93-108 RESOLUTION NO. 93R-108 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AMENDMENTS TO THE LAND USE AND CIRCULATION ELEMENTS OF THE ANAHEIM GENERAL PLAN DESIGNATED AS GENERAL PLAN AMENDMENT NO. 331. WHEREAS, the City of Anaheim, pursuant to the recommendations of the Planning Commission of the City of Anaheim, adopted a General Plan for the City of Anaheim; and WHEREAS, on the 28th day of April, 1993, the City Planning Commission of the City of Anaheim did hold a public hearing (which hearing was closed on that date, and the matter continued to April 29, 1993, and May 19, 1993) to consider General Plan Amendment No. 331. The General Plan Amendment does consider the following: (1) Land Use Element (the following amendments apply to properties within The Disneyland Resort Specific Plan project area): a) To redesignate 5.7 acres located south of the southwestern corner of Katella Avenue and Haster Street from Medium Density Residential land uses (permitting up to 36 dwelling units per acre) to Commercial Recreation land uses; b) To add text to the General Plan Land Use Element recognizing that The Disneyland Resort Specific Plan establishes maximum Development Density designations for the Hotel District (up to 5,600 hotel rooms for the entire district with up to 1,000 hotel rooms transferable to the Theme Park District) and for the C-R Overlay (the maximum number of units permitted on a parcel in the C-R Overlay would be the following: 1) for parcels designated Low Density - up to 50 hotel rooms per gross acre or 75 rooms, whichever is greater; and 2) for parcels designated Medium Density - up to 75 hotel rooms per gross acre or 75 rooms, whichever is greater; provided that for those parcels that are developed with hotel/motel rooms which exceed the maximum density designation, that the number of rooms existing on the date of adoption of The Disneyland Resort Specific Plan Ordinance may be rebuilt or modified at their existing density); and, c) To upgrade the Water and Electrical Distribution System Maps (including the realignment of the Edison Easement between Walnut Street and Harbor Boulevard on the north side of Katella Avenue), and to amend the Storm Drain and Sewer Maps; (2) Circulation Element (the following amendments apply to properties both within and outside of The Disneyland Resort Specific Plan project area): a) To redesignate West Street between Ball Road and I-5 from a Secondary Arterial Highway (4 lanes, 90-foot right-of-way) designation to a Modified Major Arterial Highway (6 to 7 lanes, 98- to 110- foot right-of-way) designation; to delete a portion of West Street south of Ball Road from the Major Arterial Highway (6 lanes, 120-foot right- of-way) designation and create a cul-de-sac; to redesignate West Street between Cerritos Avenue and Ball Road from a Major Arterial Highway (6 lanes, 120-foot right-of-way) designation to a Resort Secondary Arterial Highway (4 lanes, 95- foot right-of-way) designation; between Cerritos Avenue and Katella Avenue from a Secondary Arterial Highway (4 lanes, 90-foot right-of-way) designation to a Resort Secondary Arterial Highway (4 lanes, 95-foot right-of-way) designation; and, to change its alignment and name to Disneyland Drive from I-5 to Katella Avenue; b) To relocate Cerritos Avenue between Walnut Street and West Street/Disneyland Drive approximately 1,000 to 1,100 feet northerly and to remove it from the Secondary Arterial Highway (4 lanes, 90- foot right-of-way) designation and redesignate it to a Resort Local Street (2 lanes, 65-foot right- of-way) designation; c) To redesignate Freedman Way between Haster Street and Harbor Boulevard from a Secondary Arterial Highway (4 lanes, 90-foot right-of-way) designation to a Modified Major Arterial Highway (6 lanes, 113-foot right-of-way) designation; d) To create a new designation entitled "Resort Smartstreet" (previously advertised as "Superstreet") and to redesignate Katella Avenue between I-5 and Walnut Street from a Major Arterial Highway (6 lanes, 120-foot right-of-way) designation to a "Resort Smartstreet" (6 lanes, 122- to 147-foot right-of-way between Walnut Street and West Street/Disneyland Drive and 8 2 lanes, 166-foot right-of-way between West Street/Disneyland Drive and I-5) designation; e) To redesignate Harbor Boulevard between I-5 and Orangewood Avenue from a Major Arterial Highway (6 lanes, 120-foot right-of-way) designation to a Resort Major Arterial Highway designation (6 lanes, 144-foot right-of-way) designation; and, f) To redesignate Clementine Street between Freedman Way and Katella Avenue from a Secondary Arterial Highway (4 lanes, 90-foot right-of-way) designation to a Modified Secondary Arterial Highway (4 lanes, 87-foot right-of-way) designation; and, WHEREAS, the property which is the subject of General Plan Amendment No. 331 encompasses the area as identified on General Plan Amendment No. 331, Figures 1 through 6, copies of which are attached hereto and incorporated herein, generally located within the city of Anaheim's Commercial Recreation Area adjacent to and southwest of the Santa Ana Freeway (I-5) and accessible from Harbor Boulevard, Ball Road, Freedman Way, Katella Avenue, West Street, Orangewood Avenue, Haster Street and Walnut Street; and WHEREAS, at said public hearing, the City Planning Commission did duly adopt its Resolution No. PC93-58 containing a report of its findings, a summary of the evidence presented at said hearing, and recommending that said Amendment to the General Plan designated as Amendment No. 311 be adopted by the City Council changing the Land Use and Circulation Elements for the aforedescribed property in accordance with Figures 3, 5 and 6 respectively (Exhibit "A" for each such element); and WHEREAS, upon receipt of said Resolution, summary of evidence, report of findings and recommendations of the City Planning Commission, the City Council did fix the 9th day of June, 1993, as the time, at the Inn at the Park Hotel in the City of Anaheim as the place for a public hearing on said proposed Amendment No. 311 and did give notice thereof in the manner and as provided by law; and WHEREAS, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports and did consider the recommendations of the City Planning Commission; and 3 WHEREAS, pursuant to the provisions of the California Environmental Quality Act, the City Council, by Resolution No. 93R-3~, did find that FEIR No. 331 with the Statement of Findings and Facts and Statement of Overriding Considerations and the corresponding Mitigation Monitoring Program No. 0067, certified June 22 , 1993, addressed the environmental impacts and mitigation measures associated with General Plan Amendment No. 331, and that FEIR No. 331 is adequate to serve as the environmental documentation for General Plan Amendment No. 331; and WHEREAS, the City Council does find and determine that Amendment No. 311 changing the land use and circulation for the aforedescribed property in accordance with Exhibit "A" for each such element, respectively, on file with the City should be approved and concurs with the findings of the Planning Commission. NOW, THEREFORE, BE IT RESOLVED by the city Council of the city of Anaheim that Amendment No. 311 to the General Plan amending the land use and circulation elements for the aforedescribed property in accordance with Figures 3, 5 and 6, respectively (Exhibit "A" to each element), on file with the city be, and the same are hereby, approved. BE IT FURTHER RESOLVED that the Planning Department be, and it is hereby, instructed to amend the General Plan Text and Map to conform to General Plan Amendment No. 311 as herein adopted and approved.
