a single-family unit and an additional charge of $0.85 will be made for each unit
in excess of one that is served through a common meter.
SPECIAL CONDITIONS
A. Rates A and B of this schedule are subject to Schedules W-CA, W-PS and rules and
regulations of the Utility.
B. For Rate A of this schedule, the permit holders are required to submit meter readings
of the temporary meters on a monthly basis on forms provided by the Utility. If the
~ forms are not returned within 10 days from the date sent and it becomes necessary that
a Utility inspector obtain meter readings at the job site, an additional $16.50 fee
will be applied.
C. Temporary meCered connections may be terminated at any time, and will be at the
discretion of the Utility.

RULE NO. 5
SPECIAL INFOP/W~TION REOUIRED ON FORMS
A. CONTP~ACTS
Each contract for water service shall contain the following provision:
"This contract shall at all times be subject to such changes or
modifications by the City Council of the City of Anaheim as said City
Council may~ from time to time, direct in the exercise of its jurisdiction."
B. UTILITY BILL
The following statements will be printed on each utility bill:
1. "Bill is'due upon receipt."
'~ 2. "PROCEDURES FOR PROCESSING PAYMENT OF DISPUTED UTILITY BILL
Should you have a question regarding this bill, please request an
explanation from the Customer Services Division of the City of Anaheim,
within 10 days after receiving the bill. Your request may be by
telephone (714 254-0125) or in writing (Customer Service Manager,
Public Utilities Department, P.O. Box 3222, Anaheim, California 92803).
If, after you receive the explanation from Customer Service, you still
believe you have been billed incorrectly, you have ten days to send
your remittance (payable to the City of Anaheim) with the bill and a
written statement supporting your belief that the bill is not correct
to the General Manager, Public Utilities Department, P.O. Box 3222
Anaheim, California 92803, to avoid discontinuance of service. The
General Manager will review the basis of the billed amount and
authorize any adjustment required in accordance with his findings. If
the matter is not satisfactorily resolved with the General Manager, you
may petition the City Council for final determination."
~ C. DISCONTINUANCE OF SERVICE NOTICE
The following etatement will be printed on each discontinuance of service
notice:
"If payment is not received by 5:00 p.m. on the date shown above your
service will be disconnected without further notice. Full payment of
the bill plus any reconnection charges will be required prior to any
restoration of services. A deposit may be required to reestablish your
credit, whether or not service is disconnected for nonpayment."
"Tampering with meter or unauthorized breaking of seal constitutes a
misdemeanor. Charges for equipment replacement must be paid in advance
of restoring the service."

RULE NO. 7
DEPOSITS
A. GENERAL
Deposits will be required when a customer is otherwise unable to
satisfactorily establish or reestablish credit as set forth in Rule 6.
B. AMOUNT OF DEPOSIT
The a/nount of deposit required to establish or reestablish credit for
service is twice the estimated average bill or an amount equal to the
expenses incurred by the department in supplying the service plus a sum
equal to twice the estimated average bill for such service; but in no case
shall the amount be less than the minimum deposit as set forth in Rule 21.
C. RETUP~N OF DEPOSIT
~F 1. Upon discontinuance of service, the Utility will refund the customer's
deposit or the balance in excess of the unpaid bills for service;
except the City shall not be required to refund any advanced deposit
where the cost to the City for processing such refund, which is
herewith determined to be five dollars ($5.00), exceeds said advanced
deposit balance.
2. After the customer has paid bills for service for twelve consecutive
billing periods without having had more than two final notices, as
defined in Rule No. ll-B, the Utility will refund the deposit. If the
customer has had more than two final notices, the Utility will
thereafter review the account every twelve billing periods and will
refund the deposit after the customer has not had more than two final
notices during the twelve billing periods prior to any review.
3. The Utility may return the deposit at any time upon request, provided
the customer's credit may otherwise be established in accordance with
Rule No. 6.
D. INTEREST ON DEPOSITS
~ There shall be no interest paid on utility deposits held by the City.
E. DEPOSITS FOR TEMPORARY SERVICE
Deposits for temporary service shall be as specified in Rule No. 13,
Temporary Service.

