A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM
AMENDING R3tTES, RULES AND REGULATIONS FOR THE SALE AND
DISTRIBUTION OF ELECTRICITY AS ADOPTED BY RESOLUTION NO.
71R-478 AND MOST RECENTLY AMENDED BY RESOLUTION NO. 93R-178.
W/4EREAS, the City of Anaheim maintains an electric generation
and distribution system for the furnishing of electricity to
residents and inhabitants of the City of Anaheim and has adopted
Electric Rates, Rules and Regulations for the sale and distribution
of electricity; and
WHEREAS, a Notice of Hearing was published as follows:
On October 25, 1993, notice of the public hearing on electric
rates was published in the Orange County Register and proof
thereof is on file with the Secretary of the Public Utilities
Board.
WHEREAS, the Public Utilities Board held a public hearing on
November 4, 1993 and evidence was presented in connection with
proposed revisions of Electric Rates, Rules and Regulations; and
WHEREAS, the Public Utilities Board considered the proposal of
the Public Utilities Department and has considered the evidence
presented at the public hearing; and
WHEREAS, the funds and interest collected herein shall be
exclusively used for implementing the Underground Conversion
Program; and,
WHEREAS, the Public Utilities Board has made the following
findings with respect to the need for changes to the Electric
Rates, Rules and Regulations:
1. The Electric System revenue requirement of the Anaheim
Public Utilities Department for the 1993/94 fiscal year
consisting of the twelve months July 1, 1993, through
June 30, 1994, requires a 2% increase to revenues over
existing rate levels to continue funding the Underground
Conversion Program.
2. The Electric System revenue requirement of the Anaheim
Public Utilities Department fore'the 1994/95 fiscal year
requires a 1% increase to revenues from all customer
classes over existing rate levels to continue funding the
Underground Conversion Program.
3. These rate increases will bring to 4% the portion of
electric rates used to fund the Underground Conversion
Programas approved by the City Council on June 5, 1990.
Section 1221 of the City Charter provides that utility
rates charged to a class of customers shall be uniform
within the class and shall be based on cost-of-service
revenue requirement for the class.
5. In determining customer class rate levels, it is
appropriate to give consideration to both cost of service
and the retail rates of Southern California Edison.
6. It is appropriate to recognize the benefits all Anaheim
ratepayers will receive through improving the City image
of Anaheim by converting overhead electric subtransmission
and distribution facilities to underground facilities
along major streets.
7. On the basis of the preceding findings, the proposed base
rates are reasonable and appropriate.
W/4EREAS, the Public Utilities Board considered the California
Environmental Quality Act (CEQA) and made the following findings:
1. The establishment of these rates as set forth above will
ensure adequate revenues necessary to meet power supply
costs, operation and maintenance expenses, capital
expenditures, debt service requirements, reserve amounts,
intracity transfers, and other necessary operating and
maintenance expenses.
2. Thematters covered above come within Section 21080 (b) (8)
of the Public Resources Code of the State of California.
Section 21080 (b) (8) states that CEQA does not apply to
the establishment, modification, structuring,
restructuring, or approval of rates, tolls, fares, or
other charges which the public agency finds are for the
purpose of meeting operating expenses, materials, meeting
financial reserves, obtaining funds for capital projects
necessary to maintain service within existing service
areas, or obtaining funds necessary to maintain those
intracity transfers as are authorized by city charter.
Thus, the establishment of these rates is exempt from
CEQA.
WHEREAS, based on the findings hereinabove made, the Public
Utilities Board of the City of Anaheim recommended to the City
Council that the Council, by Motion, adopt the findings of the
Public Utilities Board with respect to the matters contained herein
and, by Resolution, adopt the changes to the Electric Rates, Rules
and Regulations as shown in Appendices D and F; and
WHEREAS, based on the findings hereinabove made, the Public
Utilities Board of the City of Anaheim recommended to the City
Council that the Council, by Motion, certify that the adoption of
the Electric Rates, Rules and Regulations is statutorily exempt
under CEQA, Public Resource Code, Section 21080 (b) (8), in
accordance with Title 14 of the Code of California Regulations,
Section 15273 (a), and authorize the City Manager to execute, and
the City Clerk to file, a Notice of Exemption for same with the
Orange County Clerk; and
WHEREAS, the City Council has considered the evidence and
concurs with the findings of the Public Utilities Board as set forth
hereinabove.
NOW, THEREFORE BE IT RESOLVED that:
1. The changes and additions to the Electric Rates, Rules and
Regulations as shown in Appendices D and F are hereby
adopted by the City Council of the City of Anaheim and
will become effective January 3, 1994, and January 2,
1995, respectively.
2. The Public Utilities General Manager is hereby authorized
and directed to prepare, promulgate, publish, and
implement changes to the Electric Rates, Rules and
Regulations as set forth herein.
THE FOREGOING RESOLUTION is approved and adopted by the City
Council of the City of Anaheim on this 30th day of November ,
1993.

