4521FOLLOWS: ORDINANCE NO. 4521 AN ORDINANCE OF THE CITY OF ANAHEIM ADDING AND AMENDING VARIOUS SECTIONS AND SUBSECTIONS OF VARIOUS CHAPTERS OF TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1. That Section 18.04.080 of Chapter 18.04 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: "18.04.080 DEDICATION AND IMPROVEMENTS - GENERAL .005 Street Dedication and Improvements Required. Anticipating that changes will occur in the local neighborhoods and the City generally, due to noise, and other activities associated with the City's development and growth, the following dedications and improvements are deemed to be necessary to prevent congestion and other hazards that are related to the intensified use of the land, and to be necessary for the preservation of the public health, safety and general welfare. These requirements shall be met or complied with before any building permits are issued for development of the property except as otherwise specifically set forth herein: .010 Dedications of Right-of-way. The right-of-way for all streets, highways, sewers, storm. " drains and/or alleys which abut or cross the subject property shall be dedicated to the full width required by the City Engineer in accordance with the City of Anaheim standard plans as adopted. .020 Improvement of Right-of-way. All street, highway, sewer, storm drain and/or alley improvements shall have been installed and/or in good repair, or improvement plans shall be required to be prepared to City of Anaheim standards and such improvements constructed, prior to issuance of occu- pancy permits. A faithful performance bond in a form approved by the City Attorney and in an amount to be determined by the City Engineer shall be posted to guarantee the construction of the required improve- ments which may include, but not necessarily be limited to, excavation, curbs, gutters, pavement, drainage facilities, sewers or other engineering requirements. .030 Street Lighting Facilities. Street lighting facilities and CATV underground structures shall be installed prior to issuance of occupancy permits in accordance with the official street lighting plan and CATV specifications approved by the General Manager of the Public Utilities Department A performance bond shall be required in an amount estab- lished by the General Manager and in a form approved by the City Attorney to cover the installed cost of the facilities required. In lieu of installation of street lighting facilities, the General Manager may require street lighting fees on a front -foot charge basis for any abutting street or highway in an amount to recover the estimated cost for the street lighting facilities required in accordance with the official street light- ing plan approved by the General Manager. The require- ment for installation or payment of street lighting facilities front -foot fee may be waived by the General Manager if the subject property has previously been assessed a fee for the street lighting facilities, but none were installed due to the existing street lighting system complying with the official street lighting plan approved by the General Manager. .040 Street Trees. .041 Subdivisions constructed shall provide street trees in compliance with Chapter 17.08 of this Code. .042 Individual Lot Development. A street tree fee, in an amount set by a resolution of the City Council, shall be paid to the City for each lot individually developed. .050 Public Utility Easements. Public utility easements necessary to serve the subject prop- erty and/or area in which the subject property is situated shall be dedicated to the City in accordance with the requirements of the Utilities General Manager. Electrical utilities shall be placed under- ground and dedicated to the City of Anaheim in accord- ance with the requirements of the Utilities General Manager prior to issuance of occupancy permits. .060 Fire Protection Facilities. Necessary fire protection facilities shall be provided for in accordance with the requirements of the Fire . Chief prior to issuance of occupancy permits or at such other time as required by the Fire Chief." -2- SECTION 2. That Section 18.21.100 of Chapter 18.21, Section 18.22.100 of Chapter 18.22, Section 18.23.100 of Chapter 18.23, Section 18.24.100 of Chapter 18.24, Section 18.27.100 of Chapter 18.27, Section 18.31.100 of Chapter 18.31, Section 18.32.100 of Chapter 18.32, Section 18.34.100 of Chapter 18.34, Section 18.35.100 of Chapter 18.35, Section 18.41.100 of Chapter 18.41, Section 18.42.100 of Chapter 18.42, Section 18.44.100 of Chapter 18.44, Section 18.48.100 of Chapter 18.48, Section 18.61.100 of Chapter 18.61, Section 18.63.100 of Chapter 18.63, and