93-014 RESOLUTION NO. 93R- ~4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLARING ITS INTENTION TO MAKE CERTAIN IMPROVEMENTS UNDER THE AUTHORITY OF THE STREET LIGHTING ACT OF 1931, DESCRIBING IMPROVEMENTS TO BE MADE, NAMING THE STREETS UPON WHICH IMPROVEMENTS ARE TO BE MADE, REFERRING TO THE REPORT OF THE SUPERINTENDENT OF STREETS ON FILE IN THE OFFICE OF THE CITY CLERK, FIXING THE PERIOD OF TIME FOR WHICH THE IMPROVEMENTS ARE TO BE MADE, AND SETTING A TIME AND PLACE FOR HEARING PROTESTS. (ASSESSMENT DISTRICT 1991-2) WHEREAS, the city Council of the City of Anaheim is of the opinion that public interest and convenience requires that a portion of the street lighting system be maintained and serviced upon certain streets in the City of Anaheim, as hereinafter set forth; and WHEREAS, the city Council did require the Superintendent of Streets to make and file with the City Clerk a written report with regard to the contemplated improvements; and WHEREAS, said report of the Superintendent of Streets was approved by the City Council of the City of Anaheim on the 12th day of January, 1993, by Resolution No. 93R-1_$_3 and filed with the city Clerk. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, as follows: 1. Public interest and convenience does require that improvements be made to certain property in the City of Anaheim, and the City Council of the City of Anaheim does hereby declare its intention to make the following described improvements under the authority of the Street Lighting Act of 1931. 2. The improvements to be made are the maintenance and servicing of a street lighting system along and upon: West, Illinois, Indiana and Ohio Streets and the west side of Citron Street between the first alley south of Lincoln Avenue and Santa Ana Street, and the north side of Santa Ana Street between Citron and West Street except those lots or parcels adjacent to Broadway. 3. A report of the Superintendent of Streets has been approved by the City Council of the City of Anaheim and is on file with the City Clerk of the City of Anaheim, designated "Street Lighting Maintenance District 1991-2." Said report contains an estimate of the cost of the improvements and incidental expenses for the period of time the improvements are to be made, a diagram or map showing the streets affected and showing each lot or parcel of land abutting such street, a proposed assessment of the total amount of the estimated cost and expenses upon the several lots or parcels of land shown on the diagram or map in proportion to the estimated benefits to be received by each lot or parcel of land for the period of time of the improvements, and plans and specifications setting out the general type of street lighting system and the location of the lights to be serviced and maintained; and reference to such report is hereby made as though set forth in full herein, and all persons are directed to such report on file with the City Clerk for more particulars. 4. The period of time for which the improvements are to be made is hereby set at five (5) years, to commence on or about July 1, 1993, and to continue for five (5) years from such date. AND BE IT FURTHER RESOLVED that the 2nd day of February, 1993, at the hour of 6:00 o'clock p.m. in the Council Chamber of the civic Center in the City of Anaheim, is hereby declared as the day, hour and place, when and where any and all persons having any objections to the proposed improvements or to the assessment as set forth in the report of the Superintendent of Streets, may appear before the legislative body and show cause why the proposed improvements should not be carried out in accordance with the report of the Superintendent of Streets on file with the City Clerk. Protests must be in writing and must contain a description of the property in which each signer thereof is interested, and be delivered to the City Clerk not later than the time set for the hearing. Protests may be against the proposed improvements or against the estimated amount of the assessment. BE IT FURTHER RESOLVED that the Superintendent of Streets of the City of Anaheim shall cause notice of the improvements and of the passage of this Resolution of Intention to be conspicuously posted along the lines of the contemplated improvements, at not more than 300 feet apart, but not less than three (3) in all, and before the date set for hearing of protests of objections. The contents of such notice shall be in conformity with the requirements of the Street Lighting Act of 1931. BE IT FURTHER RESOLVED that the City Clerk of the City of Anaheim be, and she is hereby directed to publish this Resolution of Intention by insertion in the Anaheim Bulletin, a newspaper of general circulation, published and circulated in the City of Anaheim. Such publication shall be not less than ten 2 (10) days prior to the date of public hearing as set forth in this Resolution.