GENERAL SERVICE - EXPERIMENTAL
APPLICABILITY
For purposes of business development and retention, applicable to single and three
phase general service, including lighting and power, for production and
manufacturing operations within the City of~nahelm with 15 kw demand or greater,
but less than 200 kw demand. This schedule is available to customers whose normal
production hours would include the on-peak time periods as specified in the
Special Conditions set forth herein and who can demonstrate to the Public
Utilities General Manager that it would be to the customer's economic advantage
to locate operations elsewhere. Eligibility for this schedule is solely at the
discretion of the Public Utilities General Manager and the number of customers on
the schedule at any time may be limited.

SPECIAL CONDITIONS
A. Service voltage per rules and regulations.
B. The Facilities charge shall be based on the rated transformer capacity, which
shall be 50 percent of the installed transformer kilovolt-amperes dedicated to the
customer, or the highest demand recorded in the preceding eleven billing periods,
whichever is greater, but in no event shall it be less than 15 kw.
C. The MaximumDemand shall be the average kilowatt load to the nearest one-tenth
kilowatt during the 15-minute period of greatest use at any time during a rating
interval, as recorded by the Department's meter. In cases where demand is
intermittent or subject to severe fluctuations, the Department may establish the
~aximum Demand on the basis of measurement over a shorter interval of time or the
kilovolt-amperes of installed transformer capacity required to meet the customer's
load.

This schedule is mandatory for all customers whose monthly maximum demand has
exceeded 200 kw for any three months during the preceding 12 months and whose
average demand for the preceding 12 months also exceeds 200 kw. Any customer
whose monthly maximum demand has fallen below 200 kw for any three months during
the preceding 12 months and whose average demand for the preceding 12 months also
is less than 200 kw may elect to take service on Schedule GS-1B

B. Billing Demand:
The billing demand in any month shall be the average kilowatt input
indicated or recorded by instruments to be supplied, owned, and maintained by the
City and at the City's expense upon the consumer's premises adjacent to the
watt-hour meter, in the 15 minute interval which the consumption of electric
ener9y is greater than in any other 15 minute interval in the month, but not less
than either (1) 50% of the contracted for or connected load, or (2) 50% of the
highest billing demand in the preceding eleven months, whichever is the greater.
However, in no case shall the billing demand be less than 200 KW. Billing demand
shall be determined to the nearest KW. Whenever the measured maximum demand has
exceeded 400 KW for three consecutive months and thereafter until it has fallen
below 300 KW for 12 consecutive months, a 30 minute interval will be used. Where
the demand is intermittent or subjected to violent fluctuations, the maximum
demand may be based on a shorter interval.

preceding 12 months or, if no prior billing history is available, whose total

customers who meet eligibility requirements prior to installation of load
management and conservation measures included in the Department's Demand Side
Management programs.
AVAILABILITY
A customer desiring service on this schedule or currently served on this schedule
and desiring service on a different schedule shall notify the City in writing at
least ninety (~) 30 days in advance of his intended change in service schedule,
(unless meter availability allows less notice), and will be restricted from
exercising the option to switch schedules more than once in any twelve-month
period.