b. When the total period of service is less than 30 days, no prorations
will be made, and the bill shall not be less than the monthly
minimum.
B. READINGS OF SEPAlSATE F~ETERS NOT COMBINED
For the purpose of billing, each meter upon the customer's premises will be
considered separately, and the readings of two or more meters will not be
combined, except as follows:
1. Where combination of meter readings are specifically provided for in the
tariff schedules.
2. ~lere the Utility's operating convenience requires the use of more than
one meter per service connection.
C. PAYPIENT OF BILLS
1. All bills are due upon receipt. Payment shall be made at the City of
Anaheim, Division of Collections.
2. Bills for connection or reconnection of service and payments for deposits
or to reinstate deposits as required under the rules of the Utility shall

D. RETUP~IED CHECK CHARGE
The Utility may require payment of a returned check charge equal to that
permitted under the City of Anaheim Municipal Code for any check returned
from the bank unpaid.

condition existing upon the customer's premises shall be thus determined to
endanger the Utility's service facilities, until it shall have been put in
a safe condition or the violation remedied. The Utility does not assume any
responsibility of inspecting or repairing the customer's plumbing or other
equipment or any part thereof and assumes no liability therefor.
D. SERVICE DETRIMENTAL TO OTHER CUSTOMERS
The Utility will not provide service to any equipment, the operation of
which will be detrimental to the service of the Utility or its other
customers, and will discontinue water service to any customer who shall
continue to operate such equipment after having been given notice by the
~l~' Utility to cease so doing.
E. FRAUD
The Utility may refuse or discontinue service if the acts of the customer or
the condition upon his premises are such as to indicate to it an intent to
defraud the Utility. A fee will be collected for the investigation of acts
of fraud and/or diversion as referenced in Rule 21.
F. FAILURE TO ESTABLISH OR REESTABLISH CREDIT
If, for an applicant's convenience, the Utility should provide service
before credit is established or should continue service to a customer when
credit has not been reestablished in accordance with Rule No. 6, and the
customer fails to establish or reestablish his credit, the Utility may
discontinue service.
G. NONCOMPLIANCE
Except as otherwise specifically provided in this Rule No. 11, the Utility
may discontinue service to a customer for noncompliance with tariff
schedules if, after written notice of at least five (5) days, he has not
complied with the notice. The Utility may dispense with the giving of such
notice in the event there exists in the Utility's opinion a dangerous
condition, thus rendering the immediate discontinuance of service to the
premises imRerative.

H. CUSTOmeR'S REQUEST FOR SERVICE DISCONTINUANCE
When a customer desires to terminate his responsibility for service, he
shall give the Utility not less than two days' notice of his intention,
state the date on which he wishes the termination to become effective, and
provide the Utility with the address to which the closing bill should be
mailed. A customer may be held responsible for all service furnished at the
premises until two days after receipt of such notice by tile Utility or until
the date of termination specified in the notice, whichever date is later.
I. RESTORATION--RECONNECTION CH3~qGE
The Utility w~11 require payraent of a reconnection charge for each incident
in which the service(s) were disconnected before restoring service that has
been discontinued for nonpayment of bills or for failure otherwise to comply
with tariff schedules. If service(s) have been restored illegally or
damaged due to tampering, the customer must pay all damage charges prior to
reconnection. The customer and/or beneficiary of service is responsible for
all damage charges whether or not service is reconnected.
In case the customer places a request on a day when maximum workload has
been scheduled, an additional charge will be made.
These charges are contained in Rule 21.

