93-017 RESOLUTION NO. 93R-17 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM VACATING A PORTION OF ATCHISON STREET LYING NORTHERLY OF SANTA ANA STREET (92-9A) WHEREAS, the city Council of the City of Anaheim did, by resolution duly adopted, declare its intention to vacate certain public streets, highways or public service easements pursuant to the Public Streets, Highways and Service Easements Vacation Law; and WHEREAS, notice of a public hearing to consider said vacation was posted and published in the manner prescribed by law; and WHEREAS, on the 12th day of January, 1993, a public hearing was held to allow interested persons to submit evidence concerning said proposed vacation; and NOW, THEREFORE, BE IT RESOLVED that the city Council of the city of Anaheim does hereby order the vacation of that portion of Atchison Street lying north of Santa Ana Street, more particularly described as follows: See Exhibit A attached hereto BE IT FURTHER RESOLVED that the vacation authorized by this resolution shall not be effective until a certified copy of this resoldtion is recorded in the office of the Recorder of Orange County. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a certified copy of this resolution to be recorded in the office of the Recorder of the County of Orange. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the city of Anaheim this 12th day of January, 1993. CITY CLERK OF THE CiTY OF ANAHEIM EXHIBIT "A" ABANDONMENT NO. 92-9A This description is based on Santa Ana Street having a bearing of N 74° 30' 32" E as shown on a map recorded in Book 185, pages 37 and 38 of Parcel Maps Records of Orange County, California. That portion of Atchison Street, being 60.00 feet wide and 600.00 feet in length described as follows: Commencing at the centerline intersection of Santa Ana Street and Melrose Street; thence along the centerline of Santa Ana Street N 74© 30' 32" E, to the centerline intersection of Santa Ana Street and Atchison Street; thence N 15© 18' 30" W, 34.75 feet to the True Point of Beginning; thence continuing N 15© 18' 30" W, along the centerline of Atchison Street and 30.00 feet either side of said centerline for a distance of 600.00 feet Excepting and Reserving unto the city of Anaheim an easement for public utility purposes, including ingress and egress under, upon, over and across the above described portion of Atchison Street. Also reserving therefrom unto Pacific Bell, a public utility easement to construct, place, operate, inspect, maintain, repair, replace and remove such aerial and underground telephone and telegraph and communication structures as the company may from time to time require, consisting of poles, anchors, wires, cables, conduits, manholes, markers and necessary fixtures and appurtenances, within the above described street, together with all reasonable rights of ingress and egress. Said reservation to Pacific Bell is subject to the prior rights of the City of Anaheim. Also reserving therefrom unto the Southern California Gas Company, an easement for public utility purposes for the installation and maintenance of gas line facilities over, under, along and across the above described street, together with all reasonable rights of ingress and egress. Said reservation to said Southern California Gas Company is subject to the prior rights of the City of Anaheim.