Section 18.85.100 of Chapter 18.85, all of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: "DEDICATION AND IMPROVEMENTS. Dedication of streets, public utility easements and other public works and improvements shall be required in connection with any work pertaining to the erection, construction, reconstruction, moving, conversion, alteration or addition to any building or structure within this zone in accordance with the provisions of Section 18.04.080 of this Code." SECTION 3. That new Section 18.25.100 of Chapter 18.25, Section 18.26.100 of Chapter 18.26, Section 18.45.100 of Chapter 18.45, 18.46.100 of Chapter 18.46, 18.81.100 of Chapter 18.81, 18.82.100 of Chapter 18.82, Section 18.86.100 of Chapter 18.86, and Section 18.88.100 of Chapter 18.88 be, and the same are hereby, added to Title 18 of the Anaheim Municipal Code to read as follows: "DEDICATION AND IMPROVEMENTS. Dedication of streets, public utility easements and other public works and improvements shall be required in connection with any work pertaining to the erection, construction, reconstruction, moving, conversion, alteration or addition to any building or structure within this zone in accordance with the provisions of Section 18.04.080 of this Code." SECTION 4. That subsection .010 of Section 18.04.090 of Chapter 18.04 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: -3- "18.04.090 DEVELOPMENT REVIEW AND PERMITS - GENERAL. .010 Site Plan Review. In order to promote continued quality development in Anaheim and to safeguard and enhance both potential and estab- lished community values through the encouragement of compatible developments, all building and site plans shall be subject to review by the Building Division of the Planning Department of the City. Where a question arises as to the administration of specific sections of the Anaheim Municipal Code, the Planning Commission shall hear the matter at its next regular meeting. Appeals from the decision of the City Planning Commission shall be to the City Council in written form, stating the reasons for the appeal." SECTION 5. That Section 18.21.110 of Chapter 18.21, Section 18.22.110 of Chapter 18.22, Section 18.23.110 of Chapter 18.23, Section 18.24.110 of Chapter 18.24, Section 18.25.110 of Chapter 18.25, Section 18.26.110 of Chapter 18.26, Section 18.27.110 of Chapter 18.27, Section 18.31.110 of Chapter 18.31, Section 18.32.110 of Chapter 18.32, Section 18.34.110 of Chapter 18.34, Chapter 18.35.110 of Chapter 18.35, Section 18.41.110 of Chapter 18.41, Section 18.42.110 of Chapter 18.42, Section 18.44.110 of Chapter 18.44, Section 18.45.110 of Chapter 18.45, Section 18.46.110 of Chapter 18.46, Section 18.48.110 of Chapter 18.48, Section 18.61.110 of Chapter 18.61, and Section 18.63.110 of Chapter 18.63, all of Title 18 of the Anaheim Municipal Code be, and the same are hereby, amended to read as follows: "DEVELOPMENT REVIEW AND PERMITS. Prior to commencing any work pertaining to the erection, construction, reconstruction, moving, conversion, alteration or addition to any building or structure within this zone, all building and site plans shall be subject to review by the Building Division of the Planning Department of the City and permits shall be secured from the Chief Building Inspector of the City of Anaheim in compliance with all provisions of Section 18.04.090 'DEVELOPMENT REVIEW AND PERMITS - GENERAL'; provided further, that where there are existing buildings and structures on a site for which more intensive development is proposed under the provisions of this zone, no building permit shall be issued until the Chief Building Inspector and the Fire Chief have certified that the existing buildings and structures are safe for occupancy and for human habitation." 1XIM SECTION 6. That new Section 18.81.110 of Chapter 18.81, Section 18.82.105 of Chapter 18.82, Section 18.85.110 of Chapter 18.85, Section 18.86.110 of Chapter 18.86, and Section 18.88.110 of Chapter 18.88 be, and the same are hereby, added to Title 18 of the Anaheim Municipal Code to read as follows: "DEVELOPMENT REVIEW AND PERMITS. SECTION 7. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal hereby of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which viola- tions were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as or- dinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and con- tinuations, and not as new enactments. SECTION 8. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elim- ination herefrom of any such portion as may be declared invalid. -5- SECTION 9. CERTIFICATION The City Clerk shall certify to the passage of this or- dinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
