A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND ORDERING THE
ANNEXATION TO THE CITY OF ANAHEIM OF THE
TERRITORY KNOWN AND DESIGNATED AS ANNEXATION
NO. 275 - THE COAL CANYON ANNEXATION
WHEREAS, said Local Agency Formation Commission
authorized the City of Anaheim to annex said territory without
notice and hearing and without an election pursuant to the
authority vested in said Commission by Section 56837 of the
Government Code; and
WHEREAS, said territory proposed to be annexed to said
City of Anaheim is situated in the County of Orange, State of
California, and is contiguous to the City of Anaheim, and is
uninhabited territory; and
WHEREAS, said consent contained a description of said
territory in words and figures as hereinafter described in this
resolution; and
WHEREAS, EIR No. 298 was certified by the City Council
on March 3, 1992, with a Statement of Overriding Considerations
and a corresponding Mitigation Monitoring Program in connection
with a series of project approvals, including this action; and
WHEREAS, the City Council has determined that, since
the certification of EIR No. 298, no new effects have occurred or
could occur and no new mitigation measures would be required for
approval of this action; and
WHEREAS, the City Council has determined that this
action is within the scope of EIR No. 298 and, in fact, was
stated in EIR No. 298 to be part of the project reviewed by EIR
No. 298; and
WHEREAS, the city Council has determined that no
further environmental documentation is required to be prepared
for this action; and
WHEREAS, the City Council of the City of Anaheim is
authorized to approve and order said annexation by resolution
without notice and hearing and without requirement that an
election be held in the City pursuant to the approval of said
Local Agency Formation Commission and Section 56837 of the
Government Code.
NOW, THEREFORE, BE IT RESOLVED that the city Council of
the city of Anaheim finds:
a. That proof satisfactory to the Local Agency Formation
Commission was submitted that all of the owners of land within
the territory proposed to be annexed have given their signed
consent to such annexation.
b. That said territory proposed to be annexed to said City
of Anaheim is situated in the County of Orange, State of
California, and is contiguous to the City of Anaheim, and is
uninhabited territory.
c. That said consent signed by the owner of land within
the territory proposed to be annexed contained a description of
said territory in words and figures as hereinafter in this
resolution described.
d. That the landowner filed said request to annex said
territory, containing the specific boundaries of the territory to
be annexed, with the Local Agency Formation Commission and said
Local Agency Formation Commission approved said annexation
request of the landowner pursuant to Section 56837 of the
Government Code.
e. That on the 6th day of November, 1993, the Local Agency
Formation Commission duly adopted Resolution No. 93-17 in which
said Commission authorized the City of Anaheim to annex said
territory in accordance with Section 56837 of the Government Code
and further approve such annexation of said territory without
notice or hearing by the City Council and without the requirement
that an election be held by the City on the question of said
annexation.
BE IT FURTHER RESOLVED that the annexation of the
territory included within the boundaries of Annexation No. 275,
more particularly described as follows, to wit:
SEE EXHIBIT "A" ATTACHED HERETO AND BY
THIS REFERENCE INCORPORATED HEREIN
is hereby approved and said territory is hereby ordered annexed
to and incorporated into the City of Anaheim, County of Orange,
State of California, and is hereby designated as Annexation No.
275 to the City of Anaheim.
BE IT FURTHER RESOLVED that the City Clerk is hereby
directed to transmit a certified copy of this resolution to the
Executive Officer of the Local Agency Formation Commission.
BE IT FURTHER RESOLVED that said annexation shall be
effective upon the date the Executive Officer records a certified
copy of the certificate of completion of proceedings with the
County Recorder of the County of Orange and, from and after the
effective date of such annexation, all property therein shall be
subject to taxation equally with the property within the City of
Anaheim and shall be taxed to pay its proportionate share of the
existing indebtedness and liability of said city of Anaheim
contracted prior to or existing at the time of such annexation
pursuant to the written consent of the owner of property in said
annexed territory.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 14th day of December,
1993.