RULE NO. 17
METER TESTS JkND ADJUSTFiENT OF BILLS FOR ERRORS
A. TESTS
1. On Customer's Request. A customer may, on notice of not less than
one week, require the Utility to test the meter for his service.
No charge will be made for such test; but should a customer demand a
test within four (4) months after installation or more often than
once in six (6) months, a deposit will be required to cover the cost
of the test. This deposit will be returned if the meter is found to
register more than 3% fast or 3% slow.
The amount of the deposit required is dependent on the size of meter,
and is contained in Rule 21..
A customer shall have the right to require the Utility to conduct the
test in his presence or in the presence of an expert or other
representative appointed by him. The results of the test will be
furnished to the customer within a reasonable time after completion
of the test.
B. J~DJUSTMENT OF BILLS FOR METER ERROR
1. Fast Meters. When, upon test, any meter is found to be registering
more than 3% fast, the Utility will refund to the customer the amount
of the overcharge, based on corrected meter readings, subject to the
provisions of paragraph 4 hereof.
2. Slow Meters. When, upon test, any meter is found to be registering
more than 3% slow the Utility may bill the customer for the amount of
the undercharge, based on corrected meter readings, subject to the
provisions of paragraph 4 hereof.

FIRE PROTECTION
A. PRIVATE FIRE PROTECTION
1. Private fire protection services will be provided under the conditions
specified in RULE NO. 16, "Service Connections, Meters, and Customers'
Facilities.
2. The rates for private fire protection services are specified in RATE
SCHEDULE W-PFL, "Private Fire Line Service."
3. When a fireline service is provided to a building for an automatic
sprinkling system, it shall be the option of the property owner to be
responsible for the monthly service charges or to require the tenant
of the property to be responsible. In either case, it is the
responsibility of the property owner to notify the Utilities
Department. In the event the building is vacant and/or not leased,
the property owner shall be responsible for the monthly service
charges for the fireline.
B. PUBLIC FIRE PROTECTION
The location of all public fire hydrants shall be determined by the
Utility and the City of Anaheim Fire Department.
2. Where public fire hydrants are installed on Primary Distribution
Mains, the cost for these hydrants shall be borne by the property
benefiting from these hydrants according to the following rules:
a. Wilere hydrants of standard spacing are installed on one side of a
right-of-way to serve both sides of a right-of-way, tilere shall
be a front footage charge of $3.50 per foot on property which
fronts this right-of-way. Street intersections shall not be
included in the calculation of the fees, however, corner lots
~ will be required to pay the appropriate charges on each side of a
lot.
b. Where hydrants of standard spacing are installed on both sides of
a fight-of-way, the front footage charge shall be $7.00 per foot.
Street intersection and corner lots shall be treated as outlined
in (a.) above.
c. Where hydrants of standard spacing are installed to serve only
one side of a right-of-way, the front footage charge shall be
$7.00 per foot.
d. The above fees are due at the time application for water service,
other than temporary, is made or the property is developed.

If public fire hydrants, in addition to those of a standard spacing, are
requested by a customer or required by the City of ~laheim Fire
Department as a condition of development, the Utility may install these
hydrants at the customer's expense or the customer may install these
hydrants pursuant to Section B.4 of this rule.
4. Should a customer elect to have a public fire hydrant relocated, the
following'conditions shall prevail:
~ a. A detailed plan showing the proposed location of the fire hydrant
shall be submitted to the Utility for its review and approval.
b. Customer shall pay the appropriate plan check and inspection fees
as provided for in Section B.8.b, Rule No. 16 of these Rates, Rules
and Regulations.
c. All costs associated with the relocation of the fire hydrant shall
be paid by the customer.
d. The fire hydrant may be relocated by a Contractor provided he is
licensed to do this type of work and provided that the work is
performed in compliance with appropriate permits and licenses as
may be required by the City.
5. Public fire hydrants installed as a part of a main extension by a
customer shall be paid for by the customer and be subject to
~ reimbursement as outlined in RULE NO. 15, "Main Extensions~"