A customer meeting the requirements set forth above and desiring service on this
schedule, or currently served on this schedule and desiring service on a different
schedule, shall notify the City in writing at least ninety (~) 30 days in advance
of his intended change in service schedule (unless meter availability allows less
notice). A customer will be retricted from exercising the option to switch
schedules more than once in any twelve-month period.

SPECI~J~ CONDITIONS
A. Area lighting service will be furnished from dusk to dawn, approximately 4,140
hours per year, by utility-owned lumlnaires supplied from the utility's existing
120/240 volt overhead circuits and mounted on existing utility-owned wood poles
as standard equipment. Where the service requested required the installation of
additional new wood poles, not more than one new wood pole will be installed for
each luminaire in the installation.
B. Where the customer requests the installation of other than the standard
equipment furnlshedby the utility and such requested equipment is acceptable to
the utility, the utility will install the requested equipment provided the
customer agrees to advance the estimated difference in cost installed between such
equipment and standard equipment. Advances made for this purpose will not be
refunded. Facilities installed in connection with such agreements become and
remain the sole property of the utility.
C. This service will be in accordance with utility's specifications as to
equipment, installation, maintenance and operation.

APPLICABILITY
For purposes of business development and retention, applicable to single and three
phase general service, including lighting and power, for production and
manufacturing operations within the City of Anaheim with 15 kw demand or greater,
but less than 200 kw demand. This schedule is available to customers whose normal
production hours would include the on-peak time periods as specified in the
Special Conditions set forth herein and who can demonstrate to the Public
Utilities General Manager that it would be to the customer's economic advantage
to locate operations elsewhere. Eligibility for this schedule is solely at the
discretion of the Public Utilities General Manager and the number of customers on
the schedule at any time may be limited.

C. The MaximumDemand shall be the average kilowatt load to the nearest one-tenth
kilowatt during the 15-minute period of greatest use at any time during a rating
interval, as recorded by the Department's meter. In cases where demand is
intermittent or subject to severe fluctuations, the Department may establish the
Maximum Demand on the basis of measurement over a shorter interval of time or the
kilovolt-amperes of installed transformer capacity required to meet the customer's
load.

B. Billing Demand:
The billing demand in any month shall be the average kilowatt input
indicated or recordedby instruments to be supplied, owned, and maintained by the
City and at the City's expense upon the consttmer's premises adjacent to the
watt-hour meter, in the 1S minute interval which the consumption of electric
ener9y is greater than in any other 15 minute interval in the month, but not less
than either (1) 50% of the contracted for or connected load, or (2) 50% of the
highest billing demand in the preceding eleven months, whichever is the greater.
However, in no case shall the billing demand be less than 200 KW. Billing demand
shall be determined to the nearest KW. Whenever the measured maximum demand has
exceeded 400 KW for three consecutive months and thereafter until it has fallen
below 300 KW for 12 consecutive months, a 30 minute interval will be used. Where
the demand is intermittent or subjected to violent fluctuations, the maximum
demand may be based on a shorter interval.

C. Power Cost Adjustment: The rates above are subject to adjustment as provided
for in Schedule PCA. The applicable power cost adjustment billing factor set
forth therein will be applied to 345/kwh per month per KW of lamp load for all
night service.

SPECIAL CONDITIONS
A. Area lighting service will be furnished from dusk to dawn, approximately 4,140
hours per year, by utility-owned lumlnaires supplied from the utillty's existing
120/240 volt overhead circuits and mounted on existing utility-owned wood poles
as standard equipment. Where the service requested required the installation of
additional new wood poles, not more than one new wood pole will be installed for
each luminaire in the installation.
B. Where the customer requests the installation of other than the standard
equipment furnished by the utility and such requested equipment is acceptable to
the utility, the utility will install the requested equipment provided the
customer agrees to advance the estimated difference in cost installed between such
equipment and standard equipment. Advances made for this purpose will not be
refunded. Facilities installed in connection with such agreements become and
remain the sole property of the utility.
C. This service will be in accordance with utility's specifications as to
equipment, installation, maintenance and operation.
