4526ORDINANCE NO. 4526 AN ORDINANCE OF THE CITY COUNCIL OF THE `^ CITY OF ANAHEIM REPEALING TITLE 1, CHAPTER 1.01, SECTION 1.01.380 AND ADDING NEW SECTIONS 1.01.380 AND 1.01.385 TO.CHAPTER 1.01 OF TITLE 1 OF THE ANAHEIM MUNICIPAL CODE PERTAINING TO PRISONERS AND REIMBURSEMENT OF THE CITY COST IN CERTAIN CRIMINAL ACTION. FOLLOWS: THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1. That Title 1, Chapter 1.01, Section 1.01.380 of the Anaheim Municipal Code be, and the same is hereby, repealed. SECTION 2. That Title 1, Chapter 1.01, Section 1.01.380 be added to the Anaheim Municipal Code to read as follows: "1.01.380 PRISONERS - LABOR ON PUBLIC WORKS .010 Persons confined in the City Jail under a final judgment of imprisonment for violation of any ordinance or persons confined in accordance with Penal Code Section 4022, with consent of the City, may be required by the Chief of Police to perform labor on the streets or other public property or works within the City. .020 The phrase streets or other public property or works within the City," as used in this section shall include among other things, clerical and menial labor in the City jail, or in any camp maintained for the labor of such persons on the streets or other public property, or works within the City. .030 The City Council may prescribe and enforce the rules and regulations under which such labor is to be performed; and may provide clothing of such distinctive character for said persons as the City Council in its discretion may deem proper. .040 For each month that a prisoner appears, by the record, to have satisfactorily performed labor as assigned by the Chief of Police, five days may be deducted from his period of confinement by order of the Chief of Police. For each month the prisoner appears by the record to have satisfactorily complied with the reasonable rules and regulations established by the Chief of Police, and that his conduct is reported by the officer in charge of the jail to have been satisfactory, five days may, with the consent of the Chief of Police, be deducted from his period of confinement." SECTION 3. That Title 1, Chapter 1.01, Section 1.01.385 be added to the Anaheim Municipal Code to read as follows: "1.01.385 COST OF SERVICES - REIMBURSEMENT Pursuant to Section 1203.4 subdivision (C) of the California Penal Code, any person petitioning the Municipal Court for a change of plea, or to set aside a verdict pursuant to Section 1203.4 of the Penal Code of the State of California, shall if ordered by the Municipal Court to reimburse the City the sum of Sixty Dollars ($60) for the cost of the City's services in connection with such petition." SECTION 4. CERTIFICATION The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
