93-019 RESOLUTION NO. 93R- 19 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM (i) RATIFYING THE PROCLAMATION OF A LOCAL EMERGENCY BY THE DIRECTOR OF EMERGENCY SERVICES OF THE CITY OF ANAHEIM, AND (ii) APPROVING AND AUTHORIZING CERTAIN REMEDIAL ACTIONS RELATING THERETO. WHEREAS, Section 6.04.060 of the Anaheim Municipal Code empowers the Director of Emergency Services of the city of Anaheim to proclaim the existence or threatened existence of a local emergency when the City of Anaheim is affected or likely to be affected by a public calamity and the City Council is not in session; and WHEREAS, on or about January 18, 1993, conditions of extreme peril to the safety of persons and property arose within the city of Anaheim caused by continuing earth movement and landslides within the area of the city (the "Disaster Area") described on Exhibit A of the Proclamation of the Existence of a Local Emergency by the Director of Emergency Services of the city of Anaheim (the "Proclamation"), a copy of which Proclamation is attached hereto and marked Attachment 1 hereof, which conditions of extreme peril continue to exist; and WHEREAS, on January 19, 1993, the Director of Emergency Services of the City of Anaheim did issue the Proclamation, at which time the City Council was not in session; and WHEREAS, the city Council does hereby find that the aforesaid conditions of extreme peril did warrant and necessitate the proclamation of the existence of a local emergency and the issuance of said Proclamation by the Director of Emergency Services; and WHEREAS, pursuant to Section 866(a) of the Government Code of the State of California and on the basis of expert opinion or other reasonable basis, the city Council hereby finds as follows: 1. The aforesaid Disaster Area is the subject of gradual earth movement as defined in Government Code Section 866(a); and 2. An impending peril to persons and/or property exists as a result of said gradual earth movement( the "impending peril"); and 3. The city Council has determined appropriate remedial action to halt, stabilize or abate such impending peril in the manner hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED that the City Council hereby ratifies that certain "Proclamation of the Existence of a Local Emergency by the Director of Emergency Services" dated January 19, 1993. BE IT FURTHER RESOLVED that said local emergency shall be deemed to continue to exist until its termination is proclaimed by the City Council of the City of Anaheim. BE IT FURTHER RESOLVED that the City Council of the City of Anaheim hereby determines that those certain measures (the "remedial actions") described in that certain letter dated January 25, 1993 to the City Council from Eberhart & Stone, Inc., geotechnical consultants to the City of Anaheim, a copy of which letter is attached hereto and marked Attachment 2 hereof, constitute appropriate remedial actions to halt, stabilize or abate said impending peril. BE IT FURTHER RESOLVED that the officers, employees, agents and contractors of the City of Anaheim are hereby authorized to implement said remedial actions. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the city of Anaheim this 26th day of January, 1993. That the City Council of the city of Anaheim is not in sesslon. NOW, THEREFORE, BE IT PROCLAIMED that a local emergency now exists within the above-described Disaster Area of the City of Anaheim. PURSUANT TO THE ABOVE PROCLAMATION, IT IS ORDERED AS FOLLOWS: 1. No person shall enter the Disaster Area except: (a) residents of the Disaster Area for such temporary access as may be expressly authorized by a city of Anaheim peace officer, or (b) members of the news media while in the performance of news gathering activities. 2. No person shall remain in the Disaster Area after receiving a written or oral notice or order to leave the Disaster Area from a city of Anaheim peace officer. 3. The provisions of Order No. i above shall not apply to any police, fire or other emergency service personnel, whether public or private, while engaged in providing emergency services in the Disaster Area. 4. All peace officers of the city of Anaheim are authorized to enforce the above emergency orders and to arrest any persons who do not obey said orders. 5." Violation of any of the above emergency orders shall be punishable as a misdemeanor pursuant to Sections 6.04.100 and 1.01.370 of the Anaheim Municipal Code. This proclamation is in effect beginning at 4:30 p.m., January 19, 1993, and shall continue in full force and effect untill rescinded or amended, or until the local emergency is proclaimed to be terminated. Gentlemen: The recent heavy rainfall in late December 1992 and early January 1993 has caused a significant rise of ground water levels within the Rimwood/Santiago Landslide complex, This increase in ground water levels has accelerated movement of the landslide and has caused significant damage to public and private properties. Such land movement continues to constitute an impending peril to persons and properties throughout the area referenced in the proclamation of local emergency issued by the Director of Emergency Services and dated January 19, 1993. Eberhart & Stone, Inc., has recommended several emergency measures within the affected areas, as appropriate remedial action in an attempt to halt, stabilize, or abate such impending peril. These measures include: a dewatering program consisting of horizontal and vertical dewatering wells situated in and around the toe of the landslide mass, survey monitoring of slide movement, and draining of swimming pools within the landslide area, In addition, it may be necessary to bulldoze access roads for .such wells. These measures have been, or are in the process of being, implemented with the coordination of the Engineering Department of the City of Anaheim. Horizontal wells are planned to be positioned in areas of water seepage at the toes of the slopes on Burlwood Drive, Georgetown Circle, Lehigh Circle, Pegasus Drive, Rimwood Avenue, Serrano Avenue, Williams Circle, and such other areas as may be required. These wells are estimated to extend 150 feet to 300 feet in length and will be positioned based on flow rates observed. Twenty or more horizontal wells are proposed. To date, 12 horizontal wells have been completed. Vertical dewatering wells, both shallow (50 feet to 60 feet) and deep (90 feet to 150 feet), are planned in Burlwood Drive, Georgetown Circle, Lehigh Circle, Pegasus Drive, Rimwood Avenue, Serrano Avenue, Williams Circle, and such other areas as may be required, Depending on pump rates observed, additional wells may be necessary. A'J"i'ACH NT .:__ Of _?x.. P,qGES City of Anaheim 2 W.O. 165110.69 Twenty to twenty-five vertical dewatering wells are proposed, To date, 10 vertical wells have been completed. The purpose of the dewatering wells is to lower the elevated ground water conditions, which is intended to result in relieving the increased pore water pressure acting within the slide mass. Survey monitoring of ground movement in critical areas on Georgetown Circle, Pegasus Drive, Rimwood Avenue, and Avertida de Santiago has been implemented. Survey control is initiated to monitor vertical, horizontal, and directional movement in these areas. Regularly scheduled surveys in these areas are vital to monitoring ground movement and the effects of the dewatering program. All swimming pools located within the slide mass have been drained to prevent pool water from entering the slide mass. Geologic mapping and monitoring of the changing conditions within the incident area are ongoing end are anticipated to continue indefinitely.
